The committee and staff will present the most recent versions of these amendments that were considered last August by the County Board. ANNOUNCEMENTS AND CORRESPONDENCE: POSSIBLE AGENDA ITEMS FOR NEXT MEETING: ADJOURNMENT (Agenda not necessarily presented in this order) SUBMITTED BY: St. Croix County Zoning Office DATE: March 8, 2005 COPIES TO: County Board Office Committee Members County Clerk News Media/Notice Board *CANCELLATIONS/ CHANGES /ADDITIONS MINUTES St. Croix County Planning and Zoning Committee March 23, 2005 St. Croix County Agricultural Center, Baldwin, Wisconsin Committee members present: Supervisors Jan Zoerb, Lois Burn, Buck Malick, Wally Habhegger and Brian Hurtgen Staff present: Dave Fodroczi, Robert Bezek, Alex Blackburn and Deb Murphy Chairperson Zoerb called the meeting to order at 7:00 p.m. and explained the meeting process. Dave Fodroczi explained that this meeting is for public information and is not a hearing. There were handouts available that summarized public comments and related changes for the Land Use Ordinance, as well as a handout of the proposed timeline for this process. Focroczi went over the public comments section by section. Chapter 17 A comment was made regarding setbacks for non - conforming sites /lots and how can a map be modified to change the setbacks that are located on a particular map. Staff said that some type of correction instrument would be needed to take care of that. Land Division Ordinance comments: • Some towns expressed an interest in a cooperative agreement with the county regarding subdivisions. This would be for towns that have their own subdivision ordinance. The county would be willing to work with them. • Thoughts were expressed on the fact that some towns are more "progressive" than others where this ordinance is concerned, and those towns are "holding up" this ordinance for the rest of the towns that are interested in having this ordinance passed. This proposed ordinance will work well for the majority of the towns. • Some language on page 26 needs to be changed to comply with the Rock County case regarding town roads. • Concerns were expressed on the limitation of slope disturbance to a certain percentage. If the county wants to preserve farmland, they need to allow disturbance of slopes in order to develop the less desirable farmland. Plats /CSMs can be engineered to deal with slopes with very little impact to the land. • Concerns were expressed on flag lots and how the language reads with regard to length of driveways. • Ghost platting was discussed and there was opposition to the wording being proposed. The developers and surveyors have submitted several comments to the staff and committee on this issue, and staff will be reviewing with the committee. It was suggested to leave this issue up to the cities and villages. • Question raised on submittal requirements for CSMs. In the new ordinance there are provisions for submittal of CSMs without town approval at the submittal stage. Some of the towns have expressed that they want the benefit of the county review before they sign -off on a CSM. • Rounding Rule - The general feeling is that it does not need a bonus. 25% is good. • Comments were made that overall this is a good ordinance, and there are just a few changes that need to be made. 1 J j • Questions were raised on review time for the plats. The proposed ordinance allows 90 days for review of preliminary plats and 45 days for review of final plat. Staff talked to plat review in Madison and they referenced Chapter 236 which allows local authorities 90 days for review of preliminary plat and 60 days for review of final plat. Chairperson Zoerb thanked everyone for coming and reminded the towns that any ideas from them that will help the committee and staff to go in the right direction on these ordinance changes would be appreciated. The Board will view each site in question, after which the Board will deliberate and vote on the appeals. 1. ARTICLE: Special Exception request for a permit to construct a mechanical lift on the property to allow access to the St. Croix River pursuant to Section 17.36(6)(a)4.
