Comm. 21.125 also requires the building permit applicant and /or landowner to follow erosion control procedures and maintain them until the site has been stabilized. The owner is responsible for notifying all contractors performing construction on this site that an Erosion & Sediment Control (ESC) Plan is in effect and the following activities will be required in order to maintain compliance with the plan: 1. The primary source for contaminated runoff on a replacement system is excavation for the septic system, but establishing cover on exposed soils will prevent erosion. Apply seed and mulch as recommended in #5. Maintain existing vegetation wherever possible to minimize sediment movement. Surface drainage is west toward the St. Croix River, down a >20% slope, but more than 200 feet away from the OHWM. The mound's forcemain will be installed along the ground surface traversing this slope, covered with soil and then erosion control blanketin g P will be installed over the to of both. Contaminated runoff must be contained within the property boundaries and not allowed to enter the river. 2. Silt fence or other approved sediment control products are required to assure that sediment will be contained on owner's property. The proposed site plan indicated silt fence will be installed at points along forcemain and below the mound until vegetation has been established. The POWTS inspector will evaluate ESC plan effectiveness and make recommendations to owner and building inspector for any action required to comply with applicable regulations and/or conditions in the sanitary permit. 3. Construction equipment and vehicles must utilize a stabilized driveway access off public road for heavy equipment; this includes cement trucks, well drillers, and other contractor's vehicles that access the property during construction. This helps avoid muddy, rutted conditions that may allow contaminated runoff to reach waterways and/or drainage ditches. Property owner must repair damage to ditches resulting from multiple access points and sediment tracked on public roadways must be removed at the end of each workday. 4. Stabilize new topsoil cover over septic system with seed and erosion control blanket immediately after installation — do not wait for final stabilization and/or landscaping of entire site to cover exposed soils on the system. If weather conditions will not permit seed germination, a heavy straw mulch cover will prevent erosion until grass /vegetation can get established. Erosion control matting can be applied any time of year and if installed properly, will provide protection even if seed germination is delayed. T , t 1 Mound System Management Plan Pursuant to Comm 83.54, Wis. Adm. Code General This system shall be operated in accordance with Comm 82 -84 Wis. Adm. Code, and shall maintained in accordance with its' component manuals ISBD- 10691 -P (N.01/01) and SSWMP Publication 9.6 (01/81)] and local or state rules pertaining to system maintenance and maintenance reporting. No one should ever enter a septic or pump tank since dangerous gases may be present that could cause death. Septic and pump tank abandonment shall be in accordance with Comm 83.33, Wis. Adm. Code when the tanks are no longer used as POWTS components. Septic or pump tank manhole risers, access risers and covers should be inspected for water tightness and soundness. Access openings used for service and assessment shall be sealed watertight upon the completion of service. Any opening deemed unsound, defective, or subj to failure must be replaced. Exposed access openings greater than 8- inches in diameter shall be secured by an effective locking device to prevent accidental or unauthorized entry into a tank or component. Septic Tank The septic tank shall be maintained by an individual certified to service septic tanks under s. 281.48, Stats. The contents of the septic tan shall be disposed of in accordance with NR 113, Wis. Adm. Code. The operating condition of the septic tank and outlet filter shall be assesse least once every 3 years by inspection. The outlet filter shall be cleaned as necessary to ensure proper operation. The filter cartridge should not be removed unless provisions a made to retain solids in the tank that may slough off the filter when removed from its enclosure. If the filter is equipped with an alarm, the fiftei shall be serviced if the alarm is activated continuously. Intermittent filter alarms may indicate surge flows or an impending continuous alarm. The septic tank shall have its contents removed when the volume of sludge and scum in the tank exceeds 1/3 the liquid volume of the tan the contents of the tank are not removed at the time of a triennial assessment, maintenance personnel shall advise the owner of when the ne) service needs to be performed to maintain less than maximum scum and sludge accumulation in the tank. The addition of biological or chemical additives to enhance septic tank performance is generally not required. However, if such products used they shall be approved for septic tank use by the Department of Commerce. Pump Tank The pump (dosing) tank shall be inspected at least once every 3 years. All switches, alarms, and pumps shall be tested to verify proper operation. If an effluent filter is installed within the tank it shall be inspected and serviced as necessary. Mound and Pressure Distribution System No trees or shrubs should be planted on the mound. Plantings may be made around the mound's perimeter, and the mound shall be seed and mulched as necessary to prevent erosion and to provide some protection from frost penetration. Traffic (other than for vegetative maintenance) on the mound is not recommended since soil compaction may hinder aeration of the infiltrative surface within the mound and sr compaction in the winter will promote frost penetration. Cold weather installations (October - February) dictate that the mound be heavily mull as protection from freezing. Influent quality into the mound system may not exceed 220 mg/L BOp150 mg /L TSS, and 30 mg /L FOG for septic tank effluent or 30 mg/L BOD 30 mg/L TSS, 10 mg/1_ FOG, and 1tf cfu /100 mL for highly treated effluent. Influent flow may not exceed maximum design flow specifi( in the permit for this installation. The pressure distribution system is provided with a flushing point at the end of each lateral, and it is recommended that each lateral be flus of accumulated solids at least once every 18 months. When a pressure test is performed it should be compared to the initial test when the system was installed to determine if orifice dogging has occurred and if orifice cleaning is required to maintain equal distribution within the dispersal cell. Observation pipes within the dispersal cell shall be checked for effluent ponding. Ponding levels shall be reported to the owner, and any le above 6 inches considered as an impending hydraulic failure requiring additional, more frequent monitoring. Contingency Plan If the septic tank or any of its components become defective the tank or component shall be repaired or replaced to keep the system in pro operating condition. If the dosing tank, pump, pump controls, alarm or related wiring becomes defective the defective component(s) shall be immediately repair or replaced with a component of the same or equal performance. If the mound component fails to accept wastewater or begins to discharge wastewater to the ground surface, it will be repaired or replaced its' present location by increasing basal area if toe leakage occurs or by removing biologically dogged absorption and dispersal media, and re piping, and replacing said components as deemed necessary to bring the system into proper operating condition. Tank inspections must include a visual inspection of the tank(s) to identify any missing or broken hardware, identify any cracks or leaks, measure the volume of combined sludge and scum and to check for any back up or ponding of effluent on the ground surface. The dispersal cell(s) shall be visually inspected to check the effluent levels in the observation pipes and to check for any ponding of effluent on the ground surface. The ponding of effluent on the ground surface may indicate a failing condition and requires the immediate notification of the local regulatory authority. When the combined accumulation of sludge and scum in any tank equals one -third (Y,) or more of the tank volume, the entire contents of the tank shall be removed by a Septage Servicing Operator and disposed of in accordance with chapter NR 113, Wisconsin Administrative Code. All other services, including but not limited to the servicing of effluent filters, mechanical or pressurized components, pretreatment units, and any servicing at intervals of 512 months, shall be performed by a certified POWTS Maintainer. A service report shall be provided to the local regulatory authority within 10 days of completion of any service event. GMW (4/01) Page 2 of 2 START UP AND OPERATION ' Fof new construction, prior to use of the POWTS check treatment tanks) for the presence of painting products or other chemicals that may impede the treatment process and /or damage the dispersal cell(s). If high concentrations are detected have the contents of the tank(s) removed by a septage servicing operator prior to use. System start up shall not occur when soil conditions are frozen at the infiltrative surface. During power outages pump tanks may fill above normal highwater levels. When power is restored the excess wastewater will be discharged to the dispersal cell(s) in one large dose, overloading the cell(s) and may result in the backup or surface discharge of effluent. To avoid this situation have the contents of the pump tank removed by a Septage Servicing Operator prior to restoring power to the effluent pump or contact a Plumber or POWTS Maintainer to assist in manually operating the pump controls to restore normal levels within the pump tank. Do not drive or park vehicles over tanks and dispersal cells. Do not drive or park over, or otherwise disturb or compact, the area within 15 feet down slope of any mound or at -grade soil absorption area. Reduction or elimination of the following from the wastewater stream may improve the performance and prolong the life of the POWTS: antibiotics; baby wipes; cigarette butts; condoms; cotton swabs; degreasers; dental floss; diapers; disinfectants; fat; foundation drain (sump pump) water; fruit and vegetable peelings; gasoline; grease; herbicides; meat scraps; medications; oil; painting products; pesticides; sanitary napkins; tampons; and water softener brine. ABANDONMENT When the POWTS fails and /or is permanently taken out of service the following steps shall be taken to insure that the system is properly and safely abandoned in compliance with chapter Comm 83.33, Wisconsin Administrative Code: • All piping to tanks and pits shall be disconnected and the abandoned pipe openings sealed. • The contents of all tanks and pits shall be removed and properly disposed of by a Septage Servicing Operator. • After pumping, all tanks and pits shall be excavated and removed or their covers removed and the void space filled with soil, gravel or another inert solid material. CONTINGENCY PLAN If the POWTS fails and cannot be repaired the following measures have been, or must be taken, to provide a code compliant replacement system: A suitable replacement area has been evaluated and may be utilized for the location of a replacement soil absorption system. The replacement area should be protected from disturbance and compaction and should not be infringed upon by required setbacks from existing and proposed structure, lot lines and wells. Failure to protect the replacement area will result in the need for a new soil and site evaluation to establish a suitable replacement area. I found no specific restrictions on septic systems. I note that stairways and lifts are not automatically restricted on any slope. I wonder if installing a pipe can disturb a slope more than constructing a stairway or a lift. If not, I see no reason why the pipe could not be installed. If installing a pipe is more of a disturbance, then I would look at the difficulty of restoring the excavation site and the problems likely to result from the excavation. I would not, however, dismiss the installation out of hand. I also note you indicate the subject slope is very steep. If it is very steep, how would a back hoe maneuver on the slope? I think it is also very important to be able to clearly justify why a long standing practice of the zoning office is now being changed. So if you are going to maintain this new position, you must be able to justify the change. Septic systems can be installed on slopes up to 25 % as per Comm 83. There are properties in Pierce County where holding tank installations are not feasible considering servicing requirements. Code compliant sanitary systems are an essential component of single family residences. Sanitary system review is required under the new county text regarding improvements to nonconforming structures. Staff inspect installation of pipes, tanks and drainfields to verify the system is installed per state standards and properly stabilized. Chapter 239 also states structures shall not be located on slopes facing the river on slopes greater that 12 %. As sanitary systems are accessory to single family residences, they are permitted uses so trees can be removed for their installation. We review the siting of sanitary systems to avoid too many trees from being removed and avoid exposing the building to the river. The proposed mound septic system is on 28% slopes facing the St. Croix River and is <100 feet from the westerly lot line. The plan received an Individual Site Design approval from the Dept. of Commerce on November 03, 2004. However, the property is located within the Lower St. Croix National Scenic Riverway and as such must comply with requirements contained in the St. Croix Riverway Zoning Ordinance 17.36 and with Dept. of Natural Resources Chapter NR 118 prior to issuance of a sanitary permit for installation of a Private On -site Wastewater Treatment System ( POWTS). A mound septic system is considered a structure (an appurtenance to a building) and is subject to the ordinary high water mark (OHWM) setback of 200 feet and may not be located on >12% slopes, per St. Croix Zoning Code 17.36(5)(d). Construction of a mound involves cutting trees, removing vegetation, as well as grading and filling activities. Zoning Code 17.36(5)(k)(1) prohibits removal of trees and shrubs on lands within 200' of the OHWM and 40' landward of the bluff line. A sanitary permit #453357 was issued on July 1" for a mound system, even though the site did not meet the <12% slope restriction or 100 foot bluffline setback in Zoning Code 17.36(5)c. However, the permitted mound site is outside the OHWM setbacks for both county and state regulations and is accessible from an existing road/driveway at the top of the bluffline. zoning regulations per Zoning You may apply for variances from the county g gu p 8 Code 17.36(6) and apply for a conditional use permit from the state per NR 118.09(2). You must also provide documentation that no DNR scenic easement exists that might prohibit the activities proposed on this lot. In reviewing the permit file, I found that the original Erosion & Sediment Control Plan acknowledgement form still needs owner signature, which must then be returned to our office. Please submit this form prior to any construction activity for installation of a POWTS. Adm. Code General This system shall be operated in accordance with Comm 82-84 Wis. Adm. Code, and shall maintained in accordance with its' component manuals [SBD- 10691 -P (N.01 /01) and SSWMP Publication 9.6 (01/81)] and local or state rules pertaining to system maintenance and maintenance reporting. No one should ever enter a septic or pump tank since dangerous gases may be present that could cause death. Septic and pump tank abandonment shall be in accordance with Comm 83.33, Wis. Adm. Code when the tanks are no longer used as POWTS components. Septic or pump tank manhole risers, access risers and covers should be inspected for water tightness and soundness. Access openings used for service and assessment shall be sealed watertight upon the completion of service. Any opening deemed unsound, defective, or subject to failure must be replaced. Exposed access openings greater than 84nches in diameter shall be secured by an effective locking device to prevent accidental or unauthorized entry into a tank or component. Septic Tank The septic tank shall be maintained by an individual certified to service septic tanks under s. 281.48, Stats. The contents of the septic tank shall be disposed of in accordance with NR 113, Wis. Adm. Code. The operating condition of the septic tank and outlet filter shall be assessed at least once every 3 years by inspection. The outlet filter shall be cleaned as necessary to ensure proper operation. The filter cartridge should riot be removed unless provisions are made to retain solids in the tank that may slough off the fitter when removed from its enclosure. If the filter is equipped with an alarm, the filter shall be serviced if the alarm is activated continuously. Intermittent filter alarms may indicate surge flows or an impending continuous alarm. The septic tank shall have its contents removed when the volume of studge and scum in the tank exceeds 1/3 the liquid volume of the tank. If the contents of the tank are not removed at the time of a triennial assessment, maintenance personnel shall advise the owner of when the next service needs to be performed to maintain less than maximum scum and sludge accumulation in the tank. The addition of biological or chemical additives to enhance septic tank performance is generally not required. However, if such products are used they shall be approved for septic tank use by the Department of Commerce. Pump Tank The pump (dosing) tank shall be inspected at least once every 3 years. All switches, alarms, and pumps shall be tested to verify proper operation. If an effluent filter is installed within the tank it shall be inspected and serviced as necessary. Mound and Pressure Distribution System No trees or shrubs should be planted on the mound. Plantings may be made around the mound's perimeter, and the mound shall be seeded and mulched as necessary to prevent erosion and to provide some protection from frost penetration. Traffic (other than for vegetative maintenance) on the mound is not recommended since soil compaction may hinder aeration of the infiltrative surface within the mound and snow compaction in the winter will promote frost penetration. Cold weather installations (October - February) dicWe that the mound be heavily mulched as protection from freezing. Influent quality into the mound system may not exceed 220 mg/L BOD 150 mg/L TSS, and 30 mg/L FOG for septic tank effluent or 30 mg/L BOD 30 mg/L TSS, 10 mg/L FOG, and 10 cfu/100 mL for highly treated effluent. Influent flow may not exceed maximum design flow specified in the permit for this installation. The pressure distribution system is provided with a flushing point at the end of each lateral, and it is recommended that each lateral be flushed of accumulated solids at least once every 18 months. When a pressure test is performed it should be compared to the initial test when the system was installed to determine if orifice clogging has occurred and if orifice cleaning is required to maintain equal distribution within the dispersal cell. Observation pipes within the dispersal cell shall be checked for effluent ponding. Ponding levels shall be reported to the owner, and any levels above 6 inches considered as an impending hydraulic failure requiring additional, more frequent monitoring. Continency Plan If the septic tank or any of its components become defective the tank or component shall be repaired or replaced to keep the system in proper operating condition. If the dosing tank, pump, pump controls, alarm or related wiring becomes defective the defective component(s) shall be immediately repaired or replaced with a component of the same or equal performance. If the mound component fails to accept wastewater or begins to discharge wastewater to the ground surface, it will be repaired or replaced in its' present location by increasing basal area if toe leakage occurs or by removing biologically clogged absorption and dispersal media, and related piping, and replacing said components as deemed necessary to bring the system into proper operating condition. Tank inspections must include a visual inspection of the tank(s) to identify any missing or broken hardware, identify any cracks or leaks, measure the volume of combined sludge and scum and to check for any back up or ponding of effluent on the ground surface. The dispersal cell(s) shall be visually inspected to check the effluent levels in the observation pipes and to check for any ponding of effluent on the ground surface. The ponding of effluent on the ground surface may indicate a failing condition and requires the immediate notification of the local regulatory authority. When the combined accumulation of sludge and scum in any tank equals one -third (Y or more of the tank volume, the entire contents of the tank shall be removed by a Septage Servicing Operator and disposed of in accordance with chapter NR 113, Wisconsin Administrative Code. All other services, including but not limited to the servicing of effluent filters, mechanical or pressurized components, pretreatment units, and any servicing at intervals of 512 months, shall be performed by a certified POWTS Maintainer. A service report shall be provided to the local regulatory authority within 10 days of completion of any service event. GMW (4/01) I Page 2 of 2 .START UP-AND OPERATION For now corkstruction, prior to use of the POWTS check treatment tank(s) for the presence of painting products or other chemicals that may impede the treatment process and /or damage the dispersal ceff(s). if high concentrations are detected have the contents of the tank(s) removed by a septage servicing operator prior to use. System start up shall not occur when soil conditions are frozen at the infiltrative surface. During power outages pump tanks may fill above normal highwater levels. When power is restored the excess wastewater will be discharged to the dispersal cell(s) in one large dose, overloading the cellls) and may result in the backup or surface discharge of effluent. To avoid this situation have the contents of the pump tank removed by a Septage Servicing Operator prior to restoring power to the effluent pump or contact a Plumber or POWTS Maintainer to assist in manually operating the pump controls to restore normal levels within the pump tank. Do not drive or park vehicles over tanks and dispersal cells. Do not drive or park over, or otherwise disturb or compact, the area within 15 feet down slope of any mound or at -grade soil absorption area. Reduction or elimination of the following from the wastewater stream may improve the performance and prolong the life of the POWTS: antibiotics; baby wipes; cigarette butts; condoms; cotton swabs; degreasers; dental floss; diapers; disinfectants; fat; foundation drain (sump pump) water; fruit and vegetable peelings; gasoline; grease; herbicides; meat scraps; medications; oil; painting products; pesticides; sanitary napkins; tampons; and water softener brine. ABANDONMENT When the POWTS fails and /or is permanently taken out of service the following steps shall be taken to insure that the system is properly and safely abandoned in compliance with chapter Comm 83.33, Wisconsin Administrative Code: • All piping to tanks and pits shall be disconnected and the abandoned pipe openings sealed. • The contents of all tanks and pits shall be removed and properly disposed of by a Septage Servicing Operator. • After pumping, all tanks and pits shall be excavated and removed or their covers removed and the void space filled with soil, gravel or another inert solid material. CONTINGENCY PLAN If the POWTS fails and cannot be repaired the following measures have been, or must be taken, to provide a code compliant replacement system: A suitable replacement area has been evaluated and may be utilized for the location of a replacement soil absorption system. The replacement area should be protected from disturbance and compaction and should not be infringed upon by required setbacks from existing and proposed structure, lot lines and wells. Failure to protect the replacement area will result in the need for a new soil and site evaluation to establish a suitable replacement area. Replacement systems must comply with the rules in effect at that time. ❑ A suitable replacement area is not available due to setback and /or soil limitations. Barring advances in POWTS technology a holding tank may be installed as a last resort to replace the failed POWTS. ❑ The site has not been evaluated to identify a suitable replacement area. Upon failure of the POWTS a soil and site evaluation must be performed to locate a suitable replacement area. If no replacement area is available a holding tank may be installed as a last resort to replace the failed POWTS. ❑ Mound and at -grade soil absorption systems may be reconstructed in place following removal of the biomat at the infiltrative surface. Reconstructions of such systems must comply with the rules in effect at that time. < <WARNING> > SEPTIC, PUMP AND OTHER TREATMENT TANKS MAY CONTAIN LETHAL GASSES AND /OR INSUFFICIENT OXYGEN. The proposed mound septic system is on 28% slopes facing the St. Croix River and is <100 feet from the westerly lot line. The plan received an Individual Site Design approval from the Dept. of Commerce on November 03, 2004. However, the property is located within the Lower St. Croix National Scenic Riverway and as such must comply with requirements contained in the St. Croix Riverway Zoning Ordinance 17.36 and with Dept. of Natural Resources Chapter NR 118 prior to issuance of a sanitary permit for installation of a Private On -site Wastewater Treatment System ( POWTS). A mound septic system is considered a structure (an appurtenance to a building) and is subject to the ordinary high water mark (OHWM) setback of 200 feet and may not be located on >12% slopes, per St. Croix Zoning Code 17.36(5)(d). Construction of a mound involves cutting trees, removing vegetation, as well as grading and filling activities. Zoning Code 17.36(5)(k)(1) prohibits removal of trees and shrubs on lands within 200' of the OHWM and 40' landward of the bluff line. A sanitary permit #453357 was issued on July I' for a mound system, even though the site did not meet the <12% slope restriction or 100 foot bluffline setback in Zoning Code 17.36(5)c. However, the permitted mound site is outside the OHWM setbacks for both county and state regulations and is accessible from an existing road/driveway at the top of the bluffline. You may apply for variances from the county zoning regulations per Zoning Code 17.36(6) and apply for a conditional use permit from the state per NR 118.09(2). You must also provide documentation that no DNR scenic easement exists that might prohibit the activities proposed on this lot. In reviewing the permit file, I found that the original Erosion & Sediment Control Plan acknowledgement form still needs owner signature, which must then be returned to our office. Please submit this form prior to any construction activity for installation of a POWTS. The sanitary permit will be valid until July 1, 2006. An existing lawful use of a struc- ture, building or accessory use which is not In conform- Sty with these provisions for the area of the Lower St. Croix River district which it occupies. ORDINARY HIGH WATERMARK. The point on the bank or shore up to which the presence and action of water is so continuous as to leave a distinct mark either by erosion, destruction of terrestial vegetation or other easily recognized characteristics. SUBSTANDARD LOT. A lot created and recorded prior to the effective date of this -section which does not meet the dimensional requirements of this section. TRANSMISSION SERVICES. Electric power, telephone and telegraph lines, cables or conduits, or pipelines that are used to transport large blocks of power, oil or gas, convey information or -transport materials between 2 points. In the case of electrical power, this will gen- erally apply to transmlesior, lines operating at 69,000 volts or more. For main pipeline crossings of gas, li- quids or solids in suspension, this means those used to transport such materials between 2 points. UNINCORPORATED AREA. An area that is not an incorpor- ated area as defined above. VISUALLY INCONSPICUOUS. Difficult to see or not readily noticeable in summer months as viewed from the river. WETLANDS. No structure, land, or wa- ter shall hereafter be used except in compliance with the general provisions of this chapter and with the following performance standards: (a) Prohibited Uses. Within the Lower St. Croix River District, all uses not listed as eondition;illy permitted or permitted uses shall be prohibited. (b) Density Standards for Unincorporat Areas 1. De- tached single family dwellings. No more than one dwelling per unit per acre of net project area may be allowed. There may be no more than one principal structure on each parcel. 2. Planned unit development. The number of proposed family dwellings permitted may not exceed by more than 56% the number of units allowed if the proposal. is based on sin- gle family dwelling units. 3. In newly created lots for detached, single family dwellings where municipal newer and water are not available, there shall be no more than one dwelling unit per acre of net project area. (c) Setbacks f-or Structures, Parking Facilities Pri vate Roads Public Str� eets and Tranemisslon Services. The following minimum setbacks from the ordinary high watermark -GI- ST. CROI.X COUNTY 10/01/86 and bluffline shall apply to all structures and private roads and parking areas, except those specified as exceptions herein: 1. For unincorporated areas, not less 200' from the ordinary high watermark and not less than 100' from the bluff line. 2. The Board of Adjustment for counties may grant a variance to the setback requirements in par. 1. above, for preexisting parcels only where the applicant has proven that a hardship exists. However, no variance shall be granted for a setback which results in a change in natural appearance of the shoreline, slope or bluff line as viewed from the river. It is the responsibility of the applicant to justify the need for such a reduced setback and display how the proposed structure will be visually inconspicuous from the river. The setback line shall be delineated on the application and staked out by the applicant. The local enforcement official shall certify the accuracy of setback lines prior to construction. 3. Justification for a reduced setback shall be based on limitations imposed by the physical characteristics of the property, not on the economic or other conditions of the applicant. 1 -7 . 3( 9 (V) (d) Placement of Structures Structures may not be located on slopes of greater than 12% facing the lower St. Croix River. Alterations of such slopes to overcome this limitation are not permitted. (This section emended on 6/16/58) (e) Heigh The height of any structure shall not exceed 35 feet. Height is determined by measuring from the lowest floor with exterior access or the lowest exposed foundation point (whichever is lower) to the highest point of the roof. (f) Lot Width 1. Unincorporated Areas Parcels or created for single family dwellings shall be no less than 200' in width at the building line. 2. Incorporated Areas. Lot width standards in effect on January 1, 1976 shall apply. (g) Lot Line Setback For unincorporated areas: All structures or portions of structures shall be located at least 25' from all property lines. i 62 ST. Lighting of dock or pier areas is permitted only if required by federal, State or local laws or for lighting municipal facilities in Incorporated areas only for health and safety reasons. (1) L1 -fts Lifts may be permitted provided the follow- Ing standards are met: 1. The primary function of a lift shall be for the transportation of persons up and down the bluff face. . 2. No lift shall be designed or utilized for the transport of boats or machinery up or down the bluff face. 3. All visible parts of lifts shall be painted or fin- ished in natural or earth tones and be visually inconspicu- ous. d. Lifts shall be located in the least visually conspicuous portion of any lot. 6. No construction i n shall begin gi on any lift until the applicant has provided local code enforcement officials with a plan showing all necessary construction data Including lo- cation of the lift, design, size, color, dimensions, and other pertinent information. The plan shall contain a cer- t1fication by a - registered - professional engineer or archi- tect that the lift components are securely anchored to prevent them ffom shifting and from causing accelerated ero- eion. i 6. The %car of any lift shall not exceed f x 6 feet. Care may have hand rails but no canopies or roots shall be allowed. Location of the transporting device or power source shall be visually inconspicuous. ()) Stairways Stairways may be permitted provided the following standards are met: 1. Landings may be permitted at a minimum vertical in- terval of 20' and shall not exceed 40 sq. ft. in area. 3. Stairways shall be painted or stained in earth or natural tones, or may be left unfinished If constructed of wood materials, and shall be visually inconspicuous. 4. Railings or hand raffle are permitted in conjunction with stairs and shall be painted or stained the same color as the stairways. S. Canopies or roofs# are not permitted on stairways or landings. 6. Stairways shall be located in the most visually in- conspicuous portion of any lot. Native vegetative plantings shall be used to screen the stairway from the river. T. Stairways shall be anchored and supported with pi- lings or footings. B. No construction shall begin until the applicant has submitted a plan for the stairway to the local enforcement official showing all necessary construction data including location, design, dimensions, color, construct -ion materials - and other pertinent information. The plan shall contain a certification by a registered professional engineer or-arch- itect that the stairway components are securely anchored to prevent them from shifting and from causing accelerated ero- sion. (k) Vegetative Management Provisions The vegetation shall be managed to maintain the essential char cter, qual- ity and density of existing growth. Compatible nat1ve..spe- cies of vegetation shall be used for replacement or new Plantings. Vegetation shall effectively screen lifts and stairs within 5 years, otherwise the lift and stairs shall be removed. 1. On lands within 200' of the ordinary high watermark and 40 landward of the bluff line, the following standards shall apply: a. Removal of trees and shrubs is not permitted. b. The above cutting provisions may not prevent: The removal of diseased, lnoect infested, rot- ten or damaged trees that present safety hazards. -b4- ST. CROIX COUNTY 10/01/86 ZONING CODE 17.36(6)(k)2. Pruning of trees or the cutting of shrubs, un- derstory vegetation bushes, grasses or from harvesting nonwood fiber crops. The construction of structures In compliance with the standards contained in §NR 118.06(3) (b) , Wis. Adm. Code. The practice of forestry on lands enrolled un- der the woodland tax law or forest crop law (Ch. 77, Wis. State.) as prescribed In a De- partment approved forest management plan which requires that vegetation be removed In a man- , ner that protects the scenic quality of the river. Modifications to commonly accepted ellvecultural methods shall be prescribed by the Department forester where necessary to protect the aesthetic values of the area. 2. Vegetative cutting elsewhere in the lower S *. Croix River district may be conducted only where It 16 accessory to a permitted or conditionally permitted activity. An application for a permit shall include a de- tailed plan and schedule of the earth moving activities. In- cluding a plan which shows how vegetative cover will be reestablished, at what:density and within what time frame. b. Approval of a plan shall be conditioned upon the following: No fi111ng or grading shall be allowed on elopes grtater than 12X, except for rock riprapping for shoreline protection. Diversions, silting basins, terraces and other methods to trap sediments shall be used where necessary. Fill shall be stabilized according to accepted en- gineering standards. -65- ST. Protection against erosion/ sedimentation and impairment of fish and aquatic lif shall be assured. 3. The drainage or filling of wetlands is prohibited. 4. Any local approval of a plan or permit shall not negate the requirements for obtaining State or federal per alts or approvals. (m) Color of Structures The exterior color of struc- tures including roofs, stairways, docks and lifts shall be natural wood and earth tones. (n) Substandard Lots Lots of record in the Register of Deeds office on January 1, 1976, or the date of enactment of an amendment to this section, which do not meet the re- quirements of SNR 118.06, Wis. Adm. Code, may be allowed as building sites provided that: 1. The lot 18 in separate ownership from abutting lands or, if lots in an existing subdivision are In common ownership, each of the lots has at least one acre of net project area. 2. The -proposed use conforme to the requirements of these rules and any underlying zoning or sanitary code re- quirements. (o) Nonconforming Uses Insofar as the standards in this section are not inconsistent with the provisions of 659.97(1), Wis. State., they shall apply to all nonnonform- ing uses. 1. The lawful use of :a building or premises existing at the time of adoption of a local ordinance based upon these regulations may be continued although such use does not conform with the provisions of this section. Such non - conformfng use may not be extended. 2. The total structural repairs or alterations in such a nonconforming building shall not during its life exceed 50% of the assessed value of the building unless permanently changed to a conforming use. 3. If such nonconforming use is discontinued for a period of 12 months, any future use of the building and premises %hall conform to this section. -66- ST. The amount of liquid wastes to be generated and the a quacy of the proposed disposal systems. 8. The compatibility of the project with uses on adjacent land. 9. The use of common corridors for locating proposed facilities withiU or .adjacent to existing public service facilities such as roads, bridges and transmission services. (e) Submission of Written Decision. The proposed mound septic system is on 28% slopes facing the St. Croix River and received an Individual Site Design approval from the Dept. of Commerce on November 03, 2004. However, the property is located within the Lower St. Croix National Scenic Riverway and as such must comply with both St. Croix Riverway Zoning Ordinance 17.36 and with Dept. of Natural Resources Chapter NR 118 prior to issuance of a sanitary permit for installation of a Private On -site Wastewater Treatment System (POWTS). According o NR 118.04 this parcel is in the rural residential management zone and the proposed g 4 (), p g p p mound is located in a "slope preservation zone" [definition NR 118.03(41)]. A mound septic system is considered a structure and is subject to the ordinary high water mark setback of 100 feet and cannot be located within a slope preservation zone (St. Croix Zoning Code 17.36(5)(d) prohibits structures on >12% slopes). Construction of a mound involves cutting trees, removing vegetation, as well as grading and filling activities. NR I I8.06(6)(b) 1.a. states that "Vegetation in ordinary high water mark setback areas, slope preservation zones, and 40 feet landward of blufflines shall be left undisturbed' unless a conditional use permit is obtained under NR 118.07(5)(b). You may apply for variances from the county zoning regulations per Zoning Code 17.36(6) and apply for a conditional use permit from the state per NR 118.09(2). You must also provide documentation that no DNR scenic easement exists that might prohibit the activities proposed on this lot. A permit #453357 was issued on 711!04 for mound construction, even though the site did not meet the <12% slope restriction or bluffline setback. The mound site is, however, outside the OHWM setback and close to an existing road/driveway at the top of the bluffline. In reviewing the permit file, I found that the owner has not yet signed the original Erosion & Sediment Control Plan acknowledgement form, which must be returned to our office. Please submit this form prior to any construction activity for installation of a POWTS.
