ST. CROIX COUNTY LAND USE ORDINANCE
REZONING LAND FROM AGRICULTURE TO AG-RESIDENTIAL

WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development
Committee to act in all matters pertaining to county planning and zoning; and
WHEREAS, the St. Croix County Board has established the St. Croix County Planning and
Zoning Committee; and
WHEREAS, at the request of the County Board this Committee is to review petitions, hold
public hearings, and present its recommendations for rezoning requests to the County Board for
action; and
WHEREAS, the St. Croix County Planning and Zoning Committee held a public hearing on
the rezoning request of BRUCE AND JOSEPH ACTERHOF on September 7, 2005, in the St.
Croix County Government Center in Hudson, Wisconsin; and
WHEREAS, the St. Croix County Planning and Zoning Committee having considered all
written information and verbal testimony presented at the hearing, and finding that the request
meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following
described land:
2.99 +/- acres in the NE' /4 of the NE 1 /4, Section 36, T29N -R16W, Town of Baldwin.

Based on the following findings:
1. The Town of Baldwin has reviewed the rezoning and recommends approval after considering
§91.77 in making their recommendation.
2. It appears that the proposed use can comply with standards in the Land Use, Subdivision and
Sanitary ordinances.
3. The proposed use is consistent with the spirit and intent of the ordinance.
4. The parcel is in the rural planning area and is an appropriate use.
5. The proposed use is consistent with minimum lot size requirements in the rural planning area.
6. The request is consistent with the surrounding neighborhood, countryside or terrain.
7. The proposed use has minimal potential to adversely impact stormwater management and can
be easily managed.
8. The proposed use has minimal potential to adversely impact water resources with
sedimentation resulting from erosion.
9. The proposed use has minimal potential to adversely impact shoreland areas or wetlands and
closed depressions located in shoreland areas.
10. The proposed use has minimal potential to adversely impact closed depressions or wetlands.
11. The proposed use is generally consistent or not in conflict with the St. Croix County Natural
Resources Management Plan.
With the following condition:
1. Prior to issuance of a building permit or occupancy permit for use on the rezoned parcel, the
landowner shall cause a certified survey map to be made of the property and filed with the
Register of Deeds/
THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting
in regular session, that the 2.99 +l- -acre parcel in the Town of Baldwin is now rezoned from
Agriculture to Ag- Residential.

Commencing at the northeast comer of said Section 36;
Thence South 00 degrees 12 minutes 44 seconds West, along the east line of the
Northeast Quarter of said Section 36, a distance of 482.00 feet to the POINT OF
BEGINNING;
Thence South 90 degrees 00 minutes 00 seconds West, along the line described in
Volume 1251, Page 092 on record at the Saint Croix County Register of Deeds
Office, 431.00 feet;
Thence South 00 degrees 00 minutes 00 seconds West, along the line described in
Volume 1251, Page 092 on record at the Saint Croix County Register of Deeds
Office, 303.00 feet;
Thence South 90 degrees 00 minutes 00 seconds East 429.88 feet to a point on
the east line of the Northeast Quarter of said Section 36;
Thence North 00 degrees 12 minutes 44 seconds East, along the east line of the
Northeast Quarter, 303.00 feet to the POINT OF BEGINNING and there terminating.
Including the right of way, this parcel contains 130,422 square feet — 2.994 acres.
Excluding the right of way, this parcel contains 120,423 square feet — 2.765 acres.
