Agriculture to Ag /Residential. Location: The NW '/d of the SW '/4, Section 15,
T31 N -R1 7W, Town of Stanton.
2) Blair C. Dollery to rezone approximately 6.5 +/- acres of land from Agriculture
to Ag /Residential. Location: Part of the NE' /4 of the NW '/4, Section 1, T31 N-
R 19W, Town of Somerset.
3) Larry W. Johnson rezone approximately 33 +/- acres of land from Agriculture
to Ag /Residential. Location: The NE' /4 of the NE'. /4 and the SE'/ of the NE
'/4, all in Section 10, T28N -R1 9W, Town of Troy.

PLANNING AND ZONING COMMITTEE
ST. CROIX COUNTY GOVERNMENT CENTER, HUDSON, WI
January 5, 2006
Supervisors: Brian Hurtgen, Wally Habhegger, Stan Krueger and Lois Burn were present. Jan Zoerb were
absent and excused. Staff. Bob Bezek, and Debbie Murphy.
Vice Chair Burri called the meeting to order at 7:00 p.m. The next meeting for this committee will be
January 10, 2006 at the Government Center in Hudson. Motion by Krueger, second by Hurtgen and carried
to adopt the agenda.
New Business: Vice Chair Burri opened the hearing. The public hearing notice was read into the record as
follows:
PUBLIC HEARING NOTICE
The St. Croix County Planning and Zoning Committee will be conducting; a public hearing on Thursday,
January 5, 2006, at 7:00 p.m. at the St. Croix County Government Center, 1101 Carmichael Road, Hudson,
Wisconsin, to consider the following petition(s):
1) Willis D. Savage to rezone approximately 1.5 +/- acres of land from Agriculture to
Ag/Residential. Location: The NW' /4 ofthe SW 1 /4, Section 15, T31N -R17W, Town of Stanton.
2) Blair C. Dollery to rezone approximately 6.5 +/- acres of land from Agriculture to
Ag/Residential. Location: Part of the NE' /4 ofthe NW V4, Section 1, T31N -R19W, Town of
Somerset.
3) Larry W. Johnson rezone approximately 33 +/- acres of land from Agriculture to Ag/Residential.
Location: The NE 1 /4 of the NE 1 /a and the SE %4 of the NE 1 /4, all in Section 10, T28N -R19W,
Town of Troy.
Information on this petition may be obtained from the office of the Planning and Zoning Department, Hudson,
St. Croix County, Wisconsin. In the case of cancellation of this hearing, such notice will be announced on
WIXK and WEVR Radio Stations, or call the Planning and Zoning Department at 715- 386 -4680 before 5:00
p.m.

Willis D. Savage: Bezek explained that the request is to rezone approximately 1.5 +/- acres of land from Ag to
Ag/Residential. The applicant wishes to sell this property to an adjoining; landowner, Irvin Posey, to add onto an
existing Ag/Residential parcel. The Posey's currently own 0.52 acres zoned Ag- residential and are looking to
make a conforming 2 acre lot by adding on 1.48 acres. They reached an agreement to purchase adjacent
property from Mr. Savage which is currently zoned Agricultural. In order to create a legal CSM, the 1.48
acres must be rezoned.
Bezek went over the request through a PowerPoint presentation, and going over the maps with the committee.
The Town of Stanton has recommended approval of the request.
Irvin Posey, applicant, reiterated that he is asking for this rezoning to be able to add this 1.48 acres onto his
existing property, as he currently owns approximately %2 acre of land.

There was no opposition to the request.
Hearing closed. Discussion held. Motion by Habhegger, second by Krueger and carried to recommend
approval of the request and forward onto County Board based on the following findings:
1. The proposed use can comply with standards in the Land Use, Subdivision and Sanitary
ordinances.
2. The parcel is in the rural planning area and is an appropriate use.
3. The proposed use is consistent with minimum lot size requirements in the rural planning area.
4. The request is consistent with the surrounding neighborhood, countryside or terrain.
5. The proposed use has minimal potential to adversely impact storrnwater management. The proposed
use has minimal potential to adversely impact water resources with sedimentation resulting from
erosion.
6. The proposed use has minimal potential to adversely impact shoreland areas or wetlands and closed
depressions located in shoreland areas.
7. The proposed use is generally consistent or not in conflict with the St. Croix County Natural Resources
Management Plan.
8. The Town of Somerset has reviewed the rezoning and recommends approval after considering §91.77 in
making their recommendation.
Request will be forwarded to County Board.
Blair C. Dollery: Bezek explained that the request is to rezone approximately 6.5 +/- acres of land from
Agriculture to Ag/Residential. The Dollery's own approximately 80 acres in the Town of Eau Galle that is
presently zoned Agricultural. They are requesting to rezone the two 3 acre parcels for development by their
children. Bezek presented the information to the committee through a PowerPoint presentation, going over
the maps, and pointing out that the larger parcel on the property will remain in Agriculture. This property is
not in Farmland Preservation. The Town of Somerset recommends approval of the request, stating that they
have considered State Statute 91.77 in their decision. Staff recommends approval of the request.
Mike Erickson, Northland Surveying, spoke on behalf of the Dollerys. They will be deeding the 2 lots over
to their children. Blair Dollery spoke, stating that their children want to build homes on this property.
Hearing closed. Discussion held. Motion by Habhegger, second by Krueger and carried to recommend
approval of the request and forward onto County Board based on the :following findings:
1. The parcel is in the rural planning area and is an appropriate use.

8. The proposed use is consistent with policies to preserve woodlands, prairie remnants, unique open
spaces, or environmental corridors.
9. The proposed use is generally consistent or not in conflict with the St. Croix County Natural Resources
Management Plan.

10. The proposed use can comply with standards in the Zoning, Subdivision and Sanitary ordinances.
11. The proposed use is consistent with the spirit or intent of County ordinances (zoning, land division,
non - metallic mining, sanitary, etc.).
12. The Town of Somerset has reviewed the rezoning and recommends approval after considering §91.77 in
making their recommendation.
Request will be forwarded to County Board.
Larry W. Johnson: Bezek explained that the request is to rezone approximately 33 +/- acres of land from
Agriculture to Ag/Residential. The applicant owns approximately 33 -acres zoned Agriculture, and currently live
on a 1.5 -acre parcel abutting the larger parcel on the NE side of the property. The request is to rezone the 33
acres to Ag/Residential and the 1.5 acres to Ag/Residential, so they may enlarge the 1.5 acres to 3.8 acres and
create a new 28 acre lot for a son. They plan to leave the remaining 26- acres in CRP. Bezek went over the
request with the committee through a PowerPoint presentation, pointing out the plans for the property. The
Town of Troy has not sent a recommendation to the county, yet. The staff does not see any problems with this
request.
Larry Murphy, agent Johnson, stated that Mr. Johnson is at the Town of Troy Planning Commission this
evening and will be at the Town Board next week.
Hearing closed. Discussion held. Motion by Habhegger, second by Krueger and carried to table the request
until the Town of Troy forwards a recommendation to the County. This will be placed on the next agenda
after response from the Town.
