ST. CROIX COUNTY LAND USE ORDINANCE
REZONING LAND FROM AGRICULTURE TO AG- RESIDENTIAL
ORDINANCE NO. 710 C ZUO.S)
WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development
Committee to act in all matters pertaining to county planning and zoning; and
WHEREAS, the St. Croix County Board has established the St. Croix County Planning and
Zoning Committee; and
WHEREAS, at the request of the County Board this Committee is to review petitions, hold
public hearings, and present its recommendations for rezoning requests to the County Board for
action; and
WHEREAS, the St. Croix County Planning and Zoning Committee held a public hearing on
the rezoning request of GILLEN LIME QUARRY AND TRUCKING, INC. on September 7,
2005, in the St. Croix County Government Center in Hudson, Wisconsin; and
WHEREAS, the St. Croix County Planning and Zoning Committee having considered all
written information and verbal testimony presented at the hearing, and finding that the request
meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following
described land:
20 +/- acres in the W' /2 of the SW 1 /4 of the NE 1 /4, Section 10, T30N -R17W, Town of
Erin Prairie. (See attached)
Based on the following findings:
1. The Town of Erin Prairie has reviewed the rezoning and recommends approval after
considering §91.77 in making their recommendation.
2. It appears that the proposed use can comply with standards in the Land Use, Subdivision and
Sanitary ordinances.
3. The proposed use is consistent with the spirit and intent of the ordinance.
4. The parcel is in the rural planning area and is an appropriate use.
5. The proposed non - residential use is consistent with the rural character of the area and is not
otherwise essential to the area.
6. The request is consistent with the surrounding neighborhood, countryside or terrain.
7. The proposed use does provide a buffer for residential development from nearby agricultural
uses or non - metallic mining.
8. The proposed use has a significant potential to adversely impact stormwater management and
cannot be easily managed.
9. The proposed use has minimal potential to adversely impact water resources with
sedimentation resulting from erosion.
10. The proposed use has minimal potential to adversely impact shoreland areas or wetlands and
closed depressions located in shoreland areas.
11. The proposed use has minimal potential to adversely impact closed depressions or wetlands.
12. The proposed use is consistent with restricting development on slopes in excess of 20 %.
13. The proposed use is consistent with policies to preserve woodlands, prairie remnants, unique
open spaces, or environmental corridors.
14. The proposed use is generally consistent or not in conflict with the St. Croix County Natural
Resources Management Plan.
With the following condition:
1. Prior to issuance of a building permit or occupancy permit for use on the rezoned parcel, the
landowner shall cause a certified survey map to be made of the property and filed with the
Register of Deeds.
THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting
in regular session, that the 20 -acre parcel in the Town of Erin Prairie is now rezoned from
Agriculture to Ag- Residential.

The following described parcel is what is being added to the existing Gillen Rock Quarry. This
description can be used for the rezoning process as well as the quit claim deed to attach this land
to the quarry. An affidavit will have to be filed with the quit claim deed to be consistent with St
Croix County Zoning "policy", As a Land Surveyor I have to recommend that a map of survey
accompany the description but it is not required by the St. Croix County Zoning Office,

A parcel of land located in the SW % of the NE % of Section 10, T30N, R17W, Town of Erin Prairie,
St Croix County, Wisconsin, being the W % of the said SW Y4 of the NE'/. of Section 10, further
described as follows:
Commencing at the E' /, Comer of said Section 10; thence N8n2'52'W 1987.93' along the East-
West % Section One of slid Section 10 b the point of beginning; thence continuing NM2'52"W
662.64' along said East West % Section line to the Center of Section 10 (C %); thence N01°
07'11 "W 1346.42' along the North -South X Section line of said Section 10; thence S89'S3'58 "E
664.97'; thence 501'01'14 "E 1346.58' to the point of beginning, containing 893,625 square feet
( 20.515 acres ) more or less and being subject to any easements, restrictions and covenants of
record.
