The permit granted was for a temporary occupancy permit in a trailer while Blekum constructed his house. Health problems, weather and unforeseen construction delays have slowed the construction. The township of St. Joseph supports the proposal. Motion by Menter, seconded by Neuman to grant a six (6) month extension for the temporary occupancy use permit of the trailer so construction can be continued. Nelson read the notice of the hearing as published: The St. Croix County Board of Adjustment has scheduled a public hearing for Thursday, January 28, 1993 at 9:30 A.M. in the County Board Room of the St. Croix County Courthouse, Hudson, Wisconsin to consider the following appeals to the St. Croix County Zoning Ordinance. JOHN FOKER/MARC PUTMAN Nelson introduced the application stating that this was a three BOARD OF ADJUSTMENT MEETING AND HEARING January 28, 1993 (This meeting was recorded by a Court Reporter) The meeting was called to order by vice chairman Stephens at 9:00 A.M. Stephens explained the procedures of the hearing requesting that individuals wishing to testify sign their names in the front of the room. Supervisors Menter, Neuman and Stephens were in attendance. Supervisors Bradley and Kinney had excused absences. Staff included Zoning Administrator, Tom Nelson. Motion by Menter, seconded by Neuman to approve the agenda as published. Motion carried. Motion by Neuman, seconded by Menter to approve the minutes as mailed. Motion carried. OLD BUSINESS ALAN BIGLOW Nelson stated that this was back before the Board because of several unanswered questions that came up after the site visit last month. One of these questions was how the original access permit was issued. Having checked with the County Highway Department, a permit was issued back in 1988 for access to C.T.H. "V ". The construction of this drive did not follow the private easement or access onto C.T.H. "V" perpendicularly as it should have. Now that this access is serving as a point access, there is the need to exceed the twenty -four (24) foot width standard. After a brief discussion it was agreed that it would be better to rehear and view this site at the May meeting when the snow is gone. At this same time someone representing the Highway Department should be in attendance to answer questions. part request on property located along the St. Croix River. The first part is requested is to be able to replace the existing deck that has fallen into disrepair. Second, they would like to add a second deck at the top of the roof line for astronomy purposes. Third, they would like to install a drainage system for surface waters that would involve a fair amount of filling and grading. Marc Putman provided site plans, pictures, and a detailed outline of the proposed activities. Dave Hense, Supervisor for the town of Troy stated that this application has not been reviewed by the township as of this time and therefore no recommendations can be made. After some discussion it was decided to postpone any decision until the township could give a recommendation. DR. DONALD J. AND BE'T'H ARVOLD Nelson stated that his request was a variance to reconstruct an entrance onto the Cylon Methodist Church building two (2) feet closer than the existing nonconforming structure. Dr. Don Arvold stated that there was need for this encroachment so as to provide a safer and separate entrance to the lower level of the building. The township of Cylon supports the proposal. Nelson stated that this was a request for an after the fact special exception use permit for a duplex. The building has been constructed without a code complying septic system or the special exception use permit. A permit was recently obtained for the septic system. Susan Wilmes presented plans showing the design of the building and how it was located on the lot. There was a discussion on building and fire codes relating to duplex residences. The township of Somerset supports the duplex request. At the conclusion of the hearings, the Board visited the sites in question. Upon returning, the Board of Adjustment rendered the following decisions: DR. DONALD J. Motion by Stephens, seconded by Neuman to conditionally approved the duplex based on the following conditions: 1. Septic system to be installed as per code; 2. Staircase be constructed with proper risers and treads; 3. No storage of materials beneath stair case; 4. Smoke detectors be located beneath the ceiling tiles in kitchens, bedrooms and furnace room. AK will not warranty tanks used for other applications, or which were not installed correctly. 2) Burial Depths: a) The top of the AK tank shall be buried at least 12 inches below the ground surface, and no more than 24 inches if backfilled with the excavated soil. b) If necessary to bury the top of the AK tank more than 24 inches below the ground surface, a course sand or fine gravel backfill 1/2 inch diameter or smaller, must be used. This backfill must completely surround and cover the AK tank and continue to within a foot (or less) of the ground surface. Topsoil may be used in the top one foot if desired. c) In no case shall the top of the AK tank be buried more than 24 inches (2 feet). 3) Driving over the AK tank is not allowed, except as follows: a) The top of the AK tank shall be buried at least 12 inches below grade, and no more than 24 inches. And ... b) backfill must be coarse sand or fine gravel (1/2 inch diameter or smaller). And ... c) this backfill must completely surround and cover the tank and continue to the ground surface. And ... d) no vehicles weighing more than 5000 lbs. may pass over the tank. And.. e) if riser is used, driving directly over the riser lid is not allowed. To assure proper operation and efficiency, perform regular maintenance on the AK septic tank. Maintenance, including pumping of the septic tank, must be performed whenever the top of the sludge layer in the septic tank is 5 S inches or less below the bottom of the outlet baffle of the septic tank, or the bottom of the scum layer in the septic tank is 3 inches or less above the bottom of the outlet baffle of the septic tank. Maintain written evidence of all maintenance performed on the septic tank. The chemical resistance of polyethylene is dependent upon the composition of the environment to which it is exposed, the conditions of use, and the form of the polymer concerned. Tank inspections must include a visual inspection of the tank(s) to identify any missing or broken hardware, identify any cracks or leaks, measure the volume of combined sludge and scum and to check for any back up or ponding of effluent on the ground surface. The dispersal cell(s) shall be visually inspected to check the effluent levels in the observation pipes and to check for any ponding of effluent on the ground surface. The ponding of effluent on the ground surface may indicate a failing condition and requires the immediate notification of the local regulatory authority. When the combined accumulation of sludge and scum in any tank equals one -third (Y or more of the tank volume, the entire contents of the tank shall be removed by a Septage Servicing Operator and disposed of in accordance with chapter NR 113, Wisconsin Administrative Code. All other services, including but not limited to the servicing of effluent filters, mechanical or pressurized components, pretreatment units, and any servicing at intervals of 512 months, shall be performed by a certified POWTS Maintainer. A service report shall be provided to the local regulatory authority within 10 days of completion of any service event. GMW (4/01) START UP AND OPERATION Page '�E' of For new construction, prior to use of the POWTS check treatment tank(s) for the presence of painting products or other chemicals that may impede the treatment process and /or damage the dispersal cell(s). If high concentrations are detected have the contents of the tank(s) removed by a septage servicing operator prior to use. System start up shall not occur when soil conditions are frozen at the infiltrative surface. During power outages pump tanks may fill above normal highwater levels. When power is restored the excess wastewater will be discharged to the dispersal cell(s) in one large dose, overloading the cell(s) and may result in the backup or surface discharge of effluent. To avoid this situation have the contents of the pump tank removed by a Septage Servicing Operator prior to restoring power to the effluent pump or contact a Plumber or POWTS Maintainer to assist in manually operating the pump controls to restore normal levels within the pump tank. Do not drive or park vehicles over tanks and dispersal cells. Do not drive or park over, or otherwise disturb or compact, the area within 15 feet down slope of any mound or at -grade soil absorption area. Reduction or elimination of the following from the wastewater stream may improve the performance and prolong the life of the POWTS: antibiotics; baby wipes; cigarette butts; condoms; cotton swabs; degreasers; dental floss; diapers; disinfectants; fat; foundation drain (sump pump) water; fruit and vegetable peelings; gasoline; grease; herbicides; meat scraps; medications; oil; painting products; pesticides; sanitary napkins; tampons; and water softener brine. ABANDONMENT When the POWTS fails and /or is permanently taken out of service the following steps shall be taken to insure that the system is properly and safely abandoned in compliance with chapter Comm 83.33, Wisconsin Administrative Code: • All piping to tanks and pits shall be disconnected and the abandoned pipe openings sealed. • The contents of all tanks and pits shall be removed and properly disposed of by a Septage Servicing Operator. • After pumping, all tanks and pits shall be excavated and removed or their covers removed and the void space filled with soil, gravel or another inert solid material. CONTINGENCY PLAN If the POWTS fails and cannot be repaired the following measures have been, or must be taken, to provide a code compliant replacement system: _. - -_._._ ❑ A suitable replacement area has been evaluated and may be utilized for the location of a replacement soil absorption system. The replacement area should be protected from disturbance and compaction and should not be infringed upon by required setbacks from existing and proposed structure, lot lines and wells. Failure to protect the replacement area will result in the need for a new soil and site evaluation to establish a suitable replacement area. Replacement systems must comply with the rules in effect at that time. ❑ A suitable replacement area is not available due to setback and /or soil limitations. Barring advances in POWTS technology a holding tank may be installed as a last resort to replace the failed POWTS. ❑ The site has not been evaluated to identify a suitable replacement area. Upon failure of the POWTS a soil and site evaluation must be performed to locate a suitable replacement area. If no replacement area is available a holding tank may be installed as a last resort to replace the failed POWTS. ❑ Mound nd at-grade a at g ade soil absorption systems may be reconstructed in lace following removal of the biomat at the P Y Y P 9 infiltrative surface. It is recommended that a licensed pumper empty the dosing tank, allowing the pump to return to dosing the correct amounts. Consult your installer - immediately for advice. 5. Neglect of the vegetative"cover (the cells insulation & erosion preventive) can lead to failure. Compaction or heavy traffic also can destroy t he system. It IS NECESSARY TO REGULARLY WATER THE VEGETATION OVER A SYSTEM!! Effluent in the system beneath IS NOT sufficient alone tO maintain a yl over. 6. Periodic inspections by the owner, or his agents, is necessary. Inspection pipes and ports have been incorporated into the system: on the mound basal area (effluent level inspection pipes), cleanout terminals on the pressurized laterals, at each tip - for flushing and cleaning the laterals out. The filter system in the tanks (via a locked above ground cover /manhole), only a licensed properly qualibied person should be performing this work which involves health & severe safety risks. Evidence of effluent ponding in the system's treatment cell shall also be regularly inspected.
