Staff recommendation This application is currently tabled. The 600 feet of road that

goes between lots 9 and 11 and continues off the plat to the
west was never constructed. The applicants and town were not
able to reach an agreement on who would construct the road.
Therefore staff recommends denial.
Comments;
Motion by Krueger, 2 by Burri to deny approval. Motion carried unanimously.

County Surveyor's Dept action Needed
Staff recommendation This application is currently tabled. The old ordinance required
roads in a subdivision to be dedicated to the town. The
applicants were not able to get this done. Therefore staff
recommends denial and release financial guarantees.
Comments:
Roger Humphrey requested tabling the plat at this time. He suggested that he meet with the owner
and the town and bring results to the January 23 meeting. Committee discussed releasing or
holding the financial guarantees. Motion by Krueger to bring this item to the January 23 P & Z
meeting to allow time for Land and Water to determine if there are any erosion control problems so
we can release financial guarantees and allow the consultant time to work out the road problems
with the Town of Cady. Motion 2nd by Burn and carried unanimously.

20 percent slope disturbance The PZC stated no objections to the June 28 20 percent slope
disturbance request
Staff recommendation Conditional approval. Due to the frozen ground conditions,
staff recommends that conditions to be met by May 1, 2007 and
plat to be recorded 30 days after conditions being met.
Conditions: 1. Town approval is needed.
2. Engineering plans must be stamped by a professional
engineer.
3. Submit original letters of credit and change them to be
auto — renewable.
4. Final approval needed from the County Surveyor's
office.
5. Revise soil test for lot 27 so that it does not conflict with
drainage pond.
6. Fence all soil tested areas. Staff suggest using the
approximate 6 foot high "T" posts and then placing rope
or fencing around the posts.
7. Provide 3 benchmarks.
8. Provide high water elevations for drainage easements and
all water features.
Motion by Krueger to approve with conditions listed. Motion 2 nd by Ruetz and carried
unanimously.

Blackburn reviewed the summary of land division submittals for November and December
currently being processed. Roger Humphrey asked that the Northeast Angle plat recording date be
extended until May because conditions cannot be met during winter months with frozen ground.
Motion by Burn', 2 nd by Krueger that conditions be met by May 1 with recording done within 30
days after. Motion carried unanimously. Two Dayspring plats that were submitted under the old
ordinance and approved cannot meet the recording deadline. These will be addressed at the
February 26 meeting.
Planning and Zoning Business —
Bills, Invoices and Revenue Report — The Zoning bills and revenue report for November 2006
were reviewed by Committee members and signed by Chair Habhegger. It was noted that revenue
is less than budgeted for the year with expenses also being lower.
Municipal Plats — none
Code Administration Report — Fodroczi reported that Bob Bezek's last day will be January 3.
Kevin Grabau will act as interim Code Administrator to cover zoning and code enforcement. No
rezoning applications were received in December.
Lake Mallalieu Dam - Fodroczi stated that Chuck Whiting discussed this issue with the Finance
Committee. Fodroczi received some materials from the City of Hudson including a joint resolution
from a 1967 agreement with Northern States Power Company and other correspondence from NSP
in addition to the deed. The resolution specifies the percentages of joint ownership of the dam and
percentage of the share of maintenance: St. Croix County, 50 %, City of Hudson $20 %, Village of
North Hudson $20 %, Town of Hudson 10 %. It also states that the City of Hudson handle
maintenance of the dam. Krueger stated that a more detailed bill is needed before the County can
pay. Habhegger stated that only the $5,000 budgeted for 2005 and the $5,000 budgeted for 2006
should be paid since we were not consulted prior to the cost being incurred. Ruetz stated that the
County should authorize any work being done on the dam above normal maintenance. Krueger
stated that a joint meeting with the City, Village, Town and County is needed.
Personnel Update — Fodroczi reported that ads are out for a new Code Administrator and
applications are being accepted through January 10th. The Zoning Technician selection will not be
done until the new Code Administrator is in place. Chuck Whiting has met with union
representatives regarding the Office Manager position. He will organize a meeting the following
week with Fodroczi and Compensation Specialist Scott Guinter. The job description may need to
be changed. Whiting will bring that to the Finance Committee on January 4.
Suite Remodeling — Finance Committee did not address this item at its last meeting, but will do so
on January 4.
Land Use Ordinance Amendments — The sign moratorium was approved by County Board to
take effect January 1. The amendment process will begin as soon as new staff is in place. This
will be discussed further with the Committee in late January or February. Staff will start working
on this in early January.
Comments on NR 820 High Capacity Wells - Bob Heise explained and discussed new rules
proposed by DNR on groundwater quantity. He attended a public hearing on this in mid -
December. He emphasized that direct withdrawal of groundwater has affects on surface waters.
Other areas in the state with high population growth have seen groundwater depletion. Heise

presented a draft letter with public comments as part of the public hearing process for the proposed
NR 820 Groundwater Quality Protection. In looking at this area and growth in next 20 years there
is concern about prevention of groundwater depletion and making this area a groundwater
management area. The letter requests that the DNR take required action to include the Tri- County
region (Pierce, Polk and St. Croix Counties) in the Administrative Rule NR 820.20 as a
Groundwater Management Area. The concern is with wells that withdraw more than 100,000
gallons of water per day including irrigation wells, large dairy operations, golf courses, municipal
wells. Heise would like to see baselines established and preventative measures put in place to help
preserve natural water resources in the County. Ruetz stated that more information is needed in
this area. Land and Water Committee will meet and discuss this issue on January 2. One change
was requested: Wally Habhegger to be changed to Wallace Habhegger. Motion by Krueger to
accept the letter with the change and send. Motion 2nd by Burri and carried unanimously
