Code ' Senti_c Tank The septic tank shall be maintained by an individual certified to service septic tanks under s. 281.48, Slats. The contents of the septic tank shall be disposed of in accordance with NR 113, Wis. Adm. Code. The operating condition of the septic tank and outlet filter shall be assessed at least once every 3 years by inspection. The outlet filter shall be cleaned as necessary to ensure proper operation. The filter cartridge should not be removed unless provisions are made to retain solids in the tank that may slough off the filter when removed from its enclosure. If the filter is equipped with an alarm, the filter shall be serviced if the alarm is activated continuously. Intermittent filter alarms may indicate surge flows or an impending continuous alarm. The septic tank shall have its contents removed when the volume of sludge and scum in the tank exceeds 1/3 the liquid volume of the tank, If the contents of the tank are not removed at the time of a triennial assessment, maintenance personnel shall advise the owner of when the next service needs to be performed to maintain less than maximum scum and sludge accumulation in the tank. The addition of biological or chemical additives to enhance septic tank performance is generally not required. However, if such products are used they shall be approved for septic tank use by the Department of Commerce, Safety and Buildings Division. Pum Tank The pump (dosing) tank shall be inspected at least once every 3 years. All switches, alarms, and pumps shall be tested to verify proper operation. If an effluent filter is installed within the tank it shall be inspected and serviced as necessary. Mound and Pressure Distribution Svstem No trees or shrubs should be planted on the mound. Plantings may be made around the mound's perimeter, and the mound shall be seeded and mulched as necessary to prevent erosion and to provide some protection from frost penetration. Traffic (other than for vegetative maintenance) on the mound is not recommended since soil compaction may hinder aeration of the infiltrative surface within the mound and snow compaction in the winter will promote frost penetration. Cold weather installations (October - February) dictate that the mound be heavily mulched for frost protection. Influent quality into the mound system may not exceed 220 mg/L B005, 150 mg/L TSS, and 30 mg /L FOG. Influent flow may not exceed maximum design flow specified in the permit for this installation. The pressure distribution system is provided with a flushing point at the end of each lateral, and it is recommended that each lateral be flushed of accumulated solids at least once every 18 months. When a pressure test is performed it should be compared to the initial test when the system was installed to determine if orifice clogging has occurred and if orifice cleaning is required to maintain equal distribution within the dispersal cell. Observation pipes within the dispersal cell shall be checked for effluent ponding. Ponding levels shall be reported to the owner, and any levels above 4 inches considered as an impending hydraulic failure requiring additional, more frequent monitoring. General This system shalt be operated in accordance with Comm 82 -84 Wis. Adm. Code, and shall maintained in accordance with its' component manual [SBO- 10572 -P (R. 6/99)] and local or state rules pertaining to system maintenance and maintenance reporting. No one should ever enter a septic or pump tank since dangerous gases may be present that could cause death. Septic and Pump tank abandonment shall be in accordance with Comm 83.33, Wis. Adm. Code when the tanks are no longer used as POWTS components. Septic or pump tank manhole risers, access risers and covers should be inspected for water tightness and soundness. Access openings used for service and assessment shall be sealed watertight upon the completion of service. Any opening deemed unsound, defective, or subject to failure must be replaced. Exposed access openings greater than 8- inches in diameter shall be secured by an effective locking device to prevent accidental or unauthorized entry into a tank or component. Continaencv Plan If the septic tank or any of its components become defective the tank or component shall be repaired or replaced to keep the system in proper operating condition. If the dosing tank, pump, pump controls, alarm or related wiring becomes defective the defective component shall be immediately repaired or replaced with a component of the same or equal performance. If the mound component fails to accept wastewater or begins to discharge wastewater to the ground surface, it will be repaired or replaced in its' present location by increasing basal area if toe leakage occurs or by removing biologically clogged adsorption and dispersal media, and related piping, and replacing said components as deemed necessary to bring the system into proper operating condition. Furthermore, any public utility installing any improvements within the Private Road shall restore the surface of the Private Road to its condition existing before the installation. 1,616, I A 2431P 511 8. Collection. The right to collect or enforce the collection of charges assessable to the Owners is exclusively delegated to the Declarant. The Owner of a Lot, or any portion of a Lot, shall be personally obligated to pay charges that were assessed or, accrued upon the land owned during the period of ownership. All charges that are unpaid when due shall from that date become and remain a lien upon the Lot until paid, with interest on the charges from the due date of 12% per annum until paid in full. The Declarant shall have the sole right to bring all actions and proceedings for the collection of the charges and for the enforcement of liens securing the charges. Any liens securing unpaid charges arising by virtue of this Declaration shall be subject and subordinate to the lien of any first -lien mortgage whether the mortgage is executed or recorded before or after the creation of the liens. Nothing in this Declaration shall prevent or impede the collection of lawful charges, taxes, or similar charges by the Municipality. The Declarant may commence a collection action against any Owner personally obligated to pay the charges or an action to foreclose the lien for the charges against any Lot. Any such foreclosure action may be brought, at the Declarant's election, either in the same manner as an action to foreclose a real estate mortgage or as a proceeding to enforce a lien under chapter 779 of the Wisconsin Statutes. The Declarant shall, upon the written request of an Owner or purchaser of any Lot, issue a Certificate of Status of Lien. If an attorney is retained to enforce any delinquent charges, reasonable attorney fees, title charges, court costs, and other costs incurred shall be added to and become a part of the charges. 9. Covenants Run with Land. All of the terms and conditions in this Declaration, including the benefits and burdens, shall run with the land and shall be binding upon, inure to the benefit of, and be enforceable by each owner and their respective successors and assigns as owners of the Lots. The easements granted under Section 2(a) of this Declaration are easements appurtenant to the Lots and may not be transferred separately from, or severed from, title to the Lots. Furthermore, the benefits of the easements granted under Section 2(a) may be extended to any properties other than the Lots without the consent of the owners of the fee simple interest of all of the Lots. Each Owner shall cease to have further liability under this Declaration with respect to facts or circumstances first arising after the Owner has transferred its fee simple interest in a Lot, except, however, for such obligations as accrued during the Owner's period of ownership of fee title to the Lot. 10. Non -Use. Non -use or limited use of the easement rights granted in this Declaration shall not prevent the benefiting party from later use of the easement rights to the fullest extent authorized in this Declaration. 11. Governing Law. This Declaration shall be construed and enforced in accordance with the internal laws of the State of Wisconsin. 12. Notices. All notices to any Owner under this Declaration shall be delivered in person or sent by certified mail, postage prepaid, return receipt requested, to the other party at that party's last known address. If the other party's address is not known to the party desiring to send a notice, the party sending the notice may use the address to which the other party's property tax bills are sent. Any Owner may change its address for notice by providing written notice to the Declarant. 13. Invalidity. If any term or condition of this Declaration, or the application of this Declaration to any person or circumstance, shall be deemed invalid or unenforceable, the remainder of this Declaration, or the application of the term or condition to persons or circumstances other than those to which it is held invalid or unenforceable, shall not be affected thereby, A 2431P 512 and each term and condition shall be valid and enforceable to the fullest extent permitted by law. 14. Waiver. No delay or omission by any party in exercising any right or power arising out of any default under any of the terms or conditions of this Declaration shall be construed to be a waiver of the right or power. A waiver by a party of any of the obligations of the other party shall not be construed to be a waiver of any breach of any other terms or conditions of this Declaration. 15. No Public Dedication. Nothing in this Declaration shall be deemed to be a gift or dedication of any portion of the easements granted under this Declaration to the general public or for any public purpose whatsoever (except to the extent dedication occurs as provided in Section 4(b)). The Association may take such measures as it may deem necessary to prevent the dedication to the public of the Private Road, whether by express grant, implication, or prescription, including, without limitation, the posting of "Private Road," "No Through Traffic" or "No Trespassing" signs. Such measures shall not, however, unreason- ably interfere with the easement rights granted under this Declaration. 16. Assignability of Declarant's Rights. The Declarant may, by a written, recorded assignment, transfer its rights as Declarant under this Declaration to any person, who, effective upon the recording of the assignment, shall be the Declarant for all purposes under this Declaration. 17. Nonforfeiture. Any violation of these restrictions shall not result in a forfeiture or reversion of title to any Lot. 18. Attorney Fees. If any action or suit is brought to enforce the provisions of this Declaration, the party who prevails in the action or suit shall be entitled to recover its court costs and attorney fees from the other party.
