PLANNING 1 ZONING COMMITTEE
MARCH 00
Supervisors: Jan Zoerb, Brian Hurtgen, Lois Burri, Wally Habhegger and Buck Malick were
present. Staff: David Fodroczi, Bob Bezek, Alex Blackburn and Debbie Murphy.
Chairperson Zoerb called the meeting to order at 9:oo a.m. Agenda adopted.
Major and Minor Subdivisions

Extensions: Motoin by Malick, seconded by Haghegger to exted the preliminary plat approval
for Glen View ist Addition for 6 months, with the extension beginning April 28, 2005. Applicant
to pay the difference in the fees per the new fee schedule.
Zoerb asked the staff to re -look at the subdivision fees in the future. Fodroczi stated that they
will be looked at again during the budgeting process.
Roger and Judy Evans Variance Request: At the March 8th Planning and Zoning
meeting this request was tabled for more information on the separate driveway to be built and
what requirements would be met if sold to non family. The committee wanted to see a
recorded easement or deed restriction drawn up for this property. Louie Filkins, of Ogden
Engineering, reviewed the Declaration of Covenants, Conditions and Restrictions for Shared
Driveway with the committee. Discussion held.
Motion by Zoerb, seconded by Habhegger and carried to approve of the variance request for
relief from the joint access construction standards based on the following findings:
1) The variance request does not create any apparent negative impacts or
atypical land use.
2) The shared driveway is for family members and conditions of this are
addressed in the recorded "Declaration of Covenants, Conditions and
Restrictions for Shared Driveway ".
With the following condition:
i) Edit the Declaration language to include "lots i and 2" in the first sentence of
paragraph three.
The committee recessed from 9 :55 a.m. to 10:05 a.m.
Discussion of concepts having disturbance of 20% slopes: Roger Humphrey of
Humphrey Engineering presented the Aswumb CSM. The property is located in the Town of
Kinnickinnic. The request is to put in a driveway to serve 2 lots, and 20% slopes may need to
be disturbed. A discussion was held by the committee and the applicant. Fodroczi stated that
the applicant is willing to work with the county staff on this, and suggested that staff meet with
the applicant and engineer to try to come up with a way to put this driveway in with minimal,
or no disturbance to 20% slopes. A meeting will be scheduled with all parties involved.
Ty Dodge presented a concept map for Carl and Debra Schneider in Section 5, Town of
Somerset. The request is to disturb 20% slopes for road construction. 'Discussion held by the
committee and agent. Motion by Malick, seconded by Habhegger and carried to approve the
disturbance of 20% slopes for the construction of a road. If the disturbance cannot be kept
within the 66 -foot wide area, the dedicated area is to be expanded to allow for that.
Interpretation of 18.16HE. Minimum frontage on a public or private road: Bezek
gave a PowerPoint presentation to the committee and discussion was held on Section 18.16(H)
of the ordinance. Staff believes that a lot needs to be fronted on a public or private road,
therefore a road should be built to a lot rather than access created by an easement. Discussion
held with surveyors that were present. The surveyors would like to see the interpretation
remain as it always has that a 66 -foot easement is allowed until the lot is developed. The lot is
still owned by someone and a road would then be built to county standards if it serves 2 lots.
Malick stated that each instance could be looked at separately and determine which is
appropriate for the situation. The committee would be able to waive this standard when
necessary, or applicant could request a variance from the committee. Staff will create a draft
document regarding this issue and review with the committee.
Conditions of plat approval letter and engineering construction letter
modification: Blackburn went over the Conditions of Plat Approval letter with the
committee. Motion by Malick, seconded by Burri and carried to approved the new form with
suggested minor chances. Motion carried.
Blackburn presented the Engineering /Construction Certification Letter with the committee
and they reviewed. Motion by Malick, seconded by Habhegger to approve with minor changes.
Motion carried.
Bills /Invoices: The February 2005 bills and invoices were reviewed and approved by Chair
Zoerb.
Department Name Change: Postponed until next meeting.
Municipal Plats: The committee reviewed the following municipal plat: Hidden Creek in
Sec 35, Village of Woodville. Motion by Malick, seconded by Habhegger and carried to certify
that they have no objection. No opinion is expressed concerning adequate sewer service.
New Richmond Comprehensive Plan: Postponed until next meeting.
Ordinance Amendments
Sanitary Ordinance: Fodroczi told the committee that there has been no direction from
Corporation Counsel on this. Discussion held on changes to be made to this ordinance. A new
public hearing was scheduled for May 12th at 7:00 pm in Hudson. Motion by Malick, seconded
by Burri and carried to amend the sanitary ordinance by eliminating section regarding
common system ownership and eliminate screening requirement. Fodroczi will have final
version for the committee's review at the next meeting.
The committee recessed for lunch from 12:50 P.M. to 2:00 P.M.
The committee reconvened to review the St. Croix Riverwary draft ordinance.
The meeting was declared adjourned at 4:30 p.m.

12 percent slope. This needs to be one joint access
at a maximum of 10 percent slope.
3. This map must be revised to be in compliance
with 18.11 B2k, that states, "land areas with 20

percent but less than 20 percent slope shall be
differentially shaded or otherwise clearly
indicated ".
4. A recommendation is needed from the Land and
Water Conservation Department (LWCD). This
request will go to the LWCD after 20 percent slope
disturbance approval is obtained from either the
PZC or the special exception permit from the BOA.

PUBLIC INFORMATION MEETING NOTICE
The Planning and Zoning Committee will hold two public information meetings
regarding the proposed Land Division Ordinance and the
proposed Complementary Changes to Chapter 17, Zoning Ordinance. the
committee and staff will present the most recent versions of these amendments
that were considered last August by the County Board.
The meetings will be held on Tuesday, March 15 at 7 p.m. in the Community
Room at the Government Center in Hudson and on Wednesday, March 23 at 7
p.m. in the Conference Room at the Ag Center in Baldwin.
Copies of the draft ordinances are available at the St. Croix County Zoning
Department at 1101 Carmichael Road or the drafts may be obtained below.
