The submittal described above has been reviewed for equivalency to applicable Wisconsin Administrative Codes and
compliance with Wisconsin Statutes. The submittal has been CONDITIONALLY APPROVED. The owner, as
defined in section 101.01(10), Wisconsin Statutes, is responsible for compliance with all conditions of this petition
approval and other applicable code requirements. Plan submittal and approval to the department or its agent may be
necessary prior to construction undertaken per this petition.
The code section petitioned requires POWTS treatment, holding and dispersal components shall be located so as
to provide the minimum horizontal setback distances as outlined in Table 83.43 -1.
The variance requested is to allow the continued use of a new (three year old) septic tank that has been installed as
close as 0.66 feet from the property line.
The intent of the code section petitioned is to provide the minimum horizontal setback distances as outlined in
table 83.43 -I as extra safety factors for public health, waters of the state and structures during construction and in the
event of component failure.
The petitioner submitted the SB -9890 application form including 10 additional pages of supporting documents
and/or plans.
Reviewer's Comments:
1. The St. Croix County Planning and Zoning Department approval based on the inspection of the site.
2. The owner indicates that the tank is structurally sound with no sign of leakage or cracks.

Reviewer's Conditions of Approval:
All of the petitioner's statements of fact or intent included on the variance application form, any other documents
submitted to the Department, as well as any other conditions of approval listed below, shall be carried out. This
variance is specific to the subject petition and cannot be used for any additional modifications.
• The tank is to be inspected on a three year cycle to determine the structural soundness. The report of the
inspection is to be submitted to the county.
• If at any time the tank is found not be structurally sound the tank is to be replaced and located such that it is
in compliance with the code at that time.
This decision will become final unless the department within 30 days from the date of this letter receives a written
request for a hearing. A request for hearing should be sent to the address shown on this letterhead. A copy of this
letter must be included with the request for a hearing. The request for hearing should state the reasons for objecting
to the department's decision, because a request for hearing may be denied if it does not present a significant question
in fact, law or policy.

MAINTENANCE INSTRUCTIONS
Inspections of tanks and dispersal cells shall be made by an individual carrying one of the following licenses or certificatio.
Master Plumber; Master Plumber Restricted Sewer: POWTS Inspector; POWTS Maintainer; Septage Servicing Operator.
Tank inspections must include a visual inspection ul the tank(s) to identify any missing or broken hardware, identify ar,y
cracks or leaks, measure the volume of combined sludge and scum and to check for any back up or ponding of effluent on t
ground surface. The dispersal cell(s) shall be visually inspected to check the effluent levels in the observation pipes and tc
check for any ponding of effluent on the ground surface. The ponding of effluent on the ground surface may indicate a
failing and requires the immediate notification of the local regulatory authority.
When the combined accumulation of sludge anti scum in any tank equals one -third ('h) or more of the tank volume, the eat,
contents of the tank shall be removed oy ,t 5rl)t tic �crvlcing Operator and disposed of in accordance with Ch. NR 113,
Wisconsin Administrative Code.
The servicing of effluent filters, mechanical or pressurized POWTS components, pretreatment componenu, and any other
maintenance or monitoring at intervals of 12 months or less shall be performed by a certified POWTS Maintainer.
A service report shall be provided to the local rvgtjkitury authority within 10 days of completion of any service event.
START UP AND OPERATION
For new construction, prior to use of the POWTS check trT'atment tunk(s) for the presence of painting products or other
chemicals that my impede the treatment process and/or damage the dispersal cell(s). If high eonaontrutions ara doleeted ha,
the contents of the tanks(s) removed by a septage servicing operator prior to use.

System start up shall not occur when soil conditions are frozen at the infiltrative surface.
During power outages pump tanks may fill above normal high water levels. When power is restored the excess wastewater
will be discharged to the dispersal cell(s) and may result in the backup or surface discharge of effluent. To avoid this
situation have the contents of the pump tank removed by a Septage Servicing Operator prior to restoring power to the effluent
pump or contact a Plumber or POWTS Maintainer to assist in manually operating the pump controls to restore normal levels
within the pump tank.
Do not drive or park vehicles over tanks and dispersal cells. Do not drive or park over, or otherwise disturb or compact. The
area within 15 feet down slope of any mound or at -grade soft absorption are.
Reduction or elimination of the following from the wastewater stream may improve the performance and prolong the life of
the POWTS: antibiotics; baby wipes; cigarette butts; condoms; cotton swabs; degreasers; dental floss; diapers; disinfectants;
fat; foundation drain (sump pump) water; fruit and vegetable peelings; gasoline; grease; herbicides; meat scraps; medications;
oil; painting products; pesticides; sanitary napkins; tampons; and water softener brine.
ABANDONEMENT
When the POWTS fails and/or is permanently taken out of service the following steps shall be taken to insure that the system
is properly and safely abandoned in compliance with ch. Comm 83.33, Wisconsin Administrative Code:
• All piping to tanks and pits shall be disconnected and the abandoned pipe openings sealed.
• The contents of all tanks and pits shall be removed and properly disposed of by a Septage servicing Operator.
• After pumping, all tanks and pits shall be excavated and removed or their covers removed and the void space
filled with soil, gravel or another inert solid material.
CONTINGENCY PLAN
If the POWTS fails and cannot be repaired the following measures have been, or must be taken, to provide a code compliant
replacement system:
A suitable replacement area has been evaluated and may be utilized for the location of a replacement soil absorption
system. The replacement area should be protected from disturbance and compaction and should not be infringed
upon by required setbacks from existing and proposed structure, lot lines and wells. Failure to protect the
replacement area will result in the need for a new soil and site evaluation to establish a suitable replacement area.
Replacement systems must comply with the rules in effect at that time.

Under St. Croix County Zoning Code 17.70(3)(b)5: "The (Zoning) Administrator may attach reasonable erosion
prevention conditions to a permit approved for issuance." Comm. 21.125 also requires the building permit applicant
and/or landowner to follow erosion control procedures and maintain them until the site has been stabilized.
The owner is responsible for notifying all contractors performing construction on this site that an
Erosion Control Plan is in effect and the following activities will be required in order to maintain
compliance with the plan:
1. The main source for construction site runoff will be the house foundation excavation, driveway, and any soil
stockpiled until final grading and stabilization is complete. Septic system excavation /installation adds to
temporary disturbance, but establishing cover on exposed soils will prevent erosion. Plan to apply seed and
mulch as recommended in #5. Maintain existing vegetation wherever possible to minimize sediment
movement.
2. Route contaminated runoff into vegetated buffer areas by creating temporary diversions graded ALONG
CONTOUR between excavation areas and any steep slopes, drainage ditches, or concentrated waterways.
Use a diversion along the top of the slope, behind the house construction area, to contain runoff on owner's
property and away from the step slope along the river.
3. If builder /excavator grades the site properly to create temporary diversions (see #2) for sediment
containment and leaves adequate vegetative cover to protect areas of concern, installation of silt fence
MAY not be necessary. Silt fence or other approved sediment control products will be required if sediment
cannot be contained on owner's property with the diversions and vegetative buffers. The POWTS inspector
will evaluate ESC plan effectiveness and make recommendations to owner and building inspector for any
action required to comply with applicable regulations.
4. Construction equipment and vehicles must limit access to a driveway properly stabilized for heavy
equipment at the entrance; this helps avoid muddy, rutted conditions that may allow contaminated runoff to
reach waterways and/or drainage ditches. This includes cement trucks, well drillers, and other contractor's
vehicles that access the property during construction. Property owner is responsible for repairing damage
and cleaning public roadways if vehicles track sediment off the construction site (per Comm 21.125).
5. Stabilize new topsoil cover over septic system with seed and mulch immediately after installation — do not
wait for final stabilization and/or landscaping of entire site to cover exposed soils on the system. If weather
will not permit seed germination, a heavy straw mulch cover will prevent erosion until grass /vegetation can
get established. Erosion control matting can be applied any time of year and if installed properly, will
provide protection even if seed germination is delayed.

Under St. Croix County Zoning Code 17.70(3)(b)5: "The (Zoning) Administrator may attach reasonable erosion
prevention conditions to a permit approved for issuance." Comm. 21.125 also requires the building permit applicant
and/or landowner to follow erosion control procedures and maintain them until the site has been stabilized.
The owner is responsible for notifying all contractors performing construction on this site that an
Erosion Control Plan is in effect and the following activities will be required in order to maintain
compliance with the plan:
1. The main source for construction site runoff will be the house foundation excavation, driveway, and any soil
stockpiled until final grading and stabilization is complete. Septic system excavation/installation adds to
temporary disturbance, but establishing cover on exposed soils will prevent erosion. Plan to apply seed and
mulch as recommended in #5. Maintain existing vegetation wherever possible to minimize sediment
movement.
2. Route contaminated runoff into vegetated buffer areas by creating temporary diversions graded ALONG
CONTOUR between excavation areas and any steep slopes, drainage ditches, or concentrated waterways.
Use a diversion along the top of the slope, behind the house construction area, to contain runoff on owner's
property and away from the step slope along the river.
3. If builder /excavator grades the site properly to create temporary diversions (see #2) for sediment
containment and leaves adequate vegetative cover to protect areas of concern, installation of silt fence
MAY not be necessary. Silt fence or other approved sediment control products will be required if sediment
cannot be contained on owner's property with the diversions and vegetative buffers. The POWTS inspector
will evaluate ESC plan effectiveness and make recommendations to owner and building inspector for any
action required to comply with applicable regulations.
4. Construction equipment and vehicles must limit access to a driveway properly stabilized for heavy
equipment at the entrance; this helps avoid muddy, rutted conditions that may allow contaminated runoff to
reach waterways and/or drainage ditches. This includes cement trucks, well drillers, and other contractor's
vehicles that access the property during construction. Property owner is responsible for repairing damage
and cleaning public roadways if vehicles track sediment off the construction site (per Comm 21.125).
5. Stabilize new topsoil cover over septic system with seed and mulch immediately after installation – do not
wait for final stabilization and/or landscaping of entire site to cover exposed soils on the system. If weather
will not permit seed germination, a heavy straw mulch cover will prevent erosion until grass /vegetation can
get established. Erosion control matting can be applied any time of year and if installed properly, will
provide protection even if seed germination is delayed.
The owner of record during site construction will be responsible for compliance with the ESC Plan. A
detail for temporary diversions is attached. Please feel free to contact me wit estions or ask for
