Cc: County Board Office, News Media/Notice Board, County Clerk, Committee Members Rod Eslinger From: Rod Eslinger Sent: Wednesday, June 18, 2003 3:50 PM To: Eric Lundell Subject: Wigwam Shores Plat Honorable Judge Lundell, Thank you for taking the time to meet with me on June 3rd to discuss the Wigwam Shores Plat agreement from 1978. 1 would like to summarize what we had discussed on the 3rd regarding the County's agreement with the owners of Wigwam Shores Plat. am going to restate the agreement points and then state my understanding of the points. a) The Wigwam Shores Addition plat is valid. From our conversation, I understood this to mean that the plat is legal and it was recorded prior to the date of the 1967 ordinance. This point does not exempt the Plat from the shoreland standards. b) The setback provisions of the St. Croix County ordinance do not apply to the roads within Wigwam Shores Addition plat as long as the roads remain private roads. Owners verify that they do not intend to make such private roads public. This agreement point says that the County road setbacks do not apply on the Brave and Shore Drives. However, the shoreline setback of 75 feet is in full force and effect. c) With reference to shoreline setback and width, and lot width at building site, the St. Croix County ordinance applies: however, owners may apply for special exceptions for those lots which do not conform and reasonable consideration will be given to such applications. From our discussion I understood that this point allowed the owner the right to seek relief from the shoreland provisions via variance or special exception. In the current situation that I'm dealing with, in order for a property owner to sell or use substandard lot which is under common ownership of adjoining lands, that owner would need to apply and successfully receive a variance from the St. Croix County Board of Adjustment. If I have misrepresented any of the agreement points please correct me were necessary. Thank you for your time. As I understand it, we are in agreement that: (a) The Wigwam Shores Addition plat is valid. (District Attorney's letter 10/6/77.) The outlet filter shall be installed per product approval stipulations. • Maintain well and waterline set backs per COMM 83.43(8)(i). • Maintain lot line set back per COMM 83.43(8)(1). A copy of the approved plans, specifications and this letter shall be on -site during construction and open to inspection by authorized representatives of the Department, which may include local inspectors. All permits required by the state or the local municipality shall be obtained prior to commencement of construction /installation/operation. Stats. • Inspection of the private sewage system installation is required. Stats. • The maintenance plan for this system must be given to the owner of the POWTS. Site Specific Conditions: • The orientation of the mound system must be such that the longest dimension is oriented along the surface contour per COMM 83.44(6)(a)2. • Limit activities in the area 15' beyond the down slope edge of the mound per Mound Component Manual. • Surface water drainage shall be diverted away from the system area. Maintenance information must be given to the owner of the tank explaining that periodic cleaning of the septic tank outlet filter will be required. The outlet filter shall be installed per product approval stipulations. • Maintain well and waterline set backs per COMM 83.43(8)(1). • Maintain lot line set back per COMM 83.43(8)(i). A copy of the approved plans, specifications and this letter shall be on -site during construction and open to inspection by authorized representatives of the Department, which may include local inspectors. All permits required by the state or the local municipality shall be obtained prior to commencement of construction /instal lation/operation. In granting this approval the Division of Safety & Buildings reserves the right to require changes or additions should conditions arise making them necessary for code compliance.
