Hudson, WI 54016 Re: Boeder Land Use Permit, Filling & Grading <10,000 s.f. in the Lower St. Croix Riverway District 715- 386 6 Code A - 4680trat Parcel #13.28.20.576G, lot 13 in CSM 15/1205, Town of Troy Land Information Dear Mr. & Mrs. Boeder: Planning 715- 386 -4674 This letter confirms zoning approval according plans submitted by James Thompson, Contractor, on September 3, 2008 for the following activities that require a land use Real Nope permit: 715 -3 677 Pursuant to Section 17.36.F.2.a.2 - Filling and grading an area <10,000 square feet Re cling outside of the slope preservation zone and greater than 40 feet from the slope - 386 -4675 preservation zone in the Riverway overlay district is allowed with a Land Use permit. The filling and grading is being conducted to replace an existing hydraulically failed private on -site wastewater treatment system ( POWTS). Staff finds that the proposed activities meet the spirit and intent of the St. Croix County Zoning Ordinance and Riverway District with the following findings: 1. The property consists of 10.9 acres, is zoned Ag /Residential, and is located in the Rural Residential Management Zone of the Lower St. Croix Riverway District; 2. The Wisconsin Department of Natural Resources has been sent a copy of the application and concurs that a land use permit may be issued with condition that proper erosion and /or sediment control methods be used. 3. The St. Croix County Land and Water Conservation Department has reviewed the plans and had no additional comments on the project. 4. The erosion control plan proposes to limit disturbance to the 3 new dispersal cells with topsoil cover and seeding /mulching immediately after POWTS installation has been completed. This will include conditions for maintaining any additional erosion or sediment control measures necessary until self- sustaining permanent vegetation is established on all disturbed areas and prohibiting the use of phosphorous fertilizer to establish and maintain a lawn on the disturbed areas. 5. Filling and grading less than 10,000 square feet in area on slopes greater than 40 feet from the slope preservation zone is allowed with a land use permit in the Lower St. Croix Riverway District pursuant to Section 17.36.F.2.a.2) of the St. Croix County Zoning Ordinance; . All activities approved as part of this land use permit shall commence within one year from the date of approval and be substantially completed within two years, after which time the permit expires pursuant to Section 17.36 J.7 of the Ordinance. Prior to expiration, the applicant may request extensions of up to six months from the Zoning Administrator. The total time granted for extensions shall not exceed one year. 6. Failure to comply with the conditions above may result in the revocation of this permit pursuant to Section 17.36 J.8.b of the Ordinance. This ap val does not allow for any additional construction,. grading, filling, or clearing of vegetati beyond the limits of this request. Any remaining site work above and beyond what is identifi as part of this land use permit application shall be subject to the review and approval of the Zo g Administrator. Adm. Code General The conventional septic system shall be operated in accordance with Comm 82 -84 Wis. Adm. Code, and shall be maintained in accordance with component manual SBD- 10567 -P (R.6/99). All local and/or state rules pertaining to system maintenance and maintenance reporting shall be complied with. Septic Tank The operating condition of the septic tank and outlet filter shall be assessed at least once every two years by inspection. The septic tank contents shall be removed when the sludge and scum in the tank exceed 1/3 the liquid volume of the tank. The contents of the septic tank shall be disposed of in accordance with NR 113, Wis. Adm. Code, by an individual certified to service septic tanks under s. 281.48, Stats. If the contents of the tank are not removed at the time of a biannual assessment, maintenance personnel shall advise the owner of when service will be needed to maintain less than 1/3 scum and sludge accumulation in the tank. The outlet filter shall be cleaned as necessary to ensure proper operation. The filter cartridge should not be removed unless provisions are made to retain solids in the tank that may slough off the filter when removed from its enclosure. If the filter is equipped with an alarm, the filter shall be serviced if the alarm is activated. Septic tank manholes risers, access risers, and covers should be inspected for water tightness and soundness. Access openings used for service and assessment shall be sealed watertight upon the completion of service. Any opening deemed unsound, defective, or subject to failure must be replaced. Exposed access openings greater than 8 inches in diameter shall be secured by an effective locking device to prevent accidental or unauthorized entry into the tank. No individual should ever enter the septic tank as dangerous gases may be present that could cause death. Septic tank abandonment shall be in accordance with Comm83.33, Wis. Adm. Code when the tank is no longer used as a POWTS component. The addition of biological or chemical additives to enhance septic tank performance is generally not required. If such products are used they shall be approved for septic tank use by the Department of Commerce, Safety and Buildings Division. Pump Tank The pump (dosing) tank shall be inspected at least once every two years. All switches, alarms, and pumps shall be tested to verify proper operation. Soil Absorption Cell Trees or shrubs should not be planted directly on the soil absorption system. The area above and around the system should be seeded and mulched as necessary to prevent erosion and provide some degree of frost protection. Traffic (other than for vegetative maintenance) over the system is not recommended. Soil compaction may hinder aeration of the infiltrative surface within the system and will promote frost penetration during cold weather months. Cold weather installations (October - February) dictate that the system be heavily mulched for frost protection. Influent quality into the system may not exceed 220mg/L BOD5, 150 MG/L TSS, and 30 mg/L FOG. Influent flow may not exceed maximum design flow specified in the permit for the installation. Observation pipes within the dispersal cell shall be checked for effluent ponding. Ponding levels shall be reported to the owner. Levels above 4 inches indicate an impending hydraulic failure requiring additional, more frequent monitoring. Contineencv Plan If the septic tank or any of its components become defective the tank or component shall be repaired or replaced to keep the system in proper operating condition. Excessive ponding within the dispersal cell will be eliminated by removing biologically clogged adsorption and dispersal media and replacing said components as deemed necessary or by installing a new soil absorption cell to bring the system into proper operating condition. Questions on the operation or maintenance of the system should be directed to Jim Thompson, the master plumber in charge of the system installation, or your county zoning inspector. ST. The parcel is bordered by the St. Croix River and bluff ( >12% slopes) on its west side and North Cove Road on its east. The proposed project area is located approx. 45' landward of the 100' setback as established by CSM Vol_ 5, Pg. 1205. The proposed project includes the replacement and abandoned of an existing hydraulically failed POWTS drywell. The proposed project will include installation of a sewage lift pump in the existing septic tank that will discharge to a new 1,000/500 gallon two (2) compartment septic tank. A new POWTS dispersal component will then be installed downstream consisting of three trenches at 2.83' x 82.00'. The drywell abandonment will be accomplished by removing all liquid waste and filling with concrete, The proposed area of disturbance will be stripped of topsoil immediately prior to construction of the POWTS. Topsoil will be stockpiled adjacent to the system area. Excavations for material installation will be completed immediately prior to, and will be closed Immediately after installation of materials. Topsoil will be replaced immediately upon completion of installation — anticipated as 8 hours after project is begun. Re- vegetation will consist of spreading grass seed across all area of disturbance upon completion of project. Based on the field measurements collected, the area of disturbance will comply with the requirements of the St. Croix County Lower St. Croix Riverway Zoning Ordinance, Chapter 17.36 F.2a.2. The floodway and floodplain arc greater than 200' form the project area. There are no wetlands on the site.
