1) Gloria Vorwald Revocable Trust/ Jeanne Williams, Trustee requests a variance to the St. Croix
County Subdivision Ordinance, Section 18.16(D)(7)(e) The variance is to exceed the 1000 -foot
maximum road length requirement for a dead -end road.

PLANNING AND ZONING COMMITTEE
ST. CROIX COUNTY AGRICULTURAL CENTER, BALDWIN, WI
May 17, 2006
Supervisors: Wally Habhegger, Ron Troyer, and Lois Burn were present. Stan Krueger and Gene Ruetz were
absent and excused. Staff: Bob Bezek, Alex Blackburn and Debbie Murphy.
Chairman Habhegger called the meeting to order at 7:00 p.m. The next meeting for this committee will be
May 23, 2006 at the Government Center in Hudson. Troyer/ Burn moved to adopt the agenda, carried.

PUBLIC HEARING NOTICE
The St. Croix County Planning and Zoning Committee will be conducting a public hearing on Wednesday, May
17, 2006, at 7:00 p.m. at the St. Croix County Government Center, 1101 Carmichael Road, Hudson, Wisconsin,
to consider the following petition(s):
1) Gloria Vorwald Revocable Trust/ Jeanne Williams, Trustee requests a variance to the St. Croix County
Subdivision Ordinance, Section 18.16(D)(7)(e) The variance is to exceed the 1000 -foot maximum road
length requirement for a dead -end road.

Information on this petition may be obtained from the office of the Planning and Zoning Department, Hudson,
St. Croix County, Wisconsin. In the case of cancellation of this hearing, such notice will be announced on
WIXK and WEVR Radio Stations, or call the Planning and Zoning Department at 715- 386 -4680 before 5:00
p.m.

Gloria Vorwald Revocable Trust/Jeanne Williams, Trustee: Request is for a variance to exceed the
1000 -foot maximum road length requirement for a dead -end road.
Bezek read the notice and explained that this request is under the old subdivision ordinance, so a variance is
needed, rather than a waiver. Bezek and Blackburn went over the request through a PowerPoint presentation,
going over the maps of the site, and explaining the access issues. The applicant wishes to extend the road from
1498 feet to approximately 1900 feet to allow for land to be divided between siblings, and serve tow lots. The
road is a private road, built to the required standards, but needs to exceed 1,000 feet to serve the proposed lots.
The Town of Kinnickinnic has no objections to the request.
Jeanne Williams, trustee, reiterated that this property is being divided between siblings, and that her brother still
plans to farm most of the property. She went over the map with the committee, pointing out where the lots

would be. Doug Zaher, S &N Land Surveying, explained that Lot 3 would provide an access t the property to
the west.
There was no opposition to the request.
Hearing closed. Discussion held. Motion by Troyer, second by Burri to approve the variance request to exceed
the 1000 foot road requirement based on the following finding:
1. The variance request does not create any apparent negative impacts or atypical land use.
Motion carried on a 3 -0 vote.
Kerry Licht: Request is to rezone approximately 20 +/- acres of land from Agriculture to Ag/Residential.
Bezek went over the request through a PowerPoint presentation, going over the maps of the site. The applicant
is requesting this rezoning in order to create four 5 -acre parcels. The staff supports the request. The Town of
Pleasant Valley has submitted a letter approving the request, stating that they have considered WSS 91.77.
Hearing opened. Kerry Licht added that she plans to give each child a building site. The land perks for a
mound septic system.
There was no opposition.
Hearing closed, discussion held. Motion by Habhegger, second by Burri to recommend approval of the
request to County Board based on the following findings:
1. The parcel is in the rural planning area and is an appropriate use.
2. The proposed use is consistent with minimum lot size requirements in the rural planning area.
3. The request is consistent with the surrounding neighborhood, countryside or terrain.
4. The proposed use has minimal potential to adversely impact stormwater management.
5. The proposed use has minimal potential to adversely impact water resources with sedimentation resulting
from erosion.
6. The proposed use has minimal potential to adversely impact shoreland areas or wetlands and closed
depressions located in shoreland areas.
7. The proposed use has minimal potential to adversely impact closed depressions or wetlands.
8. The proposed use is consistent with restricting development on slopes in excess of 20 %.
9. The proposed use is consistent with policies to preserve woodlands, prairie remnants, unique open
spaces, or environmental corridors.
10. The proposed use is generally consistent or not in conflict with the St. Croix County Natural Resources
Management Plan.
11. The Town of Pleasant Valley has reviewed the rezoning and recommends approval after considering §91.77
in making their recommendation.
12. The request is consistent with the spirit and intent of applicable County Land Use Ordinances.
With the following condition:
1. Prior to the issuance of a building permit or occupancy permit for a use on the rezoned parcel, the
landowner shall cause a certified survey map to be made of the property and filed with the register of
deeds.
Motion carried on a unanimous vote. Staff will forward the request onto County Board.
Basel Farms: Request is to rezone approximately 40 +/- acres of land from Agriculture to Ag/Residential.

Bezek went over the request through a PowerPoint presentation, going over the maps of the site and the staff
report. The applicant plans to sell this property for residential development. The staff supports the request.
The Town of St. Joseph has recommended approval of the request, stating that they have considered WSS 91.77
in their decision. .
Hearing opened. Mike Erickson, Northland Land Surveying, agent for Basels, agrees with the staff report.
Gloria Basel, owner., reiterated that they plan to divide up the property and sell it.
There was no opposition.
Hearing closed and discussion held by the committee. Motion by Habhegger, second by Troyer to
recommend approval of the request to County Board based on the following findings:
1. The parcel is in the rural planning area and is an appropriate use.
2. The proposed use is consistent with minimum lot size requirements in the rural planning area.
3. The request is consistent with the surrounding neighborhood, countryside or terrain.
4. The proposed use has a potential to adversely impact stormwater management that can be easily
managed.
5. The proposed use has a potential to adversely impact water resources with sedimentation resulting from

depressions located in shoreland areas.
7. The proposed use has the potential to adversely impact closed depressions or wetlands but can be easily
managed.
8. The proposed use is consistent with restricting development on slopes in excess of 20 %.
9. The proposed use is consistent with policies to preserve woodlands, prairie remnants, unique open
spaces, or environmental corridors.
10. The proposed use is generally consistent or not in conflict with the St. Croix County Natural Resources

Mathy Construction: Request is to rezone approximately 40 +/- acres of land from Ag -II to Agriculture and
40 -acres of land from Agriculture to Ag -II.
Bezek went over the request through a PowerPoint presentation, going over the maps of the site and the staff
report. This request is to correct an error in zoning. One of the 40's is zoned agricultural and 2 are zoned Ag-
Il. They wish to mine in the parcel zoned agricultural so it needs to be rezoned. Due to concerns by the
Town they agreed to rezone one of the parcels zoned Ag -1I back to agricultural. They currently mine on the
site and have appropriate County permits. The staff recommends approval of this request.
Hearing Candy Anderson, representing Mathy, reviewed the maps of the mine with the committee. She
added that the land will go to the DNR when mining is completed. The Town of Stanton approved the request
on March 9 after considering §91.77 in their decision.
There was no opposition.
Hearing closed, discussion held. Motion by Habhegger, second by Burri to recommend approval of the
request to County Board based on the following findings:

1. The parcel is in the rural planning area and is an appropriate use
2. The proposed non - residential use is consistent with the rural character of the area and is not otherwise
essential to the area.
3. The request is consistent with the surrounding neighborhood, countryside or terrain.
4. The proposed use provides a buffer for residential development from nearby agricultural uses or non-
metallic mining.
5. The proposed use has minimal potential to adversely impact stormwater management and can be easily
managed.
6. The proposed use has minimal potential to adversely impact water resources with sedimentation resulting
from erosion.
7. The proposed use has minimal potential to adversely impact shoreland areas or wetlands and closed
depressions located in shoreland areas.
8. The proposed use is consistent with restricting development on slopes in excess of 20

13. The request is consistent with the spirit and intent of applicable County Land Use Ordinances.
14, The Town of Stanton supports the request and has considered Wisconsin Statutes 91.77 in making their
decision.
Motion carried on a unanimous vote. Staff will forward to County Board.
Code Administrator's Update: There was a short discussion held on the issue of when a permit is needed
for filling and grading and how to handle this. Right now, a special exception permit from the Board of
Adjustment is needed. Staff would like to see this changed to a Land Use Permit for some cases. There have
been some problems brought to the staff's attention in the Water's Edge subdivision in Richmond. Bezek
will check into this and report back to the committee.
