ST. CROIX COUNTY BOARD OF SUPERVISORS
Regular Meeting May 22, 2001
Meeting called to order by Chair Dorsey at 7:00 p.m. Invocation
given by Chaplain Tim Sackett, Transport for Christ, Hudson. As
Chaplain, Tim provides counseling and encouragement to truck drivers,
worship services on Sundays and Bible studies during the week at the
TA truck stop near Hudson. Pledge of Allegiance was recited. Chair
welcomed guests and the press.
Roll call: 29 present, 2 absent and excused - Supr. Mehls and Supr.
Irwin.
Motion to approve the April minutes by Supr. Mortensen, 2nd by Supr.
Berenschot. Clerk Nelson noted the correct total was $11,345.93 for
mileage and per diem account. Carried.
Motion by Supr. Wolske, 2 by Supr. Bethke to adopt the agenda.
Carried. Next meeting is June 19 at 7:00 p.m. and will be casual
night.
Appointments: Chair noted Supervisors Leon Berenschot, Nancy
Bieraugel, Jack Dowd, Art Jensen and Tom Rose had been appointed to
the 2001 Redistricting Committee. He thanked the committee for their
good preliminary work on redistricting.
Department Reports: Bob Heise from the Land and Water Conservation
Office focused his report on information and educational programs.
He highlighted the school programs that feature stream clean -up and
ecology, enviro -scape watershed model, ground water model, poster and
speaking contests.
Katie LaCapitaine from River Falls Elementary gave her winning speech
on "Horrible Hidden Toxin" telling the hazardous effects of toxins in
our environment. Anna Buechter from Baldwin - Woodville High School
presented "What - A Farm - No Cows" which told about tree farms and
their benefits. Applause from the Board and a thank you from the
Chair.
Redistricting Public Hearing: Motion by Supr. O'Connell, 2 by Supr.
Mortensen to go into the public hearing at 7:20 p.m. Carried.
Wallace Habhegger, City of New Richmond Assessor, had one concern
with the eastern side of the County being under represented and the
western side over represented. No others were present to speak.
Motion by Supr. Malick, 2 by Supr. Raymond to close the public
hearing at 7:28 p.m. Carried.
County Planner Ellen Denzer highlighted the dates of the
redistricting process. Following adoption of the preliminary plan,
it will be sent to municipalities for their review. Denzer will meet

with them to complete the City and Village ward plans by the deadline
of August 2nd
The goal of no more than 1% to 3% variation in representation was met
in all but one area. Some of the guidelines used were compact and
contiguous districts, using easy landmarks and keeping districts
simple in shape.
Redistricting Chair Bieraugel thanked the Redistricting Committee and
Ellen Denzer for their work on this process.
Resolution No. 15 (2001): Approving Tentative Redistricting Plan.
Motion to adopt by Supr. O'Connell, 2 nd by Supr. Bieraugel. Carried.
Supr. Bieraugel was excused at 8:00 p.m.
Resolution No. 16 (2001): Approving Court Commissioner's Secretary
Position. Motion to adopt by Supr. Peterson, 2 nd by Vice Chair
Jacobson. Administrative Coordinator Whiting explained the current
Family Court Commissioner's secretary is retiring and her services
were provided on a contractual basis from Ed Vlack's law office. Mr.
Vlack will vacate the Family Court Commissioner position when he
becomes a Circuit Court Judge on August 1 There most likely will
not be a similar arrangement with the new Family Court Commissioner.
The Judges have requested a new full time position with a start date
of July 2, 2001. Carried.
Resolution No. 17 (2001): Designating June 2001 as Dairy Month.
Motion to adopt by Supr. Wolske, 2 nd by Supr. Wentz. Carried.
Resolution No. 18 (2001): Regarding Purchase Agreement on Property
Below Glen Hills #2 Dam. Motion to adopt by Supr. O'Connell, 2 nd by
Supr. Jensen. Whiting said an agreement has been reached with the
homeowner located in the flood plain. The Natural Resources
Conservation Service will pay 65% of the relocation costs leaving the
County to pay $45,937.50 which is less than originally budgeted.
Motion by Vice Chair Jacobson, 2 nd by Supr. O'Connell to amend the
resolution by adding to the last paragraph, "upon review of property
for good and marketable title ". Amendment carried. Resolution as
amended carried.
Resolution: Authorizing St. Croix County Dept. of Health and Human
Services /Public Health Agent Status. Motion to adopt by Supr.
Berenschot, 2 nd by Supr. Olson. Health and Human Services Director
John Borup introduced Public Health Supervisor Barbara Nelson. Borup
stated the State will not commit more resources to health
inspections. The authority can be designated to a local health
department to inspect restaurants, temporary restaurants, hotels, bed
and breakfasts, campgrounds, swimming pools, etc.

If approved, H &HS would recruit a Registered Sanitarian (non -union
pay grade 7, $38.105 to $50,960 /year) with fees assessed used to
support the costs of the program.
Supr. Swenson expressed concern that approval of the "function" at
this meeting would ethically obligate him to approve the new position
request at later budget meetings. He believes approval of the
function, staffing and funding are not separable issues. He would
prefer to use the budget process for the new position. Borup said
if the resolution is approved, the position will go through the
budget process.
Supr. Horne said we are voting for the concept of H &HS taking over
inspections. Ms. Nelson said the position can be justified because of
the safety provided to County consumers. Supr. Swenson said approval
of this H &HS "function" may lead other departments or parent
committees to request new positions or functions outside of the
agreed upon process for approval of new positions.
Motion by Supr. Malick, 2nd by Supr. Horne to amend the resolution by
adding "but employing staff at this time is not authorized." Motion
by Supr. Malick, 2 by Supr. Krueger to table this resolution. Roll
call: 15 yes, 13 no. Motion to table carried.
Ordinance No. (2001): Rezoning from Ag. to Ag /Res for Kenneth Graf,
Town of Baldwin. Motion to enact by Supr. Raymond, 2 by Supr.
O'Connell. Carried.
Ordinance No. (2001): Rezoning from Ag. to Ag. II, James and Mary
Sander, Town of Rush River. Motion to enact by Supr. Raymond 2 by
Supr. O'Connell. Carried.
Administrative Coordinator: Chuck Whiting distributed a letter
inviting all Committee Chairs to the Finance Committee meeting on
June 7 Springsted staff will give the capital outlay presentation
and budget goals will be discussed.
Whiting and Finance Director Rich Loney attended a GASBY 34 seminar
in Wausau. A new ruling affects government accounting in every state
and county in the U.S. and involves depreciating assets such as
highways and buildings. Whiting noted Governor McCallum issued a
statement opposing the casino and a statement in favor of a new
Stillwater bridge.
The new boat operated by the Sheriff's Dept. on the St. Croix River
is on display in the parking lot. Whiting also reported a Notice of
Circumstances of Claim has been filed by the Tribes vs St. Croix
County regarding the casino issue.

Corporation Counsel Timmerman said the claim is a formality before an
actual suit is filed. He believes the claim is not valid or timely
because the contract for services was voided several months earlier.
Committee and Board Reports: Land and Water Conservation Chair
Jensen reported they are working from the new plan. Watersheds will
be phased out. The staff and an advisory committee is working on a
Large Dairy Manure Ordinance. The Land and Water department is the
first stop for developers of sub divisions to meet certain criteria.
Information Services - no report.
Planning, Zoning and Parks Chair Raymond reported Planning Director
Dave Fodroczi recently had surgery to remove a tumor and was doing
well until he was again hospitalized with a low grade infection.
Supr. Bjerstedt reported on the Economic Development Corporation's
annual meeting at which the following were elected: Jerry Brandt,
President; Tim Schreiner, 1st Vice President; Pam Donohoe, 2 nd Vice
President and Brian Wert, Secretary /Treasurer.
Applications Filed for Zoning Ordinance Amendments: Gloria Basil,
Town of St. Joseph, Ag. to Ag /Res.
Mileage and Per Diem Report: Motion by Supr. O'Connell, 2 nd by Supr.
Wolske to approve total of $8,716.41. Carried.
Correspondence: None
Announcements: Supr. Grant announced the Annual Legion Golf
Tournament on June 20 at the Hammond golf course. Money derived
from this event is used to fund youth programs.
Supr. Raymond noted Roberts Good Neighbor Days, June 1, 2 and 3, is
sponsored by the Lions Club who support community projects.
Comments: Supr. Standafer advised Reps. Pettis and Rhoades and
Senator Harsdorf have made public statements supporting the
Stillwater Bridge. He asked if the Board would make a public
statement on the Resolution of support done some time ago. Supr.
O'Connell suggested Chair Dorsey send a letter to Governor McCallum
and the Minnesota Dept. of Transportation reaffirming our support.
Chair Dorsey agreed and will do so.
Chair thanked everyone for cooperation during the meeting.
