CROIX COUNTY GOVERNMENT CENTER, HUDSON WI September 26, 2006 Present: Committee: Supervisors Lois Burri, Wally Habhegger, Ron Troyer, Gene Ruetz Absent and Excused: Stan Krueger, Staff: Dave Fodroczi, Bob Bezek, Alex Blackburn, Judy Olson Guests: Jon Sonnentag, Troy Nemmers Call to Order: Chair Habhegger called the meeting to order at 8:30 a.m. Adoption of Agenda: Motion by Ruetz, 2 by Troyer. Motion carried. Date of Next Meeting: September 27, 7 p.m. Hudson Action on Previous Minutes: Motion by Burri, 2nd by Ruetz to approve the August 2 and August 22, 2006 minutes. Motion carried. Hearings: Minor Subdivisions — Major Subdivisions — Preliminary Plat(s) and Town — Construction waiver request for The Glens of Willow River — The Glens of Willow River- Waiver for road construction request Owner(s) Basel Farms Inc. Agent(s) Jim Rusch, Jon Sonnentag and Larry Thompson Surveyor Doug Zahler Location Section 18 and 19, Town of Richmond. Number of lots 70 lots totaling 158.9 acres. Bids and financial guarantees Bids have been submitted; financial guarantees will be required for road construction and erosion control. Township action The town has approved the map. Extraterritorial action NA DOT action NA LWCD action The applicants submitted covenants and restrictions that contain a revised conservation agreement on September 19, 2006. These covenants were i:orwarded to Corp Counsel for review and comment on September 20, 2006. DNR action The DNR has issued a chapter 30 permit for cleaning up the debris along the river. Highway Department action The Highway Department has approved the road plans. County Surveyor's Dept action NA 20 percent slope disturbance Approved on May 24, 2005. Staff recommendation Pending receipt of financial guarantees. Conditions; 1. Submit financial guarantees. 2. The conservation easement portion of the covenants and restrictions will need review approval form Corp Counsel. 3. The conservation easement must be recorded against the property. This agreement must then be transferred to the lots as the lots are sold. 4. Final plat may be submitted. However, staff will need the above items resolved before bringing this application to the Planning and Zoning Committee. Blackburn presented the staff report and explained map of proposed plat. Motion by Troyer, 2 nd by Burri to approve with conditions 2, 3, & 4. Motion carried. Blackburn reviewed staff report and details of the map. Motion by Burri to approve with conditions stated. Motion 2 nd by Troyer and carried. 2 Conservation Design Developments — none Summary of plats received that are currently being reviewed by staff — This summary was reviewed and discussed by the committee. Discussion of Plats and CSM's that are currently tabled - Blackburn reviewed the list with committee. Responses were recently received from two developers having tabled plats. Committee members discussed having plats that were submitted more than six months ago be cancelled. Bezek will draft a letter to developers letting them know that tabled applications more than six months old will be void. Jon Sonnentag stated that, because of various issues on plats, six months is not a long enough time. Habhegger suggested one year. Planning and Zoning Business - Bills, Invoices and Revenue Report — Committee members reviewed the bills and revenue report for August 2006 which were then signed by Chair Habhegger. Fodroczi reported that $5,000 for maintenance of the Lake Mallalieu dam has been included in the Planning & Zoning budget for many years. City of Hudson, Town of Hudson, Village of North Hudson and St. Croix County have shared ownership of the dam since 1968. The repairs are done by City of Hudson staff. This year we received a bill for $7,400. This bill reflects some additional repair costs from 2004 and 2005. Committee members discussed having a formal agreement with the City and other owners that would give the County some decision making on future repairs. Fodroczi will talk with the City and report more at the next committee meeting. Municipal Plats — none Land Use Ordinance Amendments — Fodroczi stated that a formal notice was received from the City of River Falls that the City has put a six -month moratorium on all subdivision activities in a portion of the extra territorial area that took effect September 21. No applications will be accepted for subdivisions in that area. The cooperative agreement with the Town of Troy should be done within this six months. Applicants will be advised of this moratorium when we receive applications for subdivisions in that area. Bezek presented the proposed Amendments to Chapter 17 Zoning to Comply with Wisconsin Administrative Code Chapter ATCP 51 Livestock Facility dated September 25, 2006. Bezek explained the proposed changes and comparison to the existing ordinance. This will be reviewed by Land and Water Committee on October 3. The public hearing is scheduled for October 19 at 7:00 p.m. Any other proposed changes will be brought to this committee on October 24 and will be presented for County Board approval on October 31. Code Administration Report — Bezek talked about the Bettendorf rezoning being contested. This was a court case from the 1980s. The court upheld Bettendorf but the County appealed. It contains a provision that if the property is sold, it will revert to Ag- Residential zoning and we can't eliminate that provision. We will start enforcement action. There are some enforcement issues in the Town of Kinnickinnic. Bezek stated that one applicant is challenging the constitutionality of the sign ordinance. We are trying to reach an agreement with the land owner. We also plan to revise the current sign ordinance later this year. 3 The Committee recessed at 9:37 a.m. The meeting resumed at 9:50 a.m. Personnel Update - Fodroczi will bring a resolution on the Office Manager position to the October 10 meeting. Bezek will report on adjustments to the Code Enforcement position at the October 10 meeting. Suite Remodeling - The contractor should be receiving the materials this week. Remodeling work will begin soon after. Chuck Whiting is working with Economic Development on adjustments to that office space. 2007 Budget — The issue with the Mallalieu Dam costs will be this committee's only item for the Finance Committee this month. Fodroczi presented a request to exceed the lodging rate for Brett Budrow. Motion by Burri, 2nd by Troyer to approve. Motion carried.
