CROIX COUNTY GOVERNMENT CENTER, HUDSON WI January 23, 2007 Present: Committee: Supervisors Lois Bum, Wally Habhegger, Gene Ruetz, Stan Krueger, Ron Troyer Staff: Dave Fodroczi, Alex Blackburn, Kevin Grabau, Chuck Whiting, Judy Olson Guests: Joe Granberg, Larrie Quam, Paula Estlund, Dennis Czubin, Sharon Czubin Call to Order: Chair Habhegger called the meeting to order at 8:40 a.m. Adoption of Agenda: Motion by Bum, 2" d by Ruetz to adopt the agenda. Approval of Previous Minutes: Motion by Bum, 2 by Ruetz to approve the minutes of December 27, 2006 and January 9, 2007. Motion carried. Date of Next Meeting: Tuesday, February 13, 2007, 8:30 a.m. Old and New Business: WAIVER FROM LAND DIVISION REGULATIONS 1. APPLICANT: Paula Estlund LOCATION: NE 1 /4 of NE 1 /4 and NW 1 /4, NE 1 /4, Section 16, T28N, R19W, Town of Troy, ADDRESS: 393 No. Glover Road, Hudson REQUEST: Waiver to width of lot at setback line pursuant to section 13.7G2d and of the St. Croix County Land Division Ordinance. Blackburn reviewed the request and issues pertaining to the request. Staff received no input from the Town of Troy. Paula Estlund stated that she had tried unsuccessfully many other ways to create access to the lot. Motion by Krueger, 2 nd by Burri to approve this request. Motion carried unanimously. 2. APPLICANT: Lame Quam LOCATION: NW 1 /4, Section 7, T30N, R16W, Town of Emerald ADDRESS: Highway 63 REQUEST: Waiver to driveway requirements pursuant to section 13.7G3d of the St. Croix County Land Division Ordinance. Blackburn explained the request and reviewed maps of the proposed land division. Town of Emerald has no objection to this waiver request. Staff recommends approval. Joe Granberg stated that because this is a controlled access highway, DOT will not allow more accesses on this highway. Neighbors Dennis and Sharon Czubin expressed concerns about allowing a driveway in this area. Larrie Quam stated that he wants to plan for an access to property not currently accessible for building in the future. Quam explained the history of the easement currently on the Czubin property. Motion by Troyer, 2 nd by Krueger to approve this waiver based on section 13.7G3d. Motion carried. Final Plat(s) and Town - Pond View Acres — Owner(s) Darin Oftsie Agent(s) Surveyor Roger Humphrey Location Section 10 Town of Cady. Number of lots 28 lots Original parcel 65 acres Zoning district No Zoning. Soil test Soil tests have been submitted. Several tests will need interpretive determinations and some lots may not support septic systems. Waiver request Has been approved Bids and financial guarantees Have been submitted. Township action The town has not signed the map. They have stated that the roads are not constructed to town standards. Extraterritorial action NA DOT action NA LWCD action The LWCC has recommended approval of the erosion control plans. DNR action The DNR has received the map. Highway Department action The Highway Department has recommended approval of the road plans. County Surveyor's Dept action Needed Staff recommendation This application is currently tabled. The old ordinance required roads in a subdivision to be dedicated to the town. The applicants were not able to get this done. Therefore staff recommends denial of this plat and release the letter of credit for road construction. Staff recommends retaining the letter of credit for erosion control until the site is stabilized and the road connection is abandoned where the proposed road connects to 310 street. Comments: Blackburn reviewed the proposed plat and a revised staff report. On January 19 the applicant applied to the town to have the road dedicated. Lots were combined and some lots were labeled as outlots. Staff recommends tabling until April 24. Motion by Krueger, 2 ° by Burri to use staff recommendation that this application remain tabled and, if all requirements cannot be met by April 24, 2007, staff would bring this application to the Committee meeting on that day with recommendation for denial. Motion carried unanimously. Public Hearings to be Scheduled - Committee members agreed on a February 28, 7:00 p.m. hearing. Discussion of Plats and CSMs that are Currently in the Review Process - Blackburn reviewed the list and presented copies of Technical Review Committee letters sent to developers this month. Committee members discussed plats and CSMs that are currently in the review process. 2 Planning and Zoning Business — Municipal Plats — none Code Administration Report — Grabau is following up on outstanding violations and questions from town officials about whether or not conditions for certain special exception permits have been followed or completed. Bills, Invoices and Revenue Report — The Zoning bills and revenue report for December 2006 were reviewed by Committee members and signed by Chair Habhegger. Fodroczi reported that revenue is 67% of the overall projections for the year. He will have final 2006 expenses for the February 13 meeting. Lake Mallalieu Dam - Fodroczi reported that Finance Committee approved paying $10,000 to the City of Hudson for dam repairs - $5,000 from 2006 budget and $5,000 from the 2006 contingency fund. He will work with Whiting to negotiate a written agreement with the City. Personnel Update — Interviews for the Code Administrator position will be scheduled during the following week. Krueger will participate in those interviews. Closed session per WI Stat. 19.85(1)e for the purpose of discussing bargaining strategy. Reconvene into open session to complete other agenda items. Motion by Krueger, second by Burn to go into closed session pursuant to Wisconsin Statutes section 19.85(1)e for the purpose of discussing bargaining strategy. Roll call vote; Burri, Habhegger, Krueger, Troyer, Ruetz; all aye. Moved into closed session at 9:35 a.m. Motion by Krueger, second by Troyer to come out of closed session at 10:30 a.m. Office Manager Position - The timeframe for this item is pending Chuck Whiting's discussions with the union. Land Use Ordinance Amendments — Sign Regulations — A timeframe for sign regulations and non - metallic mining ordinance changes was distributed. Fodroczi requested the Committee to consider looking for outside legal counsel that has experience with these types of regulations. Such attorneys are highly specialized with experience in First Amendment issues. There has been a lot of legal activity with cases like this in the Twin Cities area. These are Federal Constitutional issues rather than State issues. Fodroczi feels that this is advisable from a financial standpoint. He will bring information regarding costs and other options to the next meeting. From his experience with sign regulations in the City of Hudson, Troyer spoke in favor of hiring legal counsel with such experience and background. With the three staff vacancies there should be accrued savings in the budget to cover this expense. Setback Provisions in Land Division Ordinance - Fodroczi reported that work sessions were held the previous week with Mary Murphy who championed for ordinance changes. Proposed adjustments were presented and discussed. No change is proposed in the processing of requests for setback reduction. Fodroczi will attend the quarterly Towns Association meeting on January 25 and will brief town representatives on these changes. The Committee will decide at the February 13 Committee 3 meeting on whether to hold a public hearing on these amendment changes. Non - metallic Mining Ordinance - Denzer reviewed the timeline for sign regulations and amendments to the nonmetallic mining ordinance with adoption by County Board planned for June 19. Motion by Krueger, 2nd by Troyer to approve the timeline. Motion carried.
