CROIX COUNTY GOVERNMENT CENTER, HUDSON, WI December 6, 2006 Supervisors: Wally Habhegger, Stan Krueger and Gene Ruetz were present. Lois Burri and Ron Troyer were absent and excused. Staff. Alex Blackburn, Bob Bezek and Dave Fodroczi. Guests: Vicky Wine, Charles Pace, Joe Granberg, Greg Gillis, Al Penfield, Cheryl Fritsche, Grant Fritsche, Joe Hurtgen, Doug Rivard, Steve Lewis and Loren Smeester. Chairperson Habhegger called the meeting to order at 7:00 p.m. The next meeting for this committee will be December 12, 2006 at the Government Center in Hudson. Motion by Ruetz, second by Krueger to adopt the agenda. Motion carried. The public hearing notice was acknowledged for the record. REZONING APPLICANT: Dan and Vicky Wine. LOCATION: SE' /4 of NE' /4 Section 2, T29N, RI 6W, Town of Baldwin, ADDRESS: 1160 260` Street, Glenwood City REQUEST: pursuant to Section 17.72 of the St. Croix County Zoning Ordinance to rezone 40 acres of land from Agricultural to Agricultural- Residential. Bezek presented the staff report. He indicated that the staff just received the soil report from the Department of Commerce that verified that the site would support a private on -site wastewater treatment system (POWTS). Habhegger opened the public hearing at 7:10 p.m. No one spoke in favor or opposed to the application. Habhegger closed the public hearing at 7:12 p.m. Bezek recommended rezoning the property from Agricultural to Agricultural II with the condition that prior to the issuance of a building permit or occupancy permit for a use on the rezoned parcel, the landowner shall cause a certified survey map to be made of the property and filed with the Register of Deeds. Request is to create a lot without the required 66 feet of road frontage. Blackburn presented the staff report. The applicant proposes to create three lots from an existing lot, but one of the lots would require access by an easement without the required 66 feet of road frontage. Staff recommended denial of the waiver, because it could set a precedent for other properties, and the limitations could be overcome by constructing a road. 1 ~ Habhegger opened the public hearing at 7:20 p.m. Charles Pace and surveyor Joe Granberg presented the application and summarized the request. They emphasized the physical features of the site, including Bushnell Lake and surrounding topography that limited access options to the site. Greg Gillis, representing the Plan Commission and Town Board of the Town of Hammond, indicated that the Town had not received or reviewed the application. He objected to the lack of Town input. Al Penfield, adjoining landowner with an access easement over proposed Lot 6, expressed concerns about the impact on his access and asked about the driveway locations for Lots 6 and 7. Cheryl and Grant Fritsche, adjoining landowners, expressed concerns about the soils on the site and the related siting of septic systems. Charles Pace made a few additional comments in response to some of the hearing comments from other parties. Habhegger closed the public hearing at 7:45 p.m. Motion by Krueger, second by Ruetz to table the application to allow for review and comment by the Town of Hammond. Motion carried. ORDINANCE AMENDMENT Amendment to the St. Croix County Land Use Regulations Chapter 17 Zoning, to implement a six month moratorium on permanent signs to allow time to study and adopt new standards. Fodroczi summarized the proposed temporary moratorium on permanent signs. He explained that requests for new signs had increased significantly during the previous three years and that existing ordinance procedures and standards are out of date. Provisions for on- premise signs are particularly unclear and led to recent litigation. The six month moratorium would allow the County a reasonable time to research and develop updated sign regulations. After Fodroczi completed his presentation, Chairperson Habhegger allowed time for questions before opening the public hearing. Fodroczi then answered several questions regarding individual signs, previous County moratoria, on- premise signs, moratorium timeframe, and the process to develop new sign regulations. Habhegger opened the public hearing at 8:35 p.m. Those in attendance made the following comments: Doug Rivard, Star Prairie Town Chairman, supports new sign regulations based on recent experiences with a business in his town. He commented that every situation is different, and we should be sure to address realtor signs and electronic signs. Joe Hurtgen, Baldwin Town Chairman and County Board Supervisor, emphasized that new regulations should strengthen placement and maintenance of rural address signs. Loren Smeester, Silver Bison Ranch, expressed his concern about available signage for his business. He said the moratorium should be held to six months and that he would like to be involved in the process. 2 r' Habhegger closed the hearing and adjourned the meeting at 8:50 p.m. He thanked all of the public in attendance for their participation in the hearing.
