Tank inspections must include a visual inspection of the tank(s) to identify any missing or broken hardware, identify any cracks or leaks, measure the volume of combined sludge and scum and to check for any back up or ponding of effluent on the ground surface. The dispersal cell(s) shall be visually inspected to check the effluent levels in the observation pipes and to check for any ponding of effluent on the ground surface. The ponding of effluent on the ground surface may indicate a failing condition and requires the immediate notification of the local regulatory authority. When the combined .accumulation of sludge and scum in any tank equals one -third (Y or more of the tank volume, the entire contents of the tank shall be removed by a Septage Servicing Operator and disposed of in accordance with chapter NR 113, Wisconsin Administrative Code. All other services, including but not limited to the servicing of effluent filters, mechanical or pressurized components, pretreatment units, and any servicing at intervals of 512 months, shall be performed by a certified POWTS Maintainer. A service report shall be provided to the local regulatory authority within 10 days of completion of any service event. l START UP AND OPERATION Page of For new construction, prior to use of the POWTS check treatment tank(s) for the presence of painting products or other chemicals that may impede the treatment process and /or damage the dispersal cell(s). If high concentrations are detected have the contents of the tank(s) removed by a septage servicing operator prior to use. System start up shall not occur when soil conditions are frozen at the infiltrative surface. During power outages pump tanks may fill above normal highwater levels. When power is restored the excess wastewater will be discharged to the dispersal cell(s) in one large dose, overloading the cell(s) and may result in the backup or surface discharge of effluent. To avoid this situation have the contents of the pump tank removed by a Septage Servicing Operator prior to restoring power to the effluent pump or contact a Plumber or POWTS Maintainer to assist in manually operating the pump controls to restore normal levels within the pump tank. Do not drive or park vehicles over tanks and dispersal cells. Do not drive or park over, or otherwise disturb or compact, the area within 15 feet down slope of any mound or at -grade soil absorption area. Reduction or elimination of the following from the wastewater stream may improve the performance and prolong the life of the POWTS: antibiotics; baby wipes; cigarette butts; condoms; cotton swabs; degreasers; dental floss; diapers; disinfectants; fat; foundation drain (sump pump) water; fruit and vegetable peelings; gasoline; grease; herbicides; meat scraps; medications; oil; painting products; pesticides; sanitary napkins; tampons; and water softener brine. 4BANDONMENT When the POWTS fails and /or is permanently taken out of service the following steps shall be taken to insure that the system is properly and safely abandoned in compliance with chapter Comm 83.33, Wisconsin Administrative Code: • All piping to tanks and pits shall be disconnected and the abandoned pipe openings sealed. • The contents of all tanks and pits shall be removed and properly disposed of by a Septage Servicing Operator. • After pumping, all tanks and pits shall be excavated and removed or their covers removed and the void space filled with soil, gravel or another inert solid material. 'ONTINGENCY PLAN If the POWTS fails and cannot be repaired the following measures have been, or must be taken, to provide a code compliant replacement system: A suitable replacement area has been evaluated and may be utilized for the location of a replacement soil absorption system. The replacement area should be protected from disturbance and compaction and should not be infringed upon by required setbacks from existing and proposed structure, lot lines and wells. Failure to protect the replacement area will result in the need for a new soil and site evaluation to establish a suitable replacement area. Replacement systems must comply with the rules in effect at that time. ❑ A suitable replacement area is not available due to setback and /or soil limitations. Barring advances in POWTS technology a holding tank may be installed as a last resort to replace the failed POWTS. ❑ The site has not been evaluated to identify a suitable replacement area. Upon failure of the POWTS a soil and site evaluation must be performed to locate a suitable replacement area. If no replacement area is available a holding tank may be installed as a last resort to replace the failed POWTS. ❑ Mound and at -grade soil absorption systems may be reconstructed in place following removal of the biomat at the infiltrative surface. As you know, our county ordinances must be in compliance with state statutes, or they are invalid, so the business about distances from navigable waters is pertinent. Because of the topography of this area (floodplain in the lowlands /wetlands), the actual shoreland distance from the navigable waterways is unspecified, in terms of actual measurement in either the 300' or 1000' distances specified for lakes, ponds, flowages, rivers, or streams. The operant phrase is "...to the landward side of the floodplain... ", if this distance is greater than the 300' distance from a river or stream. For the 1000' distance of "...lake, pond, or flowage... ", there is no floodplain reference in the statute. The lowland you referred to this morning is listed on the official s. 23.32 wetlands maps, which are available on the DNR's web site. Ya gotta poke around to figure out how to find them, but they're there, along with extensive capabilities for measuring distances, and calculating areas. This lowland/wetland is floodplain for the Apple River, so in those terms the shoreland zoning applies to the lowland area only - - -not the highground within any certain distance (either 300' or 1000') from the wetlands /floodplains themselves. As far as designating the wetlands /floodplain to be navigable waters themselves, this would be possible, but it has not yet occurred. No one has accepted my sworn testimony about my occassional and historic use of some specific areas of the designated s. 23.32 wetlands as navigable waterways, other than within the Apple River channel itself, so any such statements from your zoning department would be brand new, at this point. If you're willing to state a firm belief that the wetlands in question is in fact a navigable waterway, I'd very much like your sworn affidavit on this issue. This would clairify some issues with property tax assessment, for example, since some of these same state statutes apply for the newly created, five- year -old Undeveloped classification of property that halves the market value of shoreland/wetland, for assessment purposes on qualifying acreages. You would have to decide what to call the wetlands- cum - navigable waters, to determine any applicable distances from them (300' or 1000% and this would involve classifying the area as river, stream, lake, pond, or flowage. This classification has not been done officially, but the area is already a designated wetlands, under s. 23.32. "Flowage" would be one label to apply, since there are already some earthen containment dams on neighboring properties that manage the water in that area. There are also some springfed "stream" qualifications in the area, and these carry with them the unspecified distances involving floodplain-- - outside of the 300' or 1000' distances specified. There are some "pond "(s) in the area as well, and the presence /existence of these has been officially ignored as well. I'd appreciate your help in making determinations on these issues. Some s. 23.32 designated wetlands are in fact navigable waterways, such as our local Oakridge Lake, which was recently sold by St. Croix County to the U.S.Fish and Wildlife Service. The depth of the water has some bearing on making these determinations, and six feet is one criteria for some kinds of classification -- -lake (other than in name only) vs. wetlands. Another important fact is that the official FEMA maps are not statutory reference determinants for defining floodplain. These FEMA documents are often assumed to be, and treated as though they comprise the official definition of floodplain, for many purposes, but the Wisconsin DNR (which 6/9/2009 Page 2 -of 2; . - supplies hydrology information for even the federal agencies, such as FEMA and the USGS) has issued qualifications to this, pointing out within it's various official floodplain publications (including some available from your office, such as the one entitled "Living in a Floodplain"), that additional areas adjacent to waterways and /or wetlands may not appear on official floodplain maps, but they still qualify as floodplains, by other criteria not always used in delineating the FEMA floodplain boundaries. I'm hoping you can expedite the permit process for my neighbor, in any ways possible. Sounds like there are several ways for you to do this, so please explore these fully. Since you didn't personally see the area in question before the removal of some trees at the proposed building site, it's understandably difficult for you to imagine precisely how much excavation has actually occurred. Since I've lived here for 4 decades, I have an intimate familiarity with the topography, and I can tell you that the amount of square footage of excavation has been vastly overestimated, so far. Please see how you can more accurately measure these square footages, since they're well within the 10,000 square feet quantity that serves as the threshold for other considerations. If you'd like a notarized affidavit or deposition from me about these details of the property I formerly owned, and have made extensive use of, in many ways, including driveways, ski trails, buidling materials, firewood, etc., please let me know if this would make your jobs easier. Raking surface materials from the forest floor, or removing trees for future lawn areas does not count as excavation, for example, so let's leave these areas out of the mix, for purposes of accuracy.
