The request has been conditionally approved based on the application submission and the following findings: 1. The conditionally approved structures are located in the Town of Cady within the Residential-1 zoning district 2. Grading and topsoil removal on this site have already begun, with grading activities disturbing slopes in the 20-24.9% grade. 3. The proposed structure locations are outside of slopes greater than 25% measured over 50ft horizontally. 4. A stormwater management plan has been submitted and meets the performance standards described in Wisconsin Administrative Code NR 151 Subchapter III, Non-Ag Performance Standards 5. The proposed structures meet the setbacks to the property lines and the 35ft maximum structure height pursuant to Ch.15.231.2. 6. Erosion and sediment control plans have been submitted. 7. A sanitary permit was issued on 3/23/2022. Based on these findings, approval of the Land Use Permit is subject to the following conditions: 1. This site has disturbed over 1-acre of land and will require a WisDNR 216 permit. A copy of this permit will need to be on file with this department before resuming construction. 2. A pre -construction inspection is required before any activity resumes onsite to validate setbacks and verify the installation of erosion control. Before any further construction or grading work, silt fence will need to be installed and extended upslope to ensure all sediment is captured. 5. Due to the extensive grading, stabilization of this site will need to occur in phases. The concentrated channels, toe of the slopes and ponding areas, should be stabilized first. These areas can be protected with additional silt fence, sediment logs, and/or "berms" to help direct runoff. Temporary sediment traps shall be installed upslope to help slow down runoff. 6. Construction of a terrace or "bench" on the south side of the driveway approximately halfway down the slope is recommended to break up the slope and minimize erosion. 7. A minimum of 4 inches of soil material or topsoil shall be added. All eroded areas and deep rills will need to be filled and leveled. 8. Due to steep slopes, erosion mat will need to be installed on all slopes to help anchor the soil and protect the newly seeded areas. 9. If the intent is to capture runoff north of the driveway and convey it south, the driveway culvert will need to have some slope to ensure runoff water has a positive flow to the south. 10. Construct a swale connecting the road ditch to the stormwater basin. 11. Slopes greater than 25% measured over a 50ft horizontal distance must not be disturbed; the topsoil removal which has occurred on these slopes must be restored and revegetated as soon as possible. 12. If the desire is to utilize "turf type" seeding, the mix included in the plan is more fit for an urban lawn and not suitable for a site with high erosion potential. WisDOT seed mix no. 20, with 6% Kentucky blue grass, 15% red fescue, 24% hard fescue, 40% tall fescue and 15% perennial ryegrass shall be used. 13. The property owner is required to file a stormwater maintenance affidavit with the St. Croix County Register of Deeds within 30 days of project completion. 14. St. Croix County reserves the right to require additional sediment and erosion control measures to be installed if found necessary due to site -specific concerns and will be documented in an as -built site plan. 15. All temporary erosion control measures shall be left in place and maintained until the site has reached a point of at least 70% permanent vegetation. Permanent vegetation shall be established once final grade is reached or as soon as applicable per plan. 16. A post -construction inspection is required prior to removing the temporary sediment and erosion control measures to verify proper vegetation cover has been established. It is the applicant's responsibility to secure any other required local, state or federal permit(s) and approval(s) prior to land disturbance activity. 18. Failure to comply with the terms or conditions above may result in the revocation of this permit by the Zoning Administrator pursuant to Chapter 15.555 and Chapter 16.570.1 This approval is subject to the conditions listed above; it does not allow for any additional construction, structures, or buildings beyond the limits of this request. Your information will remain on file at the St. Croix County Community Development Department suite. It is your responsibility to ensure compliance with any other local, state, or federal permitting or regulations, including contacting the Town of Cady and the Department of Natural Resources to inquire if additional permissions are required. This permit is valid for one year, with the possibility of up to two (2) six- month extensions if the applicant submits the appropriate permit extension fee and documentation to the Zoning Administrator. A copy of the Land Use Permit placard should be submitted to the Kelly Becker Kelly.becker@sccwi.gov (715) 386-4676 town's local Building Inspector upon applying for town building permit(s). The orange placard must be posted on the job -site and visible from public view.
