MINUTES
PLANNING AND ZONING COMMITTEE
ST. CROIX COUNTY GOVERNMENT CENTER, HUDSON, WI
February 28, 2007
Supervisors: Wally Habhegger, Stan Krueger, Ron Troyer and Gene Ruetz were present. Lois Burri was
absent and excused. Staff. Kevin Grabau and Dave Fodroczi.
Guests: Dennis Neumann, Jerry Ripley, Theresa Johnson, Mark Grabowski, David Gray, Bill Peavey, Miles
Wittig, Don Johnson, Megan Johnson.
Chairperson Habhegger called the meeting to order at 7:00 p.m. The next meeting for this committee will be
March 13, 2007 at the Government Center in Hudson. Motion by Troyer, 2 nd by Ruetz to adopt the agenda.
Motion carried.
The public hearing notice was acknowledged for the record.
REZONING
APPLICANT: Dennis Neumann
LOCATION: Sections 24 and 25, T31N, R19W, Town of Somerset
ADDRESS: 2039 Highway 35, Somerset
REQUEST: Pursuant to Section 17.72 of the St. Croix County Zoning Ordinance to rezone approximately
128.32 +/- acres of land from Agricultural to Agricultural- Residential.
Grabau presented the staff report and attachments. He reviewed the respective staff recommendations for parcel
A and parcel B. Staff recommendation for parcel A is approval based on multiple findings in the staff report.
Staff recommendation for parcel B is denial due to lack of access. Chair Habhegger opened the hearing at 7:15
p.m.
Jerry Ripley, JEO, agent for the owner and applicant, said that he talked to Diane Sherman's replacement and
Wisconsin DOT is not limiting access on State Highway 35.
Dennis Neumann, owner, indicated that parcel A was the first parcel purchased as 80 acres zoned Agricultural.
The other 10 acres was subsequently purchased as Ag- Residential.
Theresa Johnson, Chair, Town of St. Joseph said she does not usually weigh in on other Town business, but the
rezoning shouldn't be based on current availability of access.
Mark Grabowski, neighbor, referred to the Somerset Town Plan and expressed concerns about limitations of
soils for 80 +/- septic systems.
Jerry Ripley responded that part of the property is under shoreland zoning with applicable setbacks and soils are
generally suitable. Grabau reviewed the site maps from the staff report that showed a lack of limitations for
septic systems.
Chair Habhegger closed the hearing at 7:40 p.m.
Motion by Krueger, 2 nd by Troyer to recommend approval of rezoning to Agricultural- Residential for both
parcels. Krueger referenced the town approval and staff findings other than available access. Krueger and
Habhegger indicated access can be addressed as development occurs. Motion carried.

Ordinance Amendments to the St. Croix County Land Use Regulations Chapter 13, Land Division
Blackburn summarized input from landowners and town officials that requested the proposed revisions to the
procedures for adjusting setbacks recorded on plats and certified survey maps. The main concern was that the
adjustment could be made to developed parcels as well as vacant parcels. Blackburn indicated that the new
language would allow adjustment to setbacks on both developed and vacant parcels with Planning and Zoning
Committee approval. He then reviewed the details of the proposed revisions. Chair Habhegger opened the
hearing at 7:45 p.m.
Theresa Johnson, Chair of the Town of St. Joseph, questioned the wording of the proposed language as it
applied to the involvement of towns.
David Gray, property owner in the Town of Kinnickinnic, explained that he owned one of two developed lots in
a four -lot CSM on River Drive. He referenced a letter he previously submitted and suggested that the setback of
50 feet should be available to all landowners to be fair.
Bill Peavey, County Supervisor from the Town of Eau Galle, expressed concern about the fee that would apply
to his property. Staff clarified that his property would not be affected by these provisions, because it has not
been subdivided.
Miles Wittig said he was the only town official in Town of Somerset that did not support the 50 foot setback. He
thought it was too close for noise and safety. He said properties should comply with neighbors.
Don Johnson, Baldwin Town Supervisor, said the Town prefers a 100' setback.
Megan Johnson, property owner in the Town of Kinnickinnic, wants to add a deck to her home and supports the
proposed revisions.
Jerry Ripley, JEO Consulting, expressed concern that "layout, design, continuity and/or aesthetics" are
subjective terms that could lead to inconsistent interpretations.
Habhegger closed the hearing and adjourned the meeting at 8:25 p.m. He thanked all of the public in attendance
for their participation in the hearing.
