Location: The NW ' / 4 of the NW '/4, Section 19, T31 N -R1 6W, Town of Cylon. 2) Grant Fleischauer to rezone approximately 8 +/- acres of land from Agriculture to Ag /Residential. Location: The NW '/4 of the NE '/, Section 6, T29N -R16W, Town of Baldwin. Information on this petition may be obtained from the office of the Planning and Zoning Department, Hudson, St. Croix County, Wisconsin. In the case of cancellation of this hearing, such notice will be announced on WIXK and WEVR Radio Stations, or call the Planning and Zoning Office Department at 715 - 386 -4680 before 5:00 p.m. Jan Zoerb, Chairperson Planning and Zoning Committee MINUTES St. Croix County Planning, Zoning and Parks Committee January 5, 2005 St. Croix County Agricultural Center, Baldwin, Wisconsin Committee members present: Supervisors Jan Zoerb, Brian Hurtgen, Wally Habhegger and Lois Burri. Buck Malick was absent and excused. Staff present: Dave Fodroczi, Bob Bezek and Deb Murphy Chairman Zoerb called the meeting to order at 7:00 p.m. A motion was made by Bum', seconded by Hurtgen and carried to adopt the agenda. The next meeting is January 11, 2005 at the Government Center in Hudson. Zoerb explained the hearing process and opened the hearing. Bezek read the hearing notice. Pete and Bridget Kling: The request is to rezone approximately 8 +/- acres of land from Agriculture to Ag/Residential. Location: The NW' /4 ofthe NW 1 /4, Section 19, T31N -Rl6W, Town of Cylon. Bezek went over the staff report with the committee, stating that it meets the County Plan. The Town of Cylon has recommended approval of the request. Pete Kling, applicant, handed out a copy of the preliminary certified survey map. Kling explained that a friend of the family would like to purchase two lots. One lot would be 3 acres and the other would be 5 acres. The 5 acre lot would not be further subdivided and a deed restriction will be put into place to keep this from any further subdivision. There was no opposition to the request. There was no opposition to the request. Hearing recessed. Motion by Burri, seconded by Habhegger and carried to approve the rezoning request to rezone 8 +/- acres of land from Ag to Ag /Residential and forward to County Board for approval. The approval was based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. None of the site is environmental corridor. 3. The site has access to won roads to the north and west, 21.0` Avenue and 200` Street. 4. Surrounding zoning is exclusive ag to the south and east and ag residential to the north and east. 5. The Town of Cylon has reviewed the rezoning and recommends approval after considering §91.77 in making their recommendation. The rezoning will be placed on the January County Board agenda. Grant Fleischauer: The request is to rezone approximately 8 +/- acres of land from Agriculture to Ag /Residential. Location: The NW 1 /4 of the NE 1 /4, Section 6, T29N -R16W, Town of Baldwin. 1 e Jason Paukner, of Humphrey Engineering, represented Fleischauer. He went over the proposed certified survey map of the property. The applicant is requesting to sell off 8 acres of the property and then sell the remaining 35 acres with the original buildings on the site. Access to the property is off of County Road DD. The Town of Baldwin has recommended approval of the request. Bezek went over the staff report with the committee stating that the request is consistent with the County Plan. There will only be one additional residence added to the parcel. The existing 35 acre parcel will remain in exclusive ag The hearing was recessed. Motion by Habhegger, seconded by Burri and carried to recommend approval of the rezoning request for 8 acres to be rezoned from Ag; to Ag/Residential, based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. Site access is a County Trunk Highway DD. 3. Surrounding zoning is exclusive ag to the east, south and west and ag residential to the north. 4. Proposed use is a single residential site of 8 acres. 5. According to the applicant, a perk test has been done on the site and it is suitable for onsite treatment. 6. Rezoning the parcel is not in conflict with the St. Croix County Natural Resource Management Plans Goals Il, III and N which encourages protection and preservation of surface waters and wetlands; fish and wildlife habitats; and agricultural land and soils to preserve ecological functions and recreational and scenic values and wildlife habitat. 7. The Town of Baldwin has reviewed the rezoning and recommends approval after considering §91.77 in making their recommendation. The request will be placed on the January County Board agenda. Fee Schedule: Fodroczi explained to the committee that the new subdivision fees went into effect the first of the year, but due to short notice to the public, staff has run into a couple of situations where the new fees have caused a problem on projects that were bid under the old fees, prior to the first of the year. Discussion held. Motion by Habhegger, seconded by Burri and carried to support staff's request to allow the public to submit applications under the old fee schedule through this week.
