CROIX COUNTY GOVERNMENT CENTER, HUDSON WI November 16, 2006 Present: Committee: Supervisors Wally Habhegger, Lois Burn, Stan Krueger, Gene Ruetz Absent and Excused: Ron Troyer Staff: Dave Fodroczi, Alex Blackburn, Ellen Denzer, Brett Budrow, Gregg Timmerman, Don Gillen, Judy Olson Guests: Call to Order: Chair Habhegger called the meeting to order at 8:35 a.m. Adoption of Agenda: Motion by Ruetz to adopt the agenda. Motion 2 nd by Bum and carried. Action on Previous Minutes: Motion by Ruetz, 2 nd by Krueger to approve the minutes of September 27, 2006. Motion carried. Date of Next Meeting: November 28, 8:30 a.m. Land Use Ordinance Applications Municipal Plats — none Waiver Request Public Hearings to be Scheduled — Blackburn stated that one waiver request hearing for Charles and Rebecca Pace is scheduled for December 6 at 7:00 p.m. Rezoning Schedule - Bezek stated that one rezoning is scheduled for December 6. The hearing for the sign ordinance moratorium could be held the same evening. Committee members agreed to schedule the rezoning and waiver request at 7:00 p.m. and hold the moratorium hearing at 7:30 p.m. Planning and Zoning Business Bills and Invoices — The October 2006 Planning Revenue Report and October 2006 Planning Bills and Invoices were reviewed by the Committee and signed by Chair Habhegger. Personnel Update - Fodroczi reported the office manager position is still being negotiated by administration and the union Finance Committee approved the code enforcement position change from a zoning specialist to zoning technician and to increase the real property lister assistant position to full time. Four persons signed the posting for the vacant real property assistant position. After interview and testing, Beth Pabst was selected and will assume that position on December 4. Fodroczi stated that this will be a good transition. Office Remodeling - Fodroczi reported that phase one is complete. He met with Bill Rubin about converting office space in room 1259 to accommodate Economic Development Corporation. There were questions at the last Finance Committee meeting regarding other potential users of that space. This item was tabled until the December 14 meeting. That committee asked to see the space plans for Planning and Zoning and the alternative space plan for EDC in Room 1259. Whiting will send an email to all department heads letting them know the plans and to request other ideas for the space. Planning Report — Denzer reported on the completed Heartland project. The Town of Hammond received the final payment on the project. The State has given approval of the grant final report, so the project will be closed out. Town of Star Prairie held the second half of its vision workshop. There was lower turnout than the first, but those in attendance were very interested. Denzer stated that Anna Haines, the facilitator, did a very good job. Denzer will meet with them again this evening to finalize materials. She received an email from Town of Cylon indicating interest in working with us in developing new ordinances. Jim Janke will continue to help on short-term projects. He suggested creating a rural living guide which would be a county wide document. Several towns have given positive responses to such a publication. It is planned to design an insert for the document for individual town information. Denzer distributed the draft to Committee members and asked for input. This document will be tailored to St. Croix County. The idea of publishing a rural living guide was received well by the five towns in the Heartland Project, and staff thought it would be good for all towns. Denzer stated that this will also be a good PR tool for towns. Committee members were very supportive of producing this publication. Budrow reported that the Town of Baldwin is completing its land division ordinance and driveway ordinance that were needed because of the planning process. A final review has been done, and a Town attorney is now reviewing the document. It should be ready for public hearing in December or January. The major change is from two lots in five years to four lots in five years. No major subdivisions will be allowed. Fodroczi reported that we partnered with the West Central Regional Planning Commission in finalizing a comprehensive planning grant application. It was hand delivered on November 1. Copies were sent to three of the four villages. We should receive notification in January or February. An invitation was received from the Chair of Metropolitan Council to sit in on a meeting forum of all county officials of the counties surrounding the metropolitan area. Whiting or Malick have attended such meetings in the past. Committee members agreed on Fodroczi attending this meeting. He will then report to the Committee. We were also asked to participate in a St. Croix Valley transit study between the two states. The next meeting will be December 8. Rich Loney attended the last meeting. Land Information Report - Budrow distributed a report showing what was done by the Land Information Committee which includes Budrow, Fodroczi, County Surveyor, Real Property Lister, Register of Deeds, Land and Water Conservation staff and the Treasurer. He reported on what the Land Information Committee covers, including surveyor requirements, aperture card scanning project back to 1974, centerline mapping update for use in 911 and Emergency Communications, GIS software updated with new capabilities and GIS data fee schedule revisions. Budrow attended two Emergency Management and Communications Committee meetings about providing mapping for fire and ambulance districts. There were questions about which department covers the costs of making and printing maps. 22 town and fire district maps would be needed to cover all fire districts. The total cost would be approximately $600. The Committee agreed that the fire departments should pay for any maps they receive. Real Property Lister Update — Fodroczi reported that staff is continuing to enter plats and CSM's in its daily work. There is a slight backlog because of the staff vacancy. Staff is working with County Treasurer in preparing for tax processing which will be done in the Treasurer's Office this year. Real Property staff will continue to assist with that as needed this year. Code Administration Report - Fodroczi reported that notice was just received that the Wisconsin Supreme Court will not be accepting an appeal on the longstanding Bettendorf case, a decision on previous rezoning in the Town of Kinnickinnic. Property was zoned commercial in the 1980's and was conditioned upon ownership and was not transferable. It was appealed so the property could be sold with a business. The court upheld that the condition was inappropriate and invalidated the rezoning done by the County. The property is zoned ag- residential, so the commercial activities are in violation. Fodroczi also stated that a fee structure must be added to the livestock siting ordinance. Bob Bezek and Jenny Shillcox will work with Land and Water to get some estimates and will have proposed amendments later this month. Land Use Ordinance Amendments - Fodroczi reported that, in order to do complete revisions to the sign regulations, the Committee had agreed to a temporary moratorium on permanent signs to allow time to revise the ordinance. A public hearing was planned for November 29. The proposed moratorium ordinance was submitted to Corporation Counsel for review and comments. Because of Greg Timmerman's concerns, it was decided to delay the public hearing. Staff has now addressed those concerns which were also sent to Committee members. To schedule a public hearing on December 6, hearing notices must be sent by November 17. Fodroczi distributed copies of the reworked ordinance. After researching the last four years of sign applications received, Jenny Shillcox found that more applications were received this year than in the previous three years with most in the western urban towns and along the new transportation corridors of Highways 35, 64 and 65. Fodroczi explained the issues with the existing ordinance and lack of reference to standards for on- premise signs. Having a moratorium would prevent a rush of applications under the existing ordinance. Considering the holidays, no County Board meeting in February, and time needed for community input and public hearings, Fodroczi stated that six months would be needed to complete the revision process. Timmerman reviewed his concerns about doing a moratorium. There has been knowledge of shortcomings of the sign ordinance for two years. He also noted that wintertime is not a big time for placing signs. He does not feel there is justification for having a six -month moratorium. Denzer stated that the Towns of Somerset, St. Joseph and Troy have each expressed concerns f about sign regulations. She also stated that the revision process will take a full six months. Motion by Habhegger, 2 nd by Burri to proceed to public hearing with the revised draft of the moratorium ordinance, for a period not to exceed six months, subject to Corporation Counsel review of the revised draft. Motion carried with Krueger voting against. The hearing will be scheduled for December 6 with the rezoning and waiver request at 7:00 p.m. and the moratorium ordinance at 7:30 p.m. Announcements and Correspondence: Fodroczi reported that DNR has updated NR135, the non - metallic mining administrative rules, and takes effect December 1. We will have six months to make corresponding revisions to our non - metallic ordinance, including the DNR portion of the fee schedule. Bob Bezek represented us at the Towns Association the previous week. Mary Murphy gave a presentation regarding her assignment on setback changes. There was little discussion. She also sent letters to all town chairs. That item was on the Town of Hudson meeting agenda. Habhegger received correspondence from David Gray in reference to the setback requirement changes.
