HomeMy WebLinkAboutBoard of Adjustment Minutes 11-24-1993BOARD OF ADJUSTMENT MEETING AND HEARING Minutes November 24, 1993 (This meeting was recorded by a court reporter) The meeting was called to order by Chairman Bradley at 9:00 a.m. Chairman Bradley explained the procedures of the hearing and requested that individuals wishing to testify sign their names and addresses on the sign-up sheet in the rear of the room. Supervisors Stephens, Bradley, Kinney, Menter, and Neuman were in attendance. Staff included Tom Nelson, Zoning Administrator, and Michelle Judge, Recording Secretary. Next meeting scheduled for December 22, 1993. Kinney made a motion to change minutes of September 23--Kosa 'Kinney stated self-induced hardship". Menter seconded —Motion carried. Motion by Bradley, seconded by Neumann to adopt September minutes with changes —Motion carried. Menter asks to change the November vote; Stephens, no, all others yes. New addition would Motion carried for December GAME UNLIMITED: Nelson stated Game Unlimited is before the Board because of an expanded use, and the need for a special exception. It had been agreed to postpone so all could be discussed. Matt Biegert, agent for Game Unlimited brought a proposal asking for the following: sporting clays will not be done on any legal holidays. From May 1-September 1, shooting from 9-3 on Sundays, 9-5 Saturdays, M-F 9-8:30 p.m. Clay shooting will not be done one night per week. Asking that the use be grandfathered in. Stephens states it cannot be grandfathered in as it is a relatively recent addition. David Anderson, neighbor of Game Unlimited was sworn -in and asks for stronger restrictions. States concern over increased noise. Bradley asks to re -visit site and make a decision at that time. SIEKMEIER (PEABODY): Nelson states driveway was approved with contingencies. Rich Meyer verbally told them where to put the driveway. Nelson states access was to ->-be joint but a second driveway was installed instead. NEW BUSINESS: The hearing was called to order at 9:so a.m. Nelson read the notice as published: The St. Croix County Board of Adjustment has scheduled a public hearing for Wednesday, November 24, 1993 at 9*30 a.m. at the Government Center, 1101 Carmichael Rd., Hudson, Wisconsin to consider the following appeals to the St. Croix County Zoning Ordinance. An on -site investigation will be made of each site in question, after which the board contemplates adjournment into closed session for the purpose of deliberating on the appeals, pursuant to Sec. 19.85(1)(a), Wisconsin Statutes. The Board will reconvene into open session for the purpose of voting on the appeals. 1. ARTICLE: 17.155 Major Home Occupation. APPELLANT: Mark Triebold LOCATION. NE 1/4, SE 1/4, Sec. 17, T30N-R19W, Town of Somerset 2. ARTICLE. 17.64(3) Setback Variance from Adjoining Driveway Class C Highway APPELLANT: David Green LOCATION. SW 1/4, Sec. 15, T 31N-R18W, Town of Star Prairie 3. ARTICLE: 17.29(a) filling and Grading Lakeshore APPELLANT: Warren Wood LOCATION: NE 1/4, NW 1/4,. SEC. 3, T31N-R18W, Town of Star Prairie All interested persons are invited to attend said hearing and be heard. Additional information may be obtained from the office of the St. Croix County Zoning Administrator, Hudson, Wisconsin at 386-4680. John Bradley, St. Croix Co. 2 Chairman Board of Adjustment MARK TRIEBOLD: Nelson states this is a request for a major home occupation with a violation issued prior to this meeting. This would be a special exception permit. Triebold states he has a farm, machine shop workshop with his _brother. Property is zoned kg -residential. Town of Somerset supports this request. Exhibit #2 is a letter from one of his neighbors, who also supports the request. DAVID GREEN: Nelson states this is a request for a variance to driveway separation. Town of Star Prairie supports the request. Green states this is the only access to the land as it only has a 5V access. Ruth Johnson and Milton Johnson were sworn -in, neighbors of property. Ask not to grant variance because purchaser of property is possibly planning,a sub -division, as property lies on lake. Nelson recommends a single-family residence be used with driveway access. Donna Satterlund, agent for purchaser does not know if property was ever surveyed. Stephens asks that Satterlund go to register of deeds and finish this discussion at end of meeting. WARREN WOOD: Nelson states this is a request for a special exception for filling and grading on lakebed. Nelson states the Zoning office approves of the request. The Town of Star Prairie also supports the request. Upon completion, the following decisions were rendered: GAME UNLIMITED Motion by Stephens, seconded by Menter to conditionally approve the sporting days and splatball use on the property. The hours of operation shall be as follows: 1) Between May 1 and September 1 A. 9:00 a.m. to 3:00 a.m. on Sundays Be 9:00 a.m. to 5:00 a.m. on Saturdays C. Other days of the week, except Wednesdays, 9*00 a.m. to 8*30 p.m. 2) September 1 to April 30 - no time limits. 3) All federal holidays - the uses shall be closed. Roll call vote: Motion carried. Stephens, yes, Menter, yes, Neumann, yes; Kinney, yes; Bradley, yes. 3 CAR" "UND Motion by Stephens, seconded by Menter to schedule a special hearing for revocation purposes of a previously approved permit for a contractors storage yard. The date of this hearing is to be December 29, 1993 at 7:00 p.m. in the St. Joseph Town Hall. Roll call vote: Motion carried. Stephen, yes, Menter, yes, Neumann, yes, Bradley, yes, Kinney, yes. Motion by Kinney, seconded by motion Stephens to approve the request for a major home occupation/machine shop as presented. Roll call vote: Motion carried. Kinney, yes, Stephens, yes; Neumann, yes, Menter, yes; Bradley, yes. DAVID GREEN Motion by Stephens, seconded by Bradley to approve the driveway separation variance. The new drive way is to be 20 feet from the driveway to the north and can only serve (1) single family residence. Roll call vote: Motion carried. Neumann, yes; Kinney, yes, Stephens, yes; Menter, yes; Bradley, yes. WARREN WOOD Motion by Bradley, seconded by Stephens to approve the special exception use permit for filling and grading.
