This does not include 7�5 applications for installation of new POWTS. We have received the concurrence of the Wisconsin Department of Natural Resources to initiate this method of processing applications to replace failing POWTS in a timely manner. Repair or replacement of POWTS that service existing dwellings along the St. Croix River can present unique problems based on site limitations. There have been several recent cases where replacement of failing POWTS have been delayed for months while awaiting approval of special exception permits or variances due to the project's inability to meet setbacks from blufflines, OHWM, slope preservation zones, etc. Failing POWTS often pose serious health and /or environmental hazards that need to be remedied as quickly as possible. We have cooperatively developed this policy with Wisconsin Department of Natural Resources staff based upon the following interpretations of NR 118 and our County Riverway Ordinance: • NR 118.05(1)(a) lists single family homes and accessory uses as permitted in all management zones if the standards in NR 118.06 are met; • NR 118.06(7) Private On -site Wastewater Treatment Systems states that POWTS "shall be constructed in accordance with requirements of ch. Comm 83 "• • St. Croix County Riverway District ordinance Section 17.37.F.2.a.1) allows single family residences and accessory uses subject to standards in 17.36 H. and with a land use permit from the County Zoning Administrator. POWTS are an accessory use associated with single family homes, therefore replacement may be allowed with a land use permit; ST. She 715 -3 677 received support and encouragement to expedite the process by issuing both a sanitary and land use permit simultaneously. This letter is intended as a follow up on that specific Re cling issue. Repair or replacement of POWTS that service nonconforming structures along 386 -4675 the St. Croix River often present unique problems based on site limitations and zoning staff are seeking a more efficient method of processing those particular sanitary permit applications. After adopting the updated Riverway ordinance in July 2005, zoning staff began to apply filling and grading requirements from Section 17.36.F.2 and 17.36.F.3 to the excavation necessary for installation of both new and replacement POWTS. However, the location of an existing house and its failed POWTS may require a land use permit, a special exception, or a variance in addition to the sanitary permit. There have been several cases is the past couple years where replacement POWTS have had to be installed in stages due to zoning requirements, waiting two months for the Board of Adjustment approval of the project. When an existing POWTS is in dire need of repair or replacement, this type of delay seems counter - productive to the spirit and intent of both the state and county ordinance. I think that both our departments would agree that failing POWTS may pose health or environmental hazards that need to be remedied as quickly as possible. NR 118.05(1)(a) lists single family homes and accessory uses as permitted in all management zones if the standards in NR 118.06 are met. St. Croix County Riverway District ordinance Section 17.37.F.2.a.1) allows single family residences and accessory uses subject to standards in 17.36.H and with a land use permit from the County Zoning Administrator. We interpret POWTS as being an accessory use associated with single family homes and as such are allowed with a land use permit.
