All members present. Motion by Supervisor Kinney to recommend approval of the September 22, 1987 minutes as written. Seconded by Supervisor Sweitzer. Minutes approved as written. OLD BUSINESS: Ted Mackmiller: Attorney William Radosevich stated that the project is about 80 percent completed and they are requesting an extension on the one year to complete this project. Gleason LOCATION: Part of Government Lou 2, Section 27, T30N- R20W, Town of St. Joseph Jeffrey Lee: Mr. Lee explained his request to build a new garage which would not meet the 100' setback from the right -a -way line of a town road as required by the county zoning ordinance. He had agreed in his contract that the contractor was to obtain all necessary permits and construction was started. 1 ®���� �®�@g; Mr. hones presented his request to move an existing driveway to a location that would be closer than 200 feet to another driveway. This new placement would make the new entrance safer. David Oren: Mr. Oren presented his request to construct a residence that would only be 60' from the bluffline along the St. Croix River. This is the only location on this preexisting parcel that a house can be built upon. Moving the house further back would place the structure within a second 12 percent slope which is not permitted by the ordinance. Dan McGuiness representing the MN -WI Boundary Area Commission stated that he supports the location being proposed, but that the 25' height restriction should be followed. Mrs. Bacaner who owns property south of this parcel expressed interest in the project. The Zoning Administrator stated that a letter had been received from Bernie McGaver of the Department of Natural Resources. He has no objection to the proposed project. Thomas Gleason: Mr. Gleason presented his request to place a 160' 2-way communication antenna on his property to serve local businesses in the St. Croix Valley. This would be constructed and operated by Levques Tower. Quentin Weinzierl, township of St. Joseph Supervisor, stated that he is neither for the tower or against it as long as it meets all of the requirements. Attorney Warren Brandt, representing Levques Tower and Thomas Gleason stated that construction had been started but stopped in good faith when it was realized there was a need for a special hearing. This shows there is an attempt to work with the system, and trying to please all concerns. Dan McGuiness, MN -WI Boundary Area Commission, expressed his concern about the impacts of visibility, especially if there is a need for lights. There should be some proof that the tower will not need lights or will not have dishes hanging from it which would increase visibility. The tower is not being proposed in the St. Croix Riverway District but would feel the impact by visibility. Martin Levake, owner of Levques Tower, explained there is a need for this tower by local businesses. The tower is being moved from Stillwater to Houlton so as to provide a higher elevation for better communications. FAA currently does not require lights on antennas under 200 feet in height. Quentin Weinzierl stated there should be proof of insurance and not allowing strobe lights; obstruction lights would be okay. 2 Jim Junker, one of the commercial users of the tower, stated the restrictions encountered in the "valley" are making it very difficult to operate in the St. Croix River way District. Hearings recessed for viewing the parcels in question. After viewing the sites, the board returned to session to render decisions. The following decisions were made: 1. Ted Mackmiller: Motion by Supervisor Kinney that with the approval of a one year extension the following shall be required: A. Written plan appoval by the DNR and upon completion a final written inspection report. B. Written approval by the Township. C. Fill in road ditch be removed, and proper spillway grade be stabilized using riprap, sod, or seed and netting. D. The rest of the disturbed project area be sodded. E. Upon completion, the County Zoning Administrator shall be contacted to inspect project and will have received all above written reports. Motion seconded by Supervisor Sweitzer, Motion to approve as stated: Kinney, yes; Sweitzer, yes; Meinke, yes. Motion carried. 2. Jeffrey Lee: Motion by Supervisor Kinney to approve a 61 foot setback from the town road. In granting this setback neither the township or county can be held liable should the roadway be widened. Motion seconded by Supervisor Sweitzer. Motion to approve: Kinney, yes; Sweitzer, yes; Meinke, yes. Motion carried. 3. Daryl Jones: Motion by Supervisor Kinney to approve a joint driveway access with said driveway being no less than 30 feet wide. The original driveway is to be properly abandoned. Upon completion, the township and County Zoning Administrator are to be contacted for inspection. Motion seconded by Supervisor Sweitzer. Motion to approve: Kinney, yes; Sweitzer, yes; Meinke, yes. Motion carried. 4. David Oren: Motion by Supervisor Kinney to approve a 60 foot setback from the first bluffline and adjacent to second bluffline base. Request for 29' height denied, 25' height to be maintained as required by ordinance. The construction of the driveway to be done so no grading or filling be done on 12 percent slopes. The owner is to notify the County Zoning Administrator and townwhip for final inspection of project. Motion seconded by Supervisor Sweitzer. Motion to approve said motion: Kinney, yes; Sweitzer, yes; Meinke, yes. Motion carried. 5. Thomas Gleason: Motion by Supervisor Sweitzer to approve 3 the construction of the tower permitting construction to begin, but with the condition that the owner provide proof of insurance and that this project will be discussed as old business in thirty days to determine the need for lighting. This project shall also have approval of the Department of Industry, Labor and Human Relations. Motion seconded by Supervisor Kinney. Motion to approve as stated: Kinney, yes; Sweitzer, yes; Meinke, yes. Motion carried. Motion by Supervisor Sweitzer to adjourn. Seconded by Supervisor Kinney. Motion carried.
