CROIX COUNTY GOVERNMENT CENTER, HUDSON WI March 13, 2007 Present: Committee: Supervisors Lois Burri, Wally Habhegger, Gene Ruetz, Ron Troyer, Stan Krueger Staff: Dave Fodroczi, Alex Blackburn, Ellen Denzer, Brett Budrow, Kevin Grabau, Jennifer Havens, Judy Olson Guests: Theresa Johnson, Ted Anderson Call to Order: Chair Habhegger called the meeting to order at 8:31 a.m.. Adoption of Agenda: Motion by Ruetz, 2 nd by Krueger to adopt the agenda. Motion carried. Approval of Previous Minutes: none Date of Next Meeting: A public hearing is scheduled for March 21 at 7:30 in Hudson. The next Committee meeting will be held on March 27 at 8:30 a.m. Old and New Business: Land Use Ordinance Applications - Municipal Plats - none submitted Public Hearings to be Scheduled - One rezoning application was received and will be scheduled for public hearing in April. Rezone for Ted & Bergetta Anderson: Alex reviewed the staff report. This request was conditionally approved on December 17, 2003 and the conditions have not been met. Ted Anderson gave the history of the zoning of the property. The request for rezoning was approved by the town board three years ago. Theresa Johnson showed maps showing the town road giving access to the property and explained the town plan for connecting roads through adjoining property. She recommended approval of this request. Anderson stated that the surveyor assured him that he has access to the property via the town road, 142 Street, and was upset that County Zoning did not require the surveyor to give him an outlot or some type of access to the northern property. Johnson stated that 142 Street is a dedicated town road that goes to his property. Habhegger moved to recommend approval of the rezoning without the condition and forward to County Board for approval. Motion 2nd by Troyer and carried unanimously. Planning and Zoning Business Bills and Invoices - The February 2007 Planning Revenue Report and February 2007 Planning Bills and Invoices were reviewed by the Committee and signed by Chair Habhegger. Personnel Update — Fodroczi reported that interviews were held the previous week for the Zoning Technician position. Members of the interview panel were in agreement on ranking of the candidates. References are being checked and an offer will be made to the leading candidate this week. The new employee should be in place in two weeks. Fodroczi stated that he is not planning to refill the Zoning Specialist position vacated by Grabau in the near future. There is no movement with the office manager position, but Chuck Whiting continues conversations with the union representative. Fodroczi will talk to Whiting to see if anything can be done and will report at the next meeting Office Remodeling — This project was approved by Finance Committee to go ahead with moving EDC within the P &Z suite. Planning Report - Havens reported that the 2007 Award for Outstanding Achievement in Education was presented to St. Croix County Recycling Program by Associated Recyclers of Wisconsin (AROW). Committee members offered their congratulations to Havens. She will report to the County Board on the growth of recycling in the County. Denzer reported that the bike planning project being done with Land and Water Conservation is going well. The Town of Cylon is making good progress on its subdivision and driveway ordinances. The City of New Richmond is working on an official mapping project which the Town of Star Prairie will review and provide comments. Budrow reported that the Town of Warren proposed subdivision ordinance was received and reviewed by staff. Comments were submitted. The public hearing was held the previous week. Budrow stated that he found areas that could cause conflicts with developers. He attended the public hearing as an interested resident. He stated that he supports the conservation design, however the plan is to allow only one common septic system for an entire plat. The proposed ordinance is not on their website and digital copies are not available. The ordinance should work compatibly with the County ordinance. Fodroczi reported that he is waiting for release of the grant award announcement from Regional Planning. Notice should be received this month. He talked with the DOT on the mitigation activities for the St. Croix River Crossing. The Record of Decision runs through early June. He expects that organization of those activities will start in April or May. He feels the DOT is being cautious because of possible litigation. He stated that he received a Visual Quality Manual on the St. Croix River Crossing Project. Land Information Report — Budrow reported that he, Kay Walsh, Renee Potter and Dave Fodroczi attended the recent Wisconsin Land Information Association annual conference on land info and GIS projects which included discussion on where money from recorded real estate documents goes into the land information fund. The portion of that money that goes to the state used to come back to the counties in the form of contribution based grants but there were no grants in the last two years because that money was diverted into comprehensive planning grants. We applied for and received such a grant for the Heartland Project. Budrow stated that another aerial photography project may be done in 2009 or 2010. A grant would be needed for that. A $30,000 grant was received for the 2004 photography project. We would like to partner with local municipalities on such a project. A national program, Imagery for the Nation„ is putting together a program that would help eliminate overlapping projects. We could partner with that program to do aerial photography. Fodroczi said that when counties partner on such projects an average savings of 30% is possible. By organizing 2 photography nationally, federal and state resources could pool together and locals would benefit by getting on a more frequent schedule and save money doing it. We will support Wisconsin's effort in doing that. Budrow reported that the Wisconsin Land Information Association developed a Strategic Plan for GIS in Wisconsin. The outcome of that is to put together a Wisconsin Geographic Information Council. We have been encouraged to contact legislators to request the Governor to issue an executive order to create this Wisconsin Geographic Information Council to provide advice and coordination of GIS throughout the state. GIS in Wisconsin is very strong at the county level but somewhat lacking at the state level. This council will coordinate all activities. Wisconsin is only one of eleven states that does not have a body similar to this. State Representative Parisi of Madison is authorizing a proposal to allow an owner of real property to opt out of having their name published on any internet list of government data for real property. This would cause significant problems with our website. Currently our website has a subscription access allowing name search. Keeping track of who opts out would be a significant issue. Land Information Officers Network has met with Representative Parisi and proposed doing subscription service similar to what we already have. The opposing view to the Legislator wanting to take out names is Wire Data open records case - Wire Data versus City of Port Washington, Village of Thiensville and Village of Sussex. Wire Data wanted to get assessment information for those municipalities that had contracted with Market Drive who would only provide paper copies. Wire Data needed electronic copies. The court upheld that the law requires access to the source material that is both input and stored in the database regardless of its form or characteristic. That could have an impact here although we already provide data for the cost of reproduction. Several county assessors use the Market Drive software. Real Property Lister Update - Fodroczi reviewed the 2007 assessment scheduling. Real Property staff is now tracking when work rolls are processed. The first one was received the previous week from the City of New Richmond. CD's are provided for each municipality and those municipalities are encouraged to submit data reports in electronic format. The City of Hudson has not made a decision on turning over Real Property processing to the County. It is hesitant on making that changeover this year. Land Use Ordinance Amendments — Sign Regulations — Copies of sign ordinances from across the state were received from Lamar Outdoor Advertising in response to the public information meeting. Fodroczi has received some good referrals on finding an attorney with experience in sign ordinances. Habhegger stated that Finance Committee approved using department funds to pay for special counsel to work with Corporation Counsel on this project. He stated that this project would take too much time for Corporation Counsel to handle alone. Committee members agreed that Fodroczi should make the selection. Fodroczi stated that a firm in Bloomington that represented the City of Minnetonka would be a good candidate. An associate in that firm has worked on many sign cases, tried appeals court cases, and taught municipal attorneys. This firm was recommended by Brian Ohm of UW Extension and by the League of Minnesota Municipalities. Fodroczi stated that an attorney will be used only as much as necessary. 3 t Non - metallic Mining Ordinance - Jenny Shillcox has been working with Steve Olson on drafting necessary amendments and holding full staff work sessions as well. There were two or three areas of consideration such as mining groundwater. They will look at some potential standards not required in NR135. Land and Water Conservation Committee will discuss this more at its April meeting and their input will be considered. Letters were received from Don Schumacher on signage and the nonmetallic ordinance. Setback Provisions in Land Division Ordinance - Ellen distributed copies of a letter from Greg Timmerman with questions and suggested changes to the amendments. She reviewed those items and staff responses. Few specific suggestions for changes were received after the public hearing. Denzer presented the ordinance amendments for approval. Motion by Burri to recommend adoption by County Board. Motion 2" by Ruetz and carried. Announcements and Correspondence - Denzer stated that Wisconsin DOT has completed the environmental assessment on State Highway 64 and 65 from New Richmond east then north. It is available at the Deer Park Library, the New Richmond City Hall and Library as well as online. She announced that an invitation was received from Rolling Hills Farm, the first conservation design development in St. Croix County, to a celebration of its completion on March 29 at the sales center. Information on this petition may be obtained from the Planning and Zoning Department, Hudson, St. Croix County, Wisconsin. 2) Ordinance amendments to the St. Croix County Land Use Regulations Chapter 13, Land Division, to accomplish the following: a. Change to 13.10 B. 1.a.2), 3) and 4) To allow reductions in setbacks on plats for lots with existing structures. b. Change to 13.2 A.2.f. To no longer require that setbacks be shown on the final plat.
