ORDINANCE AMENDING CHAPTER 17
ST. CROIX COUNTY LAND USE ORDINANCE
REZONING LAND FROM CONSERVANCY TO AG- RESIDENTIAL
ORDINANCE NO. G (o C dS
WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development
Committee to act in all matters pertaining to county planning and zoning; and
WHEREAS, the St. Croix County Board has established the St. Croix County Planning and
Zoning Committee; and
WHEREAS, at the request of the County Board this Committee is to review petitions, hold
public hearings, and present its recommendations for rezoning requests to the County Board for
action; and
WHEREAS, the St. Croix County Planning and Zoning Committee held a public hearing on
the rezoning request of the WISCONSIN DEPARTMENT OF NATURAL RESOURCES on
July 27, 2005, in the St. Croix County Agricultural Center in Baldwin, Wisconsin; and
WHEREAS, the St. Croix County Planning and Zoning Committee having considered all
written information and verbal testimony presented at the hearing, voted to approve a rezoning of
the following described land:
.21 +/- acres located in part of the NW 1 /4 of the NE 1 /4, Section 28, T31N -R19W, Town
of Somerset (See attached)
Based on the following findings:
1. The Town of Somerset has recommended approval of the request.
2. The proposed us does comply with standards in the Land Use, Subdivision and Sanitary
ordinances.
3. The proposed use is consistent with the spirit and intent of the ordinance.
4. The parcel is in the rural planning area and is an appropriate use.
5. The request is consistent with the surrounding neighborhood, countryside or terrain.
6. The proposed use has minimal potential to adversely impact stormwater management.
7. The proposed use has minimal potential to adversely impact water resources with
sedimentation resulting from erosion.
8. The proposed use has minimal potential to adversely impact shoreland areas or wetlands and
closed depressions located in shoreland areas.
9. The proposed use has minim potential to adversely impact closed depressions or wetlands.
10. The proposed use is consistent with restricting development on slopes in excess of 20 %.
11. The proposed use is consistent with policies to preserve woodlands, prairie remnants, unique
open spaces, or environmental corridors.
12. The proposed use is consistent with the goal to protect and enhance surface waters and
wetlands to preserve their ecological functions and recreational and scenic values.
13. The proposed use is consistent with the goal to protect and restore fish and wildlife habitats
or native species, improved water quality, recreational opportunities, and natural beauty.
14. The proposed use is generally consistent with the St. Croix County Natural Resources
Management Plan.
With the following condition:
1. Prior to issuance of a building permit or occupancy permit for a use on the rezoned parcel, the
landowner shall cause a certified survey map to be made of the property and filed with the
register of deed.
THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting
in regular session, that the .21 +/- acre parcel in the Town of Somerset is now rezoned from
Conservancy to Ag/Residential.

The following is a parcel description of lands labeled as Rezone Area II in
the proposed Certified Survey Map.
DESCRIPTION
Part of the Northwest Quarter of the Northeast Quarter of Section 28,
Township 31 North, Range 19 West, Town of Somerset, St. Croix County,
Wisconsin more particularly described as follows:
Commencing at the Northeast corner of said Section 28,
Thence S00 °10'27 "E, along the east line of the Northeast Quarter of said
Section 28, a distance of 660.27 feet; Thence N89 °58'53 "W, along the south
line of the north half of said Northeast Quarter, a distance of 1337.31 feet, to
the southeast corner of the north half of the Northwest quarter of said
Northeast Quarter and point of beginning of the parcel herein described:
Thence S00 °16'47 "E, a distance of 50.00 feet;
Thence N88 °28'37 "W, a distance of 195.32 feet;
Thence N00 °01'07 "E, a distance of 44.87 feet, to the south line of said north
half;
Thence S89 °58'53 "E, along said south line, a distance of 194.99 feet, to the
point of beginning.
