ST. CROIX COUNTY LAND USE ORDINANCE
REZONING LAND FROM AGRICULTURE TO AG- RESIDENTIAL
ORDINANCE NO. - 7 &4 (R60s)
WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development
Committee to act in all matters pertaining to county planning and zoning; and
WHEREAS, the St. Croix County Board has established the St. Croix County Planning and
Zoning Committee; and
WHEREAS, at the request of the County Board this Committee is to review petitions, hold
public hearings, and present its recommendations for rezoning requests to the County Board for
action; and
WHEREAS, the St. Croix County Planning and Zoning Committee held a public hearing on
the rezoning request of JOHN HILSEN on July 27, 2005, in the St. Croix County Agricultural
Center in Baldwin, Wisconsin; and
WHEREAS, the St. Croix County Planning and Zoning Committee having considered all
written information and verbal testimony presented at the hearing, and finding that the request
meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following
described land:
83.7 + /- acres located in the SE' /4 of the NW '/4, the NE I/4 of the SW '/4, the SE 1 /4 of the
SW 1 /4,all in Section 11, T30N -R19W, Town of Somerset (See attached)
Based on the following findings:
1. The Town of Somerset has recommended approval and identified that the proposed use is in
compliance with WSS 91.77.
2. It appears that the proposed use can comply with standards in the Land Use and Sanitary
Ordinances.
3. The parcel is in the rural planning area and is an appropriate use.
4. The proposed use is consistent with minimum lot size requirements in the rural planning area.
5. The request is consistent with surrounding neighborhood, countryside or terrain.
6. The request is not in conflict with the policy to protect or preserve agricultural land.
7. The request is not in conflict with the goal to preserve agricultural land for crop productin,
scenic values, and wildlife habitat.
8. The proposed use is consistent with the spirit and intent of the ordinance.
THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting
in regular session, that the 83.70 +/- acre parcel in the Town of Somerset is now rezoned from
Agriculture to Ag/Residential.

Commencing at the S1 /4 Corner of said Section 11; thence N89 0 19'54 "W, along the
south line of the SW 1 /4 of said section, 1215.45 feet to the west line of Certified Survey
Map recorded in Volume 12, Page 3387 at the St. Croix County Register of Deeds office;
being the point of beginning; thence continuing N899 9'54 "W, along said south line,
100.00 feet to the west line of the El /2 of the SW 1 /4; thence NO1 0 02'25 "E, along last said
west line, 2612.95 feet to the east - west 1/4 line; thence S89 °52'39 "E, along said 1/4 line,
14.17 feet to the monumented east line of the parcel of land described in Warranty
Deed Recorded in Book 773, Page 125 at the above said office; thence N00 °25'24 "E,
along said east line and the monumented east line of the parcels of land described in
Warranty Deed recorded in Volume 573, Page 318 and Quit Claim Deed recorded in
Book 832, Page 465 at said office, 1268.58 feet to the southerly right -of -way line of
Wisconsin Central Limited Railroad and a point on a 3870.00 foot radius curve, concave
northerly, whose central angle measures 19 °21'39 ", whose chord bears S82 0 17'05.5 "E and
measures 1301.50 feet; thence easterly, along the arc of said curve and said right -of-
way line, 1307.71 feet to the north - south 1/4 line; thence S00 °41'53 "W, along said 1/4
line, 2519.93 feet to the north line of said Certified Survey Map; thence N89 °20'1 TW,
along said north line, 660.00 feet to the northwest line of said Certified Survey Map;
thence S37 °35'30 "W, along said northwest line, 920.60 feet to said west line of said
Certified Survey Map; thence S01 *02'25"W, along said west line, 465.97 feet to the point
of beginning. Described parcel contains 83.70 acres (3,645,893 Sq. Ft.)
Described parcel is subject to town road (160th Avenue) right -of -way and all other
easements, restrictions, and covenants of record.
