HomeMy WebLinkAboutBoard of Adjustment Minutes 4-22-1993BOARD OF ADJUSTMENT MEETING AND HEARING MINUTES April 22, 1993 (This meeting was recorded by a court reporter) This meeting was called to order by Chairman Bradley at 9:00 a.m. Chairman Bradley explained the procedures of the hearing, requesting that individuals wishing to testify sign their names in the front of the room. Supervisor Stephens, Bradley, Kinney, Menter and Neuman were all present. Staff included Tom Nelson, Zoning Administrator and Greg Timmerman, Corporation Council. Stephens made a motion to approve the agenda, Menter seconded -Motion carried. Kinney made a motion to approve the minutes, Neuman seconded the motion -Motion carried. OLD BUSINESS ALAN BIGELOA Nelson read the findings of fact and the decisions of the February, 1992 BOA decision. The reason for postponement was;so.,that..the right-of-way for "CTH" V could be identified in relationship to the joint access. Their_ request.; is to :exceed the- 241 _width that.is allowed by ordinance Alan explained that the.original drive created the problem because it was not;_,constructed properly. Discussion.: TON -DE FARM _ _... Nelson read the findings of fact .and decision of the March, 1992 hearing. This decision allowed the applicant to exceed 250 animals at their dairy facility. The, number granted was 300. Concerns voiced with the original request was groundwater quality. Bradley stated that this review was to determine if an extension of time could be granted as well as the possibility of increasing the numbers. Discussion. Kinney made a motion that the review should .only be made within the limits of the original application and decision. Consideration .for additional animals should not be given at this time without new application, seconded by Stephens. Discussion. 1 The Township of Rush River supports the`'hearing for increased numbers at this time. Robert Heise, St. Croix County Land Conservation Technician stated that Jon -De Farms have complied with the 1992 management plan. Tom Shoemaker stated that the 1993 management plan provides more acres than did the 1992 plan. James Lund, a consultant from UWMN stated that there were no problems with the management plan. William Sindler did not support or oppose the proposal -he wants to see good management practices. John Shotler and Barry Danielson both supported the proposal. Keith Rodli, attorney representing the Township of Rush River, submitted recommendations proposed by three University of Wisconsin, River Falls professors. These written recommendations outlined the procedures for monitoring the lagoon and spreading. Joe Magnor, a Hydrogeologist from the Minnesota Pollution Control, stated that there should be a better monitoring plan for this area that is so hydrogeologically sensitive. Gene Nelson, Malsy Monican, Ron Moe, Mary Susser, Deb Rasmussan, and Luke Anderson all expressed concerns for the facility at 300 cows. Their main objections were groundwater quality and odor. Role call vote: Kinney, yes, Bradley, no; Stephens, yes, Menter, yes, Neuman, no -Motion carried. ALLEN'SIERMEIER Nelson stated that : this I was'= IIa -request = to ' ask for a 6-month extension of a variance permit granted February 24, 1992. The variance granted the application permission to construct a joint driveway -`-onto STH 12. Kinney made! a,' seconded by Menter to approve the extension for 'a 6-month'_-period-Motion carried. PUBLIC HEARING The St. Croix County Board .of Adjustment scheduled a public hearing for Thursday, April 22, 1993 at 9:OO a.m. at the 5t. Croix County Courthouse, Hudson, Wisconsin to consider the following appeals to the St. Croix County Zoning Ordinance. An on -site investigation was made of each site in question, after which the board contemplated adjournment into closed session for the purpose of deliberating on the appeals, pursuant to Sec. 19.85(1)(a), Wisconsin Statutes, and reconvened into open session for the purpose of voting on the appeals. r. 1. Article: Appellant: Location: 226(89)E3 Exceed permit. Patrick O'Malley NW; of the NE; of Town of Troy 60-day: use period on land use Sec.10, T28N-R19W, 2. Article: 17.36(5)(i) Lift in the Riverway District Appellant: Richard Vasaka Location: Gov't Lot 1, Sec.25, T28N-R20W, Town of Troy All interested persons were invited to attend said hearings and be heard. Additional information may be obtained from the office of the St. Croix County Zoning Administrator, Hudson, Wisconsin at 386-4680. PATRICR O'MALLEY Nelson stated that this was a request for a variance to the 60-day period granted by the recently issued Land Use permit for a "short term" non-metallic mining request. Due to the posting of the town roads, the operation had to shut down. They are requesting to exceed the 60-day period. Pat explained that the sand fill was being used for the sand traps on his golf course. The Township of Troy supports this proposal. Discussion. Nelson stated that the requested lift on the bluff of the St. Croix River is a Special Exception Use. Vasaka presented his design of the lift. The Township of Troy Department of Natural DECISIONS plans, showing the location and engineering supports the proposal as does the Wisconsin Resources. Having completed the hearing testimony, the Board visited each site in question. Upon completion of the site inspections, the following decisions were rendered: 1) Alan Bigelow Motion was made by Stephens, seconded by Menter to postpone the decision until the next regular meeting so that the County Highway Department could be contacted for additional information —Motion carried. 3 :;. ' `i 2) Jon -De Farm Motion by Stephens, seconded by Bradley to conditionally approve the continued use of the 300 animal unit facility — Motion carried. 3) Patrick O'Malley Motion by Kinney, seconded by Neuman to approve the extension of the 60-day time period effective the day the road postings have been removed —Motion carried. 4) Richard Vasaka Motion by Stephens, seconded by Menter to approve the lift as requested —Motion carried.
