CROIX COUNTY GOVERNMENT CENTER, HUDSON, WI March 28, 2006 Supervisors:, Brian Hurtgen, Lois Burri, and Buck Malick were present. Jan Zoerb, Wally Habhegger and Stan Krueger were absent and excused. Staff. David Fodroczi, Bob Bezek, Alex Blackburn, Cheryl Slind and Debbie Murphy. The meeting was called to order at 8:30 a.m. The agenda was adopted. The next meeting is April 5, 2006. Minutes: Burri/Habhegger moved to approve the following minutes: October 11, November 8, 28 & 29, December 13 (2), January 10, February 14. Motion carried. Major and Minor Subdivisions Minor Subdivisions: See attachment A: Major Subdivisions: See attachment B: Bills/Invoices/Revenue: Burri has reviewed and approved the bills and revenues for February 2006. Rezoning schedule: Bezek explained that April 5` is scheduled for the next rezoning hearing. There will be three rezonings that night, and three waivers. The rezoning hearing night in May is the 17` Municipal plats: None Gerry Schoen: Bezek explained that his is a rezoning request that was tabled on March 8` in order to get a recommendation from the Town of Pleasant Valley. The town has now recommended approval of the request to rezone 40 acres from Ag to Ag/Residential. The applicant owns approximately 80 acres he wishes to rezone to Ag- residential to divide off into 3 - 12 to 14 acre parcels zoned ag- residential and leave the remaining 40 acre parcel zoned agricultural. There currently are no homes on the 80 acres. The Town's new subdivision standards allow for a density of 2 lots per 40 acres. Schoen is taking advantage of a provision in the Town ordinance that allows transferring density to an adjacent 40 acre parcel. Discussion held. Motion by Malick, second by Hurtgen to recommend approval to the County Board based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. The proposed use is consistent with minimum lot size requirements in the rural planning area. 3. The request is consistent with the surrounding neighborhood, countryside or terrain. 4. The proposed use has minimal potential to adversely impact stormwater management. 5. The proposed use has minimal potential to adversely impact water resources with sedimentation resulting from erosion. 6. The proposed use has little potential to adversely impact shoreland areas or wetlands and closed depressions located in shoreland areas. 7. The proposed use will not adversely impact closed depressions or wetlands. 8. The proposed use is consistent with policies to preserve woodlands, prairie remnants, unique open spaces, or environmental corridors. 9. The request does protect and preserve agricultural land. 10. The proposed use is generally consistent or not in conflict with the St. Croix County Natural Resources Management Plan. 1 11. The Town of Pleasant Valley has recommended approval and identified that the proposed use is in compliance with WSS 91.77. 12. The request is consistent with the spirit and intent of applicable County Land Use Ordinances. With the following condition: 1. Prior to the issuance of a building permit or occupancy permit for a use on the rezoned parcel, the landowner shall cause a certified survey map to be made of the property and filed with the register of deeds. J ob Descriptions and Springsted Study: Fodroczi reported that the liaison group met last week to go over the supervising structure now in place for personnel, and will be meeting with the consultant tomorrow. The job descriptions will be brought to the committee in the future Discussion of Land and Water Conservation plat review services: Fodroczi and Bezek have met with Bob Heise about this, and Heise will start the re -hiring process. Staff will keep the committee updated. Approval of CSM's/Treasurer's Certificate: Cheryl Slind, St. Croix County Treasurer, joined the group and handed out a memo to the committee from Corporation Counsel regarding Treasurer's Certificates. In order to require this certificate, an amendment would be needed to the Subdivision Ordinance. Discussion held. Motion by Malick, second by Burri to modify the ordinance to include wording on the Treasurer's Certificate for plats. Fee Schedule Amendment: Bezek went over the proposed changes to the current fee schedule. The following changes are being proposed: Land Use Permits in conjunction with another permit to be $50 rather than $300; Administrative Appeal Action to be $400; After - the -fact doubling fee to take place only after enforcement action is commenced in writing. Discussion held. Motion by Malick, second by Hurtgen to accept the proposed amendments to the fee schedule. Motion carried on a unanimous vote. Land Use Ordinance Amendments: Fodroczi asked that the committee take no action on this until possibly June. There are several things to be looked at, and need to have a discussion on how to proceed with the changes. Will discuss this further in May. Motion carried. 3 MAJOR SUBDIVISIONS March 28, 2006 The first 2 staff reports are concept submittals of conservation design developments. Prior to 2006 conservation design development were not allowed and in addition concepts were not presented to the Planning and Zoning Committee. These concept submittals are reviewed for application completeness and the general layout of the land division. The applicant will also present the Rolling Hills Farm plat from 9:30 to 10:30. The lot numbers have changed since then and the new lot numbers are 12 and 13. Staff recommendation Conditional approval of the plat and conditional approval of the waiver. Conditions; 1. Submit bids and financial guarantees for erosion control. 2. No other lots will require disturbance of 20% slopes. Residential Soil test Soil tests have been submitted Waiver request for road construction. None requested LWCD action The LWCC has conditionally approved the erosion control plans. The applicants have submitted an agreement on the conservation easement and vegetation management plan on March 22, 2006. This easements and management plan must be reviewed by zoning staff and the Land and Water Conservation Department. The applicants want to discuss whether or not the county would be willing to sign such an agreement. DNR action The DNR has received the map. Highway Department action The Highway Department had one minor revision. County Surveyor's Dept action NA 20 percent slope disturbance Approved on May 24, 2005. Staff recommendation Pending discussion pertaining to the conservation easement. Conditions; 1. Submit bids and financial ;guarantees. 2. Conservation easement and vegetation management plan need approval. 5 • 3. Address one minor revision from the Highway Department. 4. Address property line discrepancy on southeast lot. Committee action: Malick/Hurtgen moved to table to address staff concerns, and concerns of committee members regarding Chapter 30 permit and clean up of junk on the lots. Motion carried unanimously. Dayspring Vistas —Final Owner(s) Robert Nagel Surveyor Roger Humphrey Location Section 5 Town of Somerset Number of lots 11 lots totaling 38.85 acres Original parcel 38.85 acres Zoning district Ag. Residential Soil test Complete soil tests have been submitted. Lot 2 will need some further analysis to determine whether or not a sanitary system can be engineered using the present soil location. A new soil test may also solve the problem. Waiver request for road construction A waiver has been conditionally approved. 20 percent slope disturbance The PZC stated no objections to the September 27, 20 percent slope disturbance request. A special exception to disturb 20 percent slopes in order to construct a joint driveway to serve lots 3 and 4 was conditionally approved by the Board of Adjustment on February 23` Staff recommendation Conditional approval Conditions; 1. Submit bids and financial guarantees for road construction and erosion control. 2. Engineer sanitary system for lot 2 or provide a new soil test. Number of lots 28 lots Original parcel 65 acres Zoning district No Zoning. Soil test Soil tests have been submitted. Several tests will need interpretive determinations and some lots may not support septic systems. Waiver request Has been approved Bids and financial guarantees Have been submitted. Township action The town has not signed the map. They have stated that the roads are not constructed to town standards. Staff recommendation The applicants have stated they want this plat tabled to work out the soil tests and interpretive determinations. Staff recommends tabling this request to address the soil tests and resolve issues with the road dedication. Committee action: Malick/Hurtgen moved to table at applicant's request, carried. 6
