January 28, 1993

The meeting was called to order by vice chairman Stephens at 9:00
A.M. Stephens explained the procedures of the hearing requesting
that individuals wishing to testify sign their names in the front
of the room.
Supervisors Menter, Neuman and Stephens were in attendance.
Supervisors Bradley and Kinney had excused absences. Staff
included Zoning Administrator, Tom Nelson.
Motion by Menter, seconded by Neuman to approve the agenda as
published. Motion carried.
Motion by Neuman, seconded by Menter to approve the minutes as
mailed. Motion carried.
OLD BUSINESS
Nelson stated that this was back before the Board because of
several unanswered questions that came up after the site visit last
month. One of these questions was how the original access permit
was issued.
Having checked with the County Highway Department, a permit was
issued back in 1988 for access to C.T.H. "V". The construction of
this drive did not follow the private easement or access onto
C.T.H. "V" perpendicularly as it should have. Now that this access
is serving as a point access, there is the need to exceed the
twenty-four (24) foot width standard.
After a brief discussion it was agreed that it would be better to
rehear and view this site at the May meeting when the snow is gone.
At this same time someone representing the Highway Department
should be in attendance to answer questions.

Nelson stated that Mr. Blekum was back before the Board requesting
an extension of six (6) months beyond the one (1) year permit
originally granted.
The permit granted was for a temporary occupancy permit in a
trailer while Blekum constructed his house. Health problems,
weather and unforeseen construction delays have slowed the
construction. The township of St. Joseph supports the proposal.
Motion by Menter, seconded by Neuman to grant a six (6) month
extension for the temporary occupancy use permit of the trailer so
construction can be continued.

The hearing was called to order at 9:30 A.M. Nelson read the
notice of the hearing as published:
The St. Croix County Board of Adjustment has scheduled a public
hearing for Thursday, January 28, 1993 at 9:30 A.M. in the County
Board Room of the St. Croix County Courthouse, Hudson, Wisconsin to
consider the following appeals to the St. Croix County Zoning
Ordinance. An on site investigation will be made of each site in
questions, after which the Board contemplates adjournment into
closed session for the purpose of deliberating on the appeals,
pursuant to Sec. 19.85(1)(a), Wisconsin Statutes, and will
reconvene into open session for the purpose of voting on the
appeals.

LOCATION: NW 1/4 of the SW 1/4 of Sec. 5, T30N-R19W,
Town of Somerset
Nelson introduced the application stating that this was a three
part request on property located along the St. Croix River. The
first part is requested is to be able to replace the existing deck
that has fallen into disrepair. Second, they would like to add a
second deck at the top of the roofline for astronomy purposes.
Third, they would like to install a drainage system for surface
waters that would involve a fair amount of filling and grading.

Dave Hense, Supervisor for the town of Troy stated that this
application has not been reviewed by the township as of this time
and therefore no recommendations can be made.
After some discussion it was decided to postpone any decision until
the township could give a recommendation.

Nelson stated that his request was a variance to reconstruct an
entrance onto the Cylon Methodist Church building two (2) feet
closer than the existing nonconforming structure.
Dr. Don Arvold stated that there was need for this encroachment so
as to provide a safer and separate entrance to the lower level of
the building.
The township of Cylon supports the proposal.

At the conclusion of the hearings, the Board visited the sites in
question. Upon returning, the Board of Adjustment rendered the
following decisions:

Motion by Menter, seconded by Neuman to approve the two (2) foot
variance as outlined on the plans. Motion carried.

Motion by Stephens, seconded by Neuman to conditionally approved
the duplex based on the following conditions.
1. Septic system to be installed as per code;
2. Staircase be constructed with proper risers and treads,
3. No storage of materials beneath stair case,
4. Smoke detectors be located beneath the ceiling tiles in
kitchens, bedrooms and furnace room.
Motion carried.
