CROIX COUNTY AGRICULTURAL CENTER, BALDWIN, WI July 26, 2006 Present: Committee: Wallace Habhegger, Lois Burri, Ron Troyer Staff: Bob Bezek Call to Order: Chair Habhegger called the meeting to order at 7:00 pm. Adoption of Agenda: Motion by Burri, 2„d by Troyer to adopt agenda. Motion carried. Date of Next Meeting: Two rezonings and one waiver from the Land Division Ordinance are scheduled for August 23, 2006 in Hudson. Action on Previous Minutes: None Unfinished Business: None Other Business: None New Business: The following public hearing notice is presented as part of the record: PUBLIC HEARING NOTICE The St. Croix County Planning and Zoning Committee will be conducting a public hearing on Wednesday, July 26, 2006, at 7:00 p.m. at the St. Croix County Government Center, Hudson, Wisconsin, to consider the following petition(s): REZONING APPLICANT: Richard & Cheryl Saari LOCATION: SW 1 /4 of SE 1 /a Section 4, T29N, R16W, Town of Baldwin ADDRESS: 2366 11& Ave., Baldwin, WI 54002 REQUEST: pursuant to Section 17.72 of the St. Croix County Zoning Ordinance to rezone approximately 20 +/- acres of land from Agricultural- Residential to Agricultural. In the case of cancellation of this hearing, such notice will be announced on 1 r WIXK and WEVR Radio Stations, or call the Planning and Zoning Department at 715- 386 -4680 before 5:00 p.m. Wallace Habhegger, Chair Planning and Zoning Committee Item 1, Richard and Cheryl Saari: Request to rezone approximately 20 +/- acres of land from Agricultural Residential to Agricultural in Section 4, Town of Baldwin. Bezek gave an overview of the site and the applicant's request. Rick and Cheryl Saari were present. Rick identified that they will leave the land in CRP. Chairman Habhegger opened the public hearing. No one spoke either for or in objection to the request. Chairman Habhegger closed the public hearing. Motion by Troyer„ 2 nd by Burri to approve the request based on the following staff findings and condition: 1. The Town of Baldwin has not recommended disapproval. 2. The request is consistent with the County Development Management Plan and the County Natural Resources Management Plan based on: a. The parcel is in the rural planning area and is an appropriate use. b. The proposed use is consistent with minimum lot size requirements in the rural planning area. c. The request is consistent with the surrounding neighborhood, countryside or terrain. d. The proposed use has no potential to adversely impact stormwater management. e. The proposed use has no potential to adversely impact water resources with sedimentation resulting from erosion. f. The proposed use has no potential to adversely impact shoreland areas or wetlands and closed depressions located in shoreland areas. g. The proposed use has no potential to adversely impact closed depressions or wetlands. h. The proposed use is consistent with restricting development on slopes in excess of 20 %. i. The proposed use is consistent with policies to preserve woodlands, prairie remnants, unique open spaces, or environmental corridors. j. The request does protect or preserve agricultural land. k. The proposed use is generally consistent or not in conflict with the St. Croix County Natural Resources Management Plan. 1. The proposed use can comply with standards in the Land Use, Subdivision and Sanitary ordinances. 3. The request is consistent with the spirit and intent of applicable County Land Use Ordinances. 4. Approval is conditional on the landowner causing a certified survey map (CSM) on the rezoned parcel to show it being combined with an adjacent parcel such that the resultant parcel exceeds 35 acres in size. The CSM is to be recorded in with the St. Croix County register of deeds. No discussion followed, the motion passed unanimously. Item 2, John & Georgine Schottler: Request to rezone approximately 600 +/- acres of land from Agricultural to Agricultural Residential in Sections 22 and 27, Town of St. Joseph. Bob Bezek gave an overview of the site and the applicant's request. John and Georgine Schottler were present. John added that they plan to continue farming the property. Troyer stated that he thought it is unfortunate that people who move to the country would complain about agricultural practices. 2 t Chairman Habhegger opened the public hearing. Town of St. Joseph Supervisor Bye Barsness commented that both the Town Planning Commission and Town Board are supportive of the request. No one spoke in objection to the request. Chairman Habhegger closed the public hearing. Motion by Burri, 2" by Ruetz, to approve the request based on the following staff findings and condition: 1. The Town of St. Joseph has recommended approval. 2. The request is consistent with Wisconsin § 91.77. 3. The request is consistent with the County Development Management Plan and the County Natural Resources Management Plan based on: a. The parcel is in the rural planning area and is an appropriate use. b. The proposed use is consistent with minimum lot size requirements in the rural planning area. c. The request is consistent with the surrounding neighborhood, countryside or terrain. d. The proposed use has a significant potential to adversely impact stormwater management that can be managed if properly designed. e. The proposed use has a significant potential to adversely impact water resources with sedimentation resulting from erosion. Such impacts can be managed if properly designed. f. The proposed use has a significant potential to adversely impact shoreland areas or wetlands and closed depressions located in shoreland areas. Such impacts can be managed if properly designed. g. No discussion followed, the motion passed unanimously. After approval, some concerned neighbors of Schottler's arrived. They had questions for the Schottlers. Both parties were notified that the hearing was closed and a decision had been made.
