CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE TO AG- RESIDENTIAL ORDINANCE NO. `7o t (aoo S 1 WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning and Zoning Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning and Zoning Committee held a public hearing on the rezoning request of MARTHA ROHL FAMILY TRUST on August 3, 2005, in the St. Croix County Government Center in Hudson, Wisconsin; and WHEREAS, the St. Croix County Planning and Zoning Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: 231.94 +/- Acres located in the E' /Z of the NW' /o and part of the S' /2 of the S 1 /z of Section 12 and part of the N 1 /z of the N' /2 of Section 13, T28N -R19W, Town of Troy (See attached) Based on the following findings: 1. The Town of Troy has recommended approval and identified that the proposed use is in compliance with WSS 91.77. 2. The proposed use can comply with standards in the Land Use, Subdivision and Sanitary ordinances. 3. The parcel is in the rural planning area and is an appropriate use. 4. The request is consistent with the surrounding neighborhood, countryside or terrain. 5. The proposed use has minimal potential to adversely impact water resources with sedimentation resulting from erosion. 6. The proposed use has minimal potential to adversely impact shoreland areas or wetlands and closed depressions located in shoreland areas. 7. The proposed use has minim potential to adversely impact closed depressions or wetlands. 8. The proposed use is consistent with the spirit and intent of the ordinance. 9. The impacts associated with development can be mitigated through proper engineering and design approved through the subdivision approval process. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the 231.94 +/- acre parcel in the Town of Troy is now rezoned from Agriculture to Ag/Residential.
