CROIX COUNTY GOVERNMENT CENTER, HUDSON, WI November 28, 2007 Supervisors: Lois Burri, Stan Krueger, Gene Ruetz, Wally Habhegger Absent: Ron Troyer Staff. Kevin Grabau Guests: Benny Stenner, Roland Jahnke, Roger Osegard, Harvey Halverson, Lynda Pulford, Gary Pulford Chair Habhegger called the meeting to order at 7:01 p.m. The next committee meeting will be December 11, 2007 at 8:30 a.m. in Hudson. Action on previous minutes: none The public hearing notice was acknowledged for the record. REZONING APPLICANT: Ruby Schiefelbein AGENT: Gary Baillargeon LOCATION: NEIA ofNEI /4 & SEIA ofNEI /4, Section 9, T31N, R19W, Town of Somerset ADDRESS: 50th Street / Rice Lake Road REQUEST: To rezone approximately 54 +/- acres from Agricultural to Agricultural- Residential pursuant to Section 17.72 of the St. Croix County Zoning Ordinance Grabau noted that neither property owner nor agent were present. No one spoke in support or opposition of this request. Grabau reviewed the staff report. Staff recommends that the Committee approve the rezoning amendment for this parcel. Motion by Ruetz, 2nd by Krueger to approve the rezoning based on staff recommendations and findings and that the request is in compliance with WSS 91.77. Motion carried unanimously. APPLICANT: Lowell & Virginia Rivard Family Trust AGENT: Bennie Stenner, The Kraemer Company 1 LOCATION: SW1/4 of SWI /4, Section 7, T30N, R19W, Town of Somerset ADDRESS: 302 Old Scout Camp Rd., Houlton REQUEST: To rezone approximately 6.60+/- acres from Agricultural to Agricultural- Residential pursuant to Section 17.72 of the St. Croix County Zoning Ordinance Grabau reviewed the staff report. Staff recommends that the Committee approve the rezoning amendment for this parcel. Mr. Stenner, agent, stated that the Kraemer Company set up the scale operation after their first special exception permit was approved in 2002. At the special exception permit renewal time in 2007, Jennifer Shillcox, St. Croix County Zoning Specialist, found that the scale house and other related structures were located on a parcel that was zoned Agricultural. All operations of a nonmetallic mine must be located on Agricultural- Residential parcels. This rezoning is just to fix what they didn't realize earlier. No one spoke in opposition of this request. Motion by Krueger, 2nd by Ruetz to approve the rezoning from Agricultural to Agricultural- Residential based on staff recommendations and findings and that the Town of Somerset recommends approval, and that the request is consistent with WSS 91.77. Motion carried unanimously. APPLICANT: L CANT: Wisconsin Department of Natural Resources / G &Linda Pulford P �' LOCATION: NWI /4 ofNE1 /4, Section 28, T3 IN R19W, Town of Somerset ADDRESS: 1998 County Road 1, Somerset REQUEST: To rezone approximately .48 +/- acres from Conservancy to Agricultural- Residential pursuant to Section 17.72 of the St. Croix County Zoning Ordinance Grabau reviewed the staff report. Staff recommends that the Committee approve the rezoning amendment for this parcel. Harvey Halverson, WDNR, stated that this rezoning is to bring the Pulford property into compliance. Generally the DNR would not advocate for sale of highly valuable land, but it wants to clear up property borders. Mr. Polford stated that the DNR has been very amicable. The Pulfords just want to clean up their own mistake and would advocate for surveys prior to any property sales. Motion by Ruetz, 2nd by Krueger to approve the rezoning from Conservancy to Agricultural- Residential per staff recommendation and in compliance with WSS 91.77 with findings.
