All members Minutes of the February meeting and hearings approved The next regular hearing date will be April 28, 1987. in the present. as mailed. OLD BUSINESS: Marvin Bucaner has not at this time submitted the additional information. Bernard Kinney made a motion to postpone the decision until next month's meeting. Edith Sweitzer seconded the motion. Motion carried. Hearings called to order by Chairman Meinke at 9:30 A.M. Zoning Administrator Tom Nelson read the notice of the hearings as published in the local newspapers. 1. ARTICLE: 3.4 B 3.4B(1) Filling & Grading APPELLANT: John T. Schottler LOCATION: NW 1/4 of the SW 1/4, Section 24 & Gov't Lot 5, Lot C, NE 1/4 of the NW 1/4, Sect. 26, T30N-R19W, Town of St. Joseph 2. ARTICLE: 8.5C Erection of Billboard APPELLANT: AmericInn Motel LOCATION: SE 1/4 of the NE 1/4 of Section 5 T30N-R19W, Town of Somerset Mr. John Schottler presented his request to allow his filling and grading for an access onto Bass Lake and roadways through an existing wetland to allow center pivot irrigation. Dan Koch from the Department of Natural Resources has no problem with the after the fact permits for an access onto Bass Lake because the grading is less than 10,000 square feet, but was concerned that he had not originally obtained the permits before the construction had begun. Dan indicated the second application on the wetlands is a violation of state statutes and prosecution is possible. Mr, and Mrs. Patrick Milton presented their request for a Beauty Shop in their residence. This shop will employ only Mrs. Milton and will attract no other businesses to the area. Mr. William Derrick presented his request for a gravel pit on 160 acres in Richmond township. This use will be mainly for his business. No core samples have been taken but he wants the material mainly for his business. Mr. Tom Leverty indicated he would not want to look directly across the road into a pit. The Zoning Administrator read a letter from Rick Powers expressing his concern on what the use would do to the real estate value of his property and the quality of the drinking water. Mr. John Pfleider presented his request to Riprap the length of his beach so as to prevent any additional erosion of his bluff. His second request is to build a garage which would need variances on setbacks from the lot line, bluff line, and a road right -a -way. Mr. Stevq Johnson, MN -WI BAC stated that he is not opposed to the riprap request but feels the information provided should have shown areas in excess of 12% grade by a registered Land Surveyor or other professional. Mr. Bernie McGaver from the Wisconsin Department of Natural Resources expressed the same concerns for additional information since a variance cannot be granted to place fill or a structure or slopes of 12% or more. `Phomas Sheetz presented his request for a billboard. The sign will be 16' X 8' on property currently zoned commercial. The Zoning Administrator expressed the concern of the Deparment of Transportation making sure that its off the right -a -way and 300' from any other sign. Eldon Ramberg presented the concerns of the County Flighway Department on the acquisition of property for right -a -way on privately owned property in Star Prairie township. This acquisition will in effect create parcels that are less than an acre and will not be able to meet the building setback requirement from the road. It was suggested that he apply for a variance at the April Board of Adjustments. Hearing recessed for viewing the parcels in question. After viewing the sites, the board returned to session to render decisions. The following decisions were made: 1. JOHN T. SCHOTTLER: Motion by Supervisor Kinney to approve the filling and grading request on the property adjoining Bass Lake for access purposes. When the erosion control work is completed Mr. Schottler is to request that it be inspected by the Zoning Office. Seconded by Supervisor Sweitzer. Motion carried. Vote to approve: Kinney, yes, Sweitzer, yes; Meinke, yes. Motion by Supervisor Kinney to table the request on filling and grading on the wetland located in Section 26, T30N-R19W, St. Joseph Township until the Department of Natural Resources has time to review the request. Seconded by Supervisor Sweitzer. Motion carried. 2. PATRICK & SUSAN MILTON: Motion approve the beauty shop providing that by Supervisor Kinney to only fam0ly members are employed. When construction is completed, the Zoning Office is to be contacted so a construction inspection can be done for approval. Seconded by Supervisor Sweitzer. Motion carried. Vote to approve: Kinney, yes; Sweitzer, yes; Meinke, yes. 3. WILLIAM H. DERRICK: Motion by Supervisor Kinney to only consider the NW 40 acres of the 160 acres and to postpone a decision for 30 days until the requirements of the ordinance can be met which shall include the filing of an agreement, accompanied by a surety bond or other financial guarantee for the restoration, within one year after discontinuation of operations, of the site to a condition of practiced usefullness and physical attractiveness. This is to be binding by William H. Derrick, The Derrick Corporation, and his heirs. Motion seconded by Supervisor Sweitzer. Motion carried. Vote to table: Kinney, yes; Sweitzer, yes, Meinke, yes. 4. JOHN R. PFLEIDER: Motion by Supervisor I{inney to approve the rip rap application and upon completion notify the reviewing agencies for inspection. Motion seconded by Supervisor Sweitzer. Motion carried. Vote to approve: Kinney, yes; Sweitzer, yes; Meinke, yes. Motion by Supervisor I{inney to postpone a decision for 30 days so the following information can be presented by the the applicant: 1. Statement from Fire Insurance Agent that the garage will not interfer with insurability. 2. A statement describing how property can be accessed to provide fire protection for the residence. 3. A statement describing how the septic system can be maintained (pumped) or replaced should the system .fail. 4. A statmer�t describing how the garage will not interfer with the servicing or replacement of the well. 5. Provide a survey done by a licensed professional showing all areas in the area of the garage that are 12% slope or more. This would also include the approach°to the garage. Motion seconded by Supervisor Sweitzer. Motion carried. Vote to postpone: Kinney, yes; Sweitzer, yes; Meinke, yes. 5. AMERIC INN MOTEL: Motion by Supervisor Sweitzer to approve the placement of a sign making sure that it meets the DOT setback requirements. Motion seconded by Supervisor Kinney. Motion carried. Vote to approve: I{inney, yes; Sweitzer, yes; Meinke, yes. Motion by Supervisor Sweitzer to close the hearings and adjourn. Seconded by Supervisor Kinney. Motion carried.
