ST. CROIX COUNTY LAND USE ORDINANCE
REZONING LAND FROM AG- RESIDENTIAL TO COMMERCIAL
ORDINANCE NO. 7():, LAU -)S)
WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development
Committee to act in all matters pertaining to county planning and zoning; and
WHEREAS, the St. Croix County Board has established the St. Croix County Planning and
Zoning Committee; and
WHEREAS, at the request of the County Board this Committee is to review petitions, hold
public hearings, and present its recommendations for rezoning requests to the County Board for
action; and
WHEREAS, the St. Croix County Planning and Zoning Committee held a public hearing on
the rezoning request of NEW HORIZON HOMES on June 8, 2005, in the St. Croix County
Government Center in Hudson, Wisconsin; and
WHEREAS, the St. Croix County Planning and Zoning Committee having considered all
written information and verbal testimony presented at the hearing, voted to approve a rezoning of
the following described land:
12.207 -acres located in part of the NW I /4 of the NW 1 /4, Section 23, T30N -R18W, Town
of Richmond. (See attached)
Based on the following findings:
1. The Town of Richmond has recommended approval of the request.
2. Rezoning to Commercial would be consistent with similarly zoned properties in the
immediate vicinity.
3. Aside from access issues, a commercial use could most likely comply with standards in the
Land Use, Subdivision and Sanitary ordinances.
4. The proposed use has little potential to have an adverse impact from increased stormwater
runoff.
5. The proposed use has little potential to adversely impact water resources with sedimentation
resulting from erosion.
6. The proposed use has little potential to adversely impact shoreland areas or wetlands and
closed depressions located in shoreland areas.
7. The proposed use has little potential to adversely impact closed depressions or wetlands.
8. The proposed use will not impact development on slopes in excess of 20 %.
9. The proposed use is not in conflict with the St. Croix County Natural Resources Management
Plan.
10. The proposed use is consistent with the spirit and intent of the ordinance.
With the following condition:
1. Prior to issuance of a building permit or occupancy permit for a use on the rezoned parcel, the
landowner shall cause a certified survey map to be made of the property and filed with the
register of deed.
THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting
in regular session, that the 12.207 +l -acre parcel in the Town of Richmond is now rezoned from
Ag(Residential to Commercial.

This description and area is based on the Certified Survey Map (CSM) as recorded in the St. Croix County
Register of Deeds office in Volume 14 of CSM's Page 3947.
Being Lot 4 of Certified Survey Map Document No. 629850 as recorded in the St. Croix County Register of
Deeds office in Volume 14 of CSM's Page 3947 located within the Northwest Quarter of the Northwest Quarter
(NW/NW) of Section 23, Township 30 North, Range 18 West, Town of Richmond, St. Croix County,
Wisconsin being described as follows:
Commencing at the Northwest Corner of Section 23, thence on an assumed bearing South 89 degrees 44
minutes 42 seconds East along the north line of said section a distance of 598.02 feet to the point of beginning;
thence South 00 degrees 11 minutes 53 seconds East 291.37 feet to a point; thence North 89 degrees 44 minutes
42 seconds West 598.02 feet to a point on the west line of said section; thence South 00 degrees 11 minutes 53
seconds East along said west line 772.27 feet to a point on the north line of Lot 2 of Volume 12 of CSM's Page
3342; thence South 89 degrees 48 minutes 46 seconds East along last said north line 664.02 feet to a point;
