Exhibits: 1) Staff Report 2) Application for variance 3) Photos 4) Zoning Map BACKGROUND: The applicant requests a 125 -foot variance from the 200 ft. ordinary high water mark of the Lower St. Croix Riverway and a variance from the 100 ft. bluff line setback to construct an addition onto an existing single - family home located in the Lower St. Croix Riiverway District. The applicant requests to construct a 14 -foot by 23 -foot addition onto the north side of the house. The property is located in the Town of Somerset, in the "Federal zone" of the Lower St. Croix Riverway (north of Stillwater). The area north of Stillwater is commonly referred to as the Federal riverway zone; while the area south of Stillwater (in Wisconsin) is commonly referred to as the "State riverway zone ". On February 15, 2000, the St. Croix County Board of Supervisors approved a zoning ordinance amendment to the Lower St. Croix Riverway District. The amendment removed the overlay riverway district located in the "Federal zone" of the Lower St. Croix Riverway District (that area of the riverway located north of Stillwater), as this area is subject to scenic easements with the National Park Service. The State of Wisconsin filed a lawsuit against St. Croix County shortly after February 15 challenging the County's amendment to the Federal zone of the Lower St. Croix Riverway District. This amendment was found to be illegal by the court. Since the court ruled in favor of the State, the County is now enforcing the Lower St. Croix Riverway overlay district ordinance in the area also referred to as the Federal zone. Since this property is located in the Federal zone, it is also subject to scenic easements, which are administered by the National Park Service (NPS). The NPS purchased easements from property owners in the 1970's along the upper 27 miles of the St. Croix River corridor (Federal zone). These easements contain conditions that stipulate what land use activities need approval from the NPS. In letters dated February 19, 2002 and April 10, 2002, the NPS stated the conditions of the scenic easement have been met for this project. 1997 BOA DECISION The BOA denied a similar request to the Neumeier's in July of 1997. A copy of the decision is included in your packet. The applicant is reapplying for the variance as he has now obtained approval for this project from the NPS. Upon approval of the NPS and during the interim period where the County had removed the Lower St. Croix Riverway overlay regulations in the Federal zone, the applicant applied for a building permit from the Town of Somerset. The Town issued a building permit for this project on March 27, 2002 Once zoning staff was informed that the DNR successfully won their lawsuit (reinstating Lower St. Croix Riverway Zoning in the Federal zone) the zoning department informed the Town and the applicant that a building permit to expand the structure couldn't be issued to this structure without an approved variance. AGENCY REVIEW This application was forwarded to the St. Croix County Land and Water Conservation Department, Wisconsin Department of Natural Resources, US National Park Service and the US Army Corps of Engineers for comment on July 24, 2002. The National Park Service has responded to this request in letters dated February 19, and April 10 2002. The NPS has certified that this request complies with the scenic easements on the property. The DNR submitted a letter dated August 15, 2002 objecting to this variance request. Section 17.36 (6) (0 2 of the St. Croix County Lower St. Croix Riverway ordinance states that variances shall not be approved over the objection of the Department (DNR). These letters are found in the application materials. SITE REVIEW: The properties adjacent to this site are all located in the Lower St. Croix Riverway District. TOWN BOARD RECOMMENDATION: A copy of the application was sent to the Town of Somerset on July 22, 2002. A building permit has been issued for this project. STAFF SUMMARY: Variance Requests: The Board of Adjustments has the authority to issue a variance only when the statutory variance criteria are satisfied. Those criteria are according to State Statutes 59.694. 59.694 (7) (c) To authorize upon appeal in specific cases variances from the terms of the ordinance that will not be contrary to the public interest, where, owing to special conditions, a literal enforcement of the provisions of the ordinance will result in unnecessary hardship, and so that the spirit of the ordinance shall be observed and substantial justice done. The Board of Adjustment must stipulate findings to support their variance decision (for approval or denial).
