BOARD OF ADJUSTMENTS MEETING AND HEARINGS
July 28, 1987
Hearing called to order by Chairman Meinke at 9:15 A.M. in the
County Board Room. Supervisors Kinney and Sweitzer present.
Supervisor Meinke absent. Minutes of the June meeting and
hearings approved as mailed. The next regular meeting will be
August 25, 1987.
OLD BUSINESS: John Goulette: Zoning Administrator is to contact
owner of pool and request that additional information be
submitted as requested on June 30, 1987.
The Zoning Administrator informed the Board that in October and
November there will be several ETN's dealing with the recent
Supreme Court Decision on the "Taking." It was suggested that
the regular meeting dates be changed so these could be attended.
Hearings called to order by Vice -Chairman Kinney at 9:30 A.M.
The Zoning Administrator, Tom Nelson, read the notice of the
hearings as published in the local newspapers. The procedures of
the hearing were explained.
1. ARTICLE: 17.15 (6) (n) Temporary Asphalt Plant
APPELLANT: American Asphalt of Wisconsin
LOCATION: N 1/2 of NE 1/4 of Section 16, T29N-R17W, Town
of Hammond
2. ARTICLE: 17.36 (5) (c) 1 Setback from Bluff, Riverway
District
APPELLANT: David C. Zanick
LOCATION: Gov't Lot 1, Section 26, T28N-R20W, and in the
NW 1/4 of the SW 1/4 and Gov't Lot 1 of
Section 25, T28N-R20W, Town of Troy
3. ARTICLE: 17.64 (1) (c) 2 Highway Setback
APPELLANT: Timothy P. Rehberger
LOCATION: SW 1/4 of the NW 1/4, Section 14, T28N-R18W,
Town of Kinnickinnic
4. ARTICLE: 17.65 (3) Off -Premise Sign
APPELLANT: Steven Montbriand
LOCATION: SE 1/4 of the NE 1/4, Section 5, T30N-R19W,
Town of Somerset
American Aspahlt of Wisconsin: Mr. Tom O'Keefe, St. Croix County
Highway Commissioner stated they have a twenty year lease on
crushing gravel and due to the favorable oil prices they wish to
clean up the current crushed rock supply producing asphalt.
David C. Zanick: Mrs. Sue Zanic presented her request to build a
bunkhouse -storage shed adjacent to the existing residence. This
would be for a summer sleeping quarters and winter storage. It
would not be served by a water supply.
41 T}fetRy ft@hB@fq@f presented his request to build a barn -
garage 67' from the town road centerline. Several months ago the
horse barn had burned on this location. The current residence is
64' from the centerline of the road. The building will be 36' X
66'.
Mr. Steven Montbriand presented his request to retain a sign on
commercial property located on STH 64 and signs located on Ag-
Residential property along 170th Street and CTH I directing
traffic down the town road towards his tubing facility.
Mr. Milton Meinke, Town of Somerset Chairman, stated these signs
were okay, new signs elsewhere should be limited.
Ms. Beth Stenzel is concerned the sign on STH 64 is directing
traffic down her road. "Most people are concerned with this
routing because of the rural residential activities in the area."
Also, there is a hill which creates a blind spot.
Ms. Kathy Granger expressed her concern that the signs rather
than being directional are informational showing prices and also
have flagging which should not be permitted.
Ms. Charlene Charbonneau stated that she is concerned with how so
many are abusing the sign ordinances and why something isn't
being done.
Hearings recessed for viewing the parcels in question. After
viewing the sites, the board returned to session to rendor
decisions. The following decisions were made:
1. AMERICAN ASPHALT OF WISCONSIN: Motion by Supervisor Sweitzer
to recommend 90 day approval of asphalt operation. Motion
seconded by Supervisor Kinney. Vote to approve: Sweitzer, yes,
Kinney, yes. Motion carried.
2. DAVID ZANIC: Motion by Supervisor Kinney to table this
decision. Committee needs to receive revised plans showing
attachment of bunkhouse -storage shed to house by a deck, and
showing and certifying the bluffline on a plot plan by a
professional engineer or surveyor. Motion seconded by Supervisor
Sweitzer. Vote to table: Sweitzer, yes; Kinney, yes. Motion
carried.
3. TIMOTHY REHBERGER: Motion by Supervisor Sweitzer to approve
variance of 67' from the center of the. road for a 36' x 66'.
horsebarn-garage. The township and county assume no
responsibility should future road construction impose on the
structure. Motion seconded by Supervisor Kinney. Vote to
approve: Sweitzer, yes; Kinney, yes. Motion carried.
9. STEVEN MONTBRIAND: Motion by Supervisor Kinney to approve
sign on STH 64 since it is on commercial property, streamers and
flags are to be removed. Motion to conditionally approve the
signs on 170th street and CTH I, the conditions being the signs
be no more than 32 feet, meet 10' setback from property -easement

line, and that all streamers and flags be removed. Motion
seconded by Supervisor Sweitzer. Vote to approve: Sweitzer,
yes; Kinney, yes. Motion carried.
Motion by Supervisor Sweitzer to adjourn. Seconded by Supervisor
Kinney. Motion carried. Hearing and meeting adjourned at 3:30
P.M.
