The St. Croix County Planning and Zoning Committee will be conducting a public hearing
on Wednesday, September 27, 2006, at 7 :00 p.m. at the St. Croix County Government
Center, 1101 Carmichael Road, Hudson, Wisconsin, to consider the following petition(s):

PLANNING AND ZONING COMMITTEE
ST. CROIX COUNTY GOVERNMENT CENTER, HUDSON WI
September 27, 2006
Present:
Committee: Supervisors Wally Habhegger, Lois Burri, Ron Troyer, Gene Ruetz
Staff: Bob Bezek
Call to Order: Chair Habhegger called the meeting to order at 7:00 p.m.,
Adoption of Agenda: Motion by Burri, 2" d by Ruetz to adopt the agenda. Motion carried.
Date of Next Meeting: October 10, 2006, 8:30 a.m. in Hudson.
Action on Previous Minutes: None
Hearings:
Tom and Tony Dallman• Rezone approximately 9 acres from Agricultural to Agricultural
Residential in the SW ' / 4 of Section 31, Town of Pleasant Valley.
Bezek presented the staff report. The applicants were in attendance. Reutz identified that the pond had
been there since the 50's.
Chairman Habhegger opened the public hearing. No one spoke in favor or against the proposal.
Habhegger closed the hearing.
Motion by Ruetz, 2 nd by Burri to approve the request based on the following staff findings and
condition (item 5):
1. The Town of Pleasant Valley has recommended approval and identified that the proposed
use is in compliance with WSS 91.77.
2. The request is consistent with the County Development Management Plan and the County
Natural Resources Management Plan based on:
a. The parcel is in the rural planning area and is an appropriate use.
b. The proposed use is consistent with minimum lot size requirements in the rural
planning area.
c. The request is consistent with the surrounding neighborhood, countryside or
terrain.
d. The proposed use has minimal potential to adversely impact stormwater
management and can be easily managed.
e. The proposed use has minimal potential to adversely impact water resources with
sedimentation resulting from erosion.
f. The proposed use has minimal potential to adversely impact shoreland areas or
wetlands and closed depressions located in shoreland areas.
g. The proposed use has minimal potential to adversely impact closed depressions or
wetlands.
h. The proposed use is consistent with restricting development on slopes in excess of
20 %.
i. The proposed use is consistent with policies to preserve woodlands, prairie
remnants, unique open spaces, or environmental corridors.
J. The proposed use is generally consistent or not in conflict with the St. Croix
County Natural Resources Management Plan.
3. The proposed use can comply with applicable County Land Use Ordinances.
4. The request is consistent with the spirit and intent of applicable County Land Use
Ordinances,
5. Prior to the issuance of a building permit or occupancy permit for a use on the rezoned
parcel, the landowner shall cause a certified survey map to be made of the property and
filed with the register of deeds.
No discussion followed, the motion passed unanimously.
Valley Land Company: Rezone approximately 42 acres from Agricultural to Agricultural
Residential in the NW V4 Section 27, Town of Troy.
Bezek presented the staff report. Jon Sonnentag from S &N Land Surveying represented the client and
added to the presentation and discussed the soil suitability of the site.
Chairman Habhegger opened the public hearing. Michael Albert, who lives on Bjerstad Lane provided a
handout with concerns and discussed them briefly. Bezek read a letter into the record from an absentee
neighboring landowner identified as the Lewinski family. Their letter expressed concerns with seeing
agricultural land being converted for residential purposes. Habhegger closed the hearing.
A motion was made by Troyer, 2 nd by Burn to approve the request based on the following staff
findings and condition (item 4):
1. The Town of Troy has recommended approval.
2. The proposed use is in compliance with WSS 91.77.

Some discussion followed regarding the Town's vote and their deliberations on the issue. Ruetz
commented that where there are already houses to the north is more valuable habitat than what
would be destroyed by this proposal. The motion passed unanimously.
