The owner of a POWTS shall be responsible for ensuring that the operation and maintenance of the POWTS occurs in accordance with this chapter and the approved management plan under s. Comm 83.54(1). • Comm 83.52(2) A POWTS that is not maintained in accordance with the approved management plan or as required under s. Comm 83.54(4) shall be considered a human health hazard. • Comm 83.55 The owner is responsible for submitting a maintenance verification report acceptable to the county for maintenance tracking purposes. Reports shall be submitted at intervals appropriate for the component(s) utilized in the POWTS. A copy of the approved plans, specifications and this letter shall be on -site during construction and open to inspection by authorized representatives of the Department, which may include local inspectors. All permits required by the state or the local municipality shall be obtained prior to commencement of construction/installation/operation. In granting this approval the Division of Safety & Buildings reserves the right to require changes or additions should conditions arise making them necessary for code compliance. As per state stats 101.12(2), nothing in this review shall relieve the designer of the responsibility for designing a safe building, structure, or component. Creation of Easement. The Owner creates on Parcel 1 a perpetual easement and right -of -way to construct, reconstruct, maintain, operate, supplement, and remove a septic system and drainfield easement, with the right of ingress and egress for the purpose of this grant, over the Utility Easement Area. 2. Maintenance and Indemnification, Subsequent owners of Parcel 2 shall be solely responsible for all maintenance, repair and/or replacement of the system and drainfield, and shall indemnify the Owner and successor owners of Parcel l or any portion thereof from and against all loss, costs (including reasonable attorney fees), injury, death, or damage to persons or property that at any time may be suffered or sustained by any person or entity in connection with the activities conducted on the Property. 3. Consistent Uses Allowed. The Owner reserves the right to use the Utility Easement Area for purposes that will not interfere with the Parcel 2's full enjoyment of the Easement rights granted in this Declaration. 4. Covenants Run with Land. All terms and conditions in this Declaration, including the benefits and burdens, shall run with the land and shall be binding upon, inure to the benefit of, and be enforceable by the Owner and his respective successors and assigns. Successor owners of Parcel 2 shall cease to have any liability under this Declaration with respect to facts or circumstances arising after the party has transferred its fee simple interest in Parcel 2 and its interest in the Easement Utility Area. Non -use or limited use of the Easement granted in this Agreement shall not prevent Successor owners of Parcel 2 from later use of the Easement rights to the fullest extent authorized in this Declaration. 6. Governing Law. This Agreement shall be construed and enforced in accordance with the laws of the State of Wisconsin. 7. Invalidity. If any term or condition of this Declaration, or the application ofthis Declaration to any person or circumstance, shall be deemed invalid or unenforceable, the remainder of this Declaration, or the application of the term or condition to persons or circumstances other than those to which it is held invalid or unenforceable, shall not be affected thereby, and each term and condition shall be valid and enforceable to the fullest extent permitted by law. 8. Waiver. No delay or omission by any party in exercising any right or power arising out of any default under any of the terms or conditions of this Declaration shall be construed to be a waiver of the right or power. 9. Enforcement. Enforcement of this Agreement may be by proceedings at law or in equity against any person or persons violating or attempting or threatening to violate any term or condition in this Declaration, either to restrain or prevent the violation or to obtain any other relief. Tc Mrs. Helen Ross Wilson, Wisconsin 54027 �.4. • Re: Failing disposal system, abandoned Dear Mrs. Ross: Enclosed is a copy of my inspection report of July 3, 1979. As I discussed with you on that date, the septic tank which served both your residence and Marshal Schillinger's is in extremely poor condition and is apparently leaking. Evidence to support the contention that the tank leaks comes from your statements that within a matter of hours following pumping of the tank on May 20, 1979, and again on July 28, 1979, the tank was observed to be full. You stated that 6 hours after pumping of the tank on May 20, liquid was surfacing out of the tank. I might also note that the tank is metal and corroded so badly that Mr. Aaby and I easily cut the metal (inadvertently) with a shovel while inspecting its condition. This is not surprising since the tank and disposal system i were installed some 25 years previous. There can be little doubt that some of the water which leaks into your basement comes from the septic tank. I have confirmed that the water table occurs at less than 2 feet below ground surface in your yard and in { fact over most of the immediate vicinity of your home. As noted on the report, there is a rise in elevation north of the fence and store which does have sufficient soil over the high groundwater level Ot Gour insta I a tion of a mound should you wish to have one ation tests and additional borings will be required for design data before a plan can be prepared and submitted to the State Plumbing Section for approval. Due to the above stated facts of the problem you have been experiencing, in keeping with our conversation of July 3, 1979, and because the system is located on your property, I am directing that you take the following action in accordance with the provisions of the State Plumbing Code. ' 1. H 62.20(4)(a)1. Septic Tanks and Other Treatme Tanks All tanks shall be watertight and fabricated so as to consti an i ndividual structure. 8 We have already established that the septic tank is not w co 7 49 �. Administrative Code, t the tank or entire top-of the tank shall be removed and the remaining portion of the tank or excavation shall be immediately filled with suitable fill ,f material. You have abandoned the septic tank and are now diverting household waste to your new holding tank, therefore this procedure is required. 3. H 62.20(2)(e)7 There shall be a minimum of 3 feet of soil between the bottom of the soil absorption system and high groundwater or bedrock. The area which you showed me as being the location of the old soil absorption system has high groundwater at less than 3 feet below ground surface. Since you have a holding tank for your own disposal now, the system is no longer needed and must be discontinued for use. Corrections shall be completed within 30 days from the receipt of this letter or a written agreeable date satisfactory to state and county authorities. I do appreciate your concern for speedy disposition of this vexing matter and will pursue it as quickly as my authority allows. You are correct in understanding that the 30 day time limit, imposed by directive, does extend into the month of August. Should the time limit for correction be exceeded, my next step is to seek enforcement assistance in the Circuit Court of St. Croix ounty. Regrettably, this would take more time, however. I am not empowered to proceed in another way. As to the disposition of the existing failing septic tank, since it is located on your property, I found it necessary to direct its destruction to you.
