CROIX COUNTY GOVERNMENT CENTER, HUDSON WI May 22, 2007 Present: Committee: Supervisors Lois Burri, Wally Habhegger, Gene Ruetz, Stan Krueger, Ron Troyer Staff: Dave Fodroczi, Alex Blackburn, Kevin Grabau, Ellen Denzer, Judy Olson Guests: Roger Humphrey, Robert Nagel, Marty Ryan, one representative of Dayspring Development Call to Order: Chair Habhegger called the meeting to order at 8:32 a.m. Adoption of Agenda: Motion by Ruetz, 2nd by Troyer to adopt the agenda. Motion carried. Approval of Previous Minutes: none Date of Next Meeting: A public hearing for two rezonings will be held on Wednesday, May 23 at 7:00 p.m. in Baldwin. A public hearing on proposed new Sign Regulations and Nonmetallic Mining Ordinance revisions is scheduled for Thursday, May 24 at 7:00 p.m. in Hudson. Old and New Business: Final Plat(s) and Town - Blackburn stated that there are only a few remaining plats from 2005 submitted under the old ordinance. Dayspring Reserve, Section 6, Somerset — Owner(s) Irene Hildebrandt Agent(s) Surveyor Roger Humphrey Location Section 6, Town of Somerset Number of lots 17 lots totaling 55.6 acres Original parcel 55.6 acres Zoning district Ag. Residential Soil test Complete soil tests have been submitted for all of the lots. Waiver request for road Has been submitted and approved. construction. Bids and financial guarantees Will be required for road construction and erosion control. Township action The town has approved the map. County Surveyor's Dept action The County Surveyors office has approved the plat. 20 percent slope disturbance NA Staff recommendation This final plat was conditionally approved on April 25, 2006. On February 27, 2007 the applicants were given a deadline of Mayl, 2007 for conditions to be met. The condition listed below is still not met. The Committee has indicated that they want these applications from 2005 completed or have them brought forward for denial. Therefore, staff recommends denial. Any new application in the future would be under the current ordinance and would start out at concept with a re- submittal of all applicable fees. Conditions: 1. Submit bids and financial guarantees for road construction and erosion control. Blackburn reviewed the staff report. The representative stated that completing the conditions would not be financially feasible at this time and hoped to get an extension of the deadline. It is difficult to go from the old to new ordinance. There are several flag lots which are more difficult to have under the new ordinance. He would like to extend the conditions if possible. Motion by Burri to deny approval of this plat. Motion 2 nd by Troyer and carried. Dayspring Vistas, Section 5, Somerset — Owner(s) Robert Nagel Agent(s) Surveyor Roger Humphrey Location Section 5 Town of Somerset Number of lots 11 lots totaling 38.85 acres Original parcel 38.85 acres Zoning district Ag. Residential Soil test Complete soil tests have been submitted. Lot 2 will need some further analysis to determine whether or not a sanitary system can be engineered using the present soil location. A new soil test may also solve the problem. Highway Department action The Highway Department has approved the road plans County Surveyor's Dept action Needed 20 percent slope disturbance The PZC stated no objections to the September 27, 2005 - 20 percent slope disturbance request. A special exception to disturb 20 percent slopes in order to construct a joint driveway to serve lots 3 and 4 was conditionally approved by the Board of Adjustment on February 23' 2006. Staff recommendation This final plat was conditionally approved on March 28, 2006. On February 27, 2007 the applicants were given a deadline of Mayl, 2007 for conditions to be met. Blackburn reviewed the staff report noting that staff recommends denial. The owner needs to be able to disperse of some of the property. He would like to see what part of the plat would apply to the new ordinance. He asked for a better definition of a flag lot and if it would be denied under the new ordinance. Because of the lay of the land, he felt a flag lot does have merit. Blackburn responded that flag lots can exist, but very limited on how they are designed. Roger Humphrey stated that the owner wishes to keep the integrity of the engineering that has been done. If this plat is denied, they would like to do a CSM to split off lot 7. Motion by Ruetz, 2 " by Troyer to deny approval of the plat. Motion carried. Northeast Angle, Section 2, Somerset — Owner(s) P.C. Collova Agent(s) Surveyor Roger Humphrey Location Section 2, Town of Somerset. Number of lots 20 lots totaling 64.94 acres Original parcel 154 acres Zoning district Ag. Residential Soil test Soil test for lots 1, and 9 are in a drainage easement. Soil test for lot 8 is in the driveway. Waiver request for road A waiver to start road construction has been submitted and construction. conditionally approved. Bids and financial guarantees Bids have been submitted and approved. Financial guarantees have not been submitted. Township action The town has approved the map. Extraterritorial action NA DOT action NA LWCD action The erosion and sediment control staff has approved the revised erosion control plans. DNR action The DNR has received the map. Highway Department action The Highway Department has approved the road plans. County Surveyor's Dept action The County Surveyors office has approved the plat. Staff recommendation This final plat was conditionally approved on November 28, 2006. On December 27, 2006 an extension to May 1, 2007 was given to meet the conditions. The conditions listed below are still not met. The applicant has requested a two year extension, 3 however the Committee has indicated that they want these applications from 2005 completed or have them brought forward for denial. Therefore staff recommends denial. Any new application in the future would be under the current ordinance and would start out at concept with a re- submittal of all applicable fees. Conditions: 1. Submit new soil tests for lots 1, 8, and 9. 2. Submit financial guarantees in the amount of 120 percent of the approved bids for the construction of the road and erosion control that serves lots 1 -20. 3. Make sure owner on plat document is consistent with the deeds; don't interchange Collova with Bass Lake Investments. Blackburn reviewed the staff report noting that staff recommends denial. Motion by Troyer, 2nd by Ruetz to deny approval of the plat. Motion carried. Bristol Farms, Section 19, Star Prairie - Owner(s) Oakwood Land Development Agent(s) Surveyor Mark Kretschmer Location Section 19, Town of Star Prairie Number of lots 37 lots totaling 86.11 acres Original parcel 86.11 acres Zoning district Ag. Residential Soil test Complete soil tests have been submitted for each lot. Waiver request for road None requested construction. Bids and financial guarantees Submitted, need originals and must be auto - renewable. Township action Has conditionally approved the preliminary plat. Final plat must be signed by the town. Engineering plans must be stamped by a professional engineer. 3. Submit original letters of credit and change them to be auto — renewable. 4. Fence all soil tested areas. Staff suggest using the approximate 6 foot high "T" posts and then placing rope or fencing around the posts. 5. Provide 3 benchmarks. 6. Provide high water elevations for drainage easements and all water features. Blackburn reviewed the staff report. No representative of this development was present. Motion by Krueger, 2nd by Burri to deny approval of the plat. Motion carried. Discussion of plats and CSM's that are currently in the review process Blackburn reviewed with the Committee the summary of land division submittals. Copies of technical review letters regarding the corresponding plats were reviewed. He noted that only one application for a major subdivision was submitted in May. Planning and Zoning Business — Bills, Invoices and Revenue Report — The Zoning bills and revenue report for April 2007 were reviewed by Committee members and signed by Chair Habhegger. Municipal Plats — None Waivers to be Scheduled — Two waiver requests were received, one in Town of Kinnickinnic and one in Town of Hudson. Committee members agreed to schedule the hearing during its regular Committee meeting on June 26 at 8:30 a.m. Code Administration Report — Grabau reported that staff is working on a large number of violations. Carrie Stoltz has gone through all the files and is working with people getting the many issues resolved. The Camacho property in Town of Star Prairie is cleaned up. The renters were evicted, and the owners have cleaned the property very well. Land Use Ordinance Amendments — Fodroczi requested input from Committee members in preparation for the public hearing on May 24. He distributed a list of the questions asked by County Board Supervisors at the May 15 County Board Meeting. Only one simple question was asked about the sign regulations. a. Sign Regulations — Denzer stated that in the comments received from Town of Hudson, it was noted that house address signs should be 12" x 20" in size. Denzer stated that the legal firm is doing research without great cost. b. Non - metallic Mining Ordinance - The Committee reviewed the other questions regarding the nonmetallic mining ordinance. A major concern is costs. Fodroczi stated that the process of determining cost issues for site reports has already started. 5 Comments were received from Dr. Tinker. Feedback was also received from an experienced hydrogeologist working for Minnesota DNR who prepared a study in Minnesota that the industry cited at the last information meeting. Depending on the site, one report could cost $1,000 for minimal work and up to several thousand dollars on a limestone quarry. Fodroczi has had conversations with Bob Heise and Ron Raymond about having a public hydrogeologist who is not working with the industry do a presentation to the County Board. The Committee discussed the questions raised at the County Board meeting by members of the Transportation Committee and whether or not to do a groundwater presentation prior to the June County Board meeting and/or to the Transportation Committee. The Transportation Committee's main concern is the cost of studies. It was suggested that a UW Extension hydrogeologist do a presentation. Fodroczi will discuss these possibilities with Dick King and Tim Ramberg. Troy Riverway Ordinance - Fodroczi stated that he had just received actual ordinance amendments to the Town of Troy Riverway ordinance. Another hearing is scheduled for June 7. Some of these revisions may create inconsistencies between town and county ordinances. Fodroczi will ask the town for an explanation of the proposed changes and a copy showing the changes. It appears that the Town ordinance will be duplicative, and each landowner will need two permits. An email was received from Supervisor Marzolf indicating his concern. Fodroczi will ask to have the comment period open for two weeks after June 7. Fodroczi received copies of comments from a number of Riverway families objecting to the ordinance amendments and various aspects of the town process of developing the ordinance. Planning and Zoning staff will attend the meeting. FEMA Floodplain Map Update - Fodroczi reminded Committee members of the two meetings this day in Baldwin. Several staff members will attend. A meeting for local officials is planned at 3:00 p.m. at the Ag Center in Baldwin. FEMA and Ag staff will meet with County staff and local officials of cities and villages. Some town officials may also attend. A public open house is scheduled for this evening. Announcement of this open house was sent to media, builders, realtors, and lenders. The proposed amendments to the County's Nonmetallic Mining ordinance, Chapter 14, are to bring it into compliance with changes to Chapter NR 135, Wisconsin Administrative Code, adopted in December 2006 by the Wisconsin Department of Natural Resources. 2) Proposed amendments to Chapter 17, Zoning Ordinance, Section 17.65 Sign Regulations: Comments and questions from the public will be heard and addressed. The proposed amendments to the County's sign regulations are to address identified inadequacies in the existing sign regulations regarding standards, approval process and sign needs of county businesses.
