BOARD OF ADJUSTMENT MEETING AND HEARING MINUTES
February 23, 2007
The meeting was called to order by Chairperson Buck Malick at 8:34 a.m. A roll call
was made. Chairperson Buck Malick, Linda Luckey, and Jan Zoerb were present. Chuck
Struemke and Sue Nelson were absent. Staff included: Jenny Shillcox, Zoning
Specialist; David Fodroczi, Planning and Zoning Director; Kevin Grabau, Code
Administrator; and Becky Eggen, Recorder.
Staff confirmed to the Board that this was a properly advertised meeting.
The next meeting for the Board is scheduled for Friday, March 23` 2007 at 8:30 a.m. in
the County Board Room of the Government Center in Hudson.
Leal Update
Staff notified the Board that the oral arguments for the Murr case have been rescheduled
for March 26, 2007 with Judge Vlack.
Micabren Acres Special Exception
Follow up by staff was done on Michael Feist's special exception permit. Conditions #3
- #6 of the permit have not been met by the deadlines of the permit as outlined in the
letter to Mr. Feist dated February 15, 2007.
Mr. Feist showed up during the hearing and met briefly with staff, at which time he
submitted to a staff member a letter outlining his status and timeline for meeting the
conditions of the special exception permit, a personal check for the $10,000 compliance
deposit (with the stipulation that it not be cashed until the following week), and a copy of
the contract for deed transferring ownership of the horse facilities and pastures from
Riding Meadows LLC to Micabren Acres LLC to be recorded with the Register of Deeds
office no later than March 1, 2007.
. Motion by Luckey, second by Nelson to proceed with potential revocation process of
the special exception permit that was issued October 26, 2006 and schedule a public
hearing at the Board's next meeting in March.
The Board recessed for a short break at 9:50 a.m.
Struemke arrived at 10:00 a.m.
The Board reconvened at 10:07 a.m.
Minutes
Motion by Luckey, second by Zoerb to approve the January 25, 2007 minutes as
amended. Motion carried unanimously.

Revision to Board of Adiustment By -Laws
The Board concluded that Staff should combine Article VII, Section 2 — Decisions to be
Written and Section 4 — Findings. Staff will be drafting Article IV, Section 3 and 9
Notice of hearing.
The Board recessed for a short break at 11:43 a.m.
The Board reconvened at 11:46 a.m.
Motion by Zoerb, second by Struemke to adjourn the meeting at 12:05p.m.
