PUBLIC HEARING NOTICE
The St. Croix County Planning and Zoning Committee will be conducting a public hearing
on Wednesday, January 12, 2005, at 7:00 p.m. at the St. Croix County Government
Center, 1101 Carmichael Road, Hudson, Wisconsin, to consider the following petition(s):
1) Kim and Robert Boddy and Nancy Clausen Trust to rezone approximately
56 +/- acres of land from Agriculture to Ag /Residential and 20 +/- acres of
land from Ag -II to Ag /Residential. Location: Both properties are located in
the N %2 of the SW' /4 of Section 31, T28N -R1 9W, Town of Troy.
2) Dennis and Janice Johnson and Joyce Peterson to rezone approximately
1.0 +/- acres of land from Commercial to Ag /Residential and 2.08 +/-
acres of land from Agriculture to Ag /Residential. Location: Both properties
are located in the NE % of the NW ' / 4 of Section 19, T31 N -R1 7W, Town of
Stanton.
Information on this petition may be obtained from the office of the Planning and Zoning
Department, Hudson, St. Croix County, Wisconsin. In the case of cancellation of this

Committee members present: Supervisors Jan Zoerb, Brian Hurtgen, Wally Habhegger and
Buck Malick. Lois Burri was absent and excused. Staff present: David Fodroczi and Bob
Bezek
Chairman Zoerb called the meeting to order at 7:00 p.m.
The next meeting is January 25, 2005 at the Government Center in Hudson.
Zoerb explained the hearing process and opened the hearing. The hearing notice was read.
Kim and Robert Boddy/Nancy Clausen: The request is to rezone approximately 21 +/- acres of
land from Ag -II to Ag/Residential. Location: The NW 1 /4 of the SW 1 /4 and the NE 1 /4 of the SW 1 /4
of Section 31, T28N -R1 9W, Town of Troy.
Louie Filkins of Ogden Engineering represented the applicants. The Boddys would like to
rezone this property to Ag/Residential and then add this piece: onto 40 -acres they intend to
purchase from the Clausen Trust. The request of the Clausen Trust is to rezone 56 acres from Ag
to Ag/Residential and sell 40 -acres to Boddys. This will leave a 60 -acre Ag/Residential parcel
( Boddys) and a 16 acre Ag/Residential parcel (Clausen Trust).
Bezek presented the staff report to the committee. The request is consistent with the County
Plan and the Town of Troy has recommended approval of the two requests.
The committee discussed the current zoning and lot layout. They reviewed the CSM
requirements and intentions. Zoerb added that if this is approved, there needs to be two
ordinances prepared for County Board, showing the rezoning of each separate parcel.
Motion by Habhegger, seconded by Malick and carried to approve the rezoning requests and to
forward onto the County Board for approval, based on the following findings:
1. The parcel is in the rural planning area and is an appropriate use.
2. Access to the site is off Ilwaco Road to the South. The 56 -acre site can also access
County Road F to the east.
3. The applicant states that the rezoning request is to allow the Boddys to purchase
approximately 40 acres from Clausen to add to their existing 20 acres. They intend to
continue farming the 60 -acre site. The remaining Clausen site will be approximately 16
acres.
4. The applicant states that the site was reviewed under the Town of Troy's 40/60 Farm Plan
provisions in the subdivision ordinance. The site has 17 -lot development potential and 15-
acres of open space required. A conservation easement will be placed on 15 -acres
including the existing farm buildings and the best land in the southwest portion of both
sites.
5. The Town of Troy has reviewed the rezoning and recommends approval after considering
§91.77 in making their recommendation.

Dennis Johnson, Janice Johnson, Joyce Peterson:: The request is to rezone approximately
2.08 +/- acres of land from Agriculture to Ag/Residential and 1.0 +/- acres of land from
Commercial to Ag/Residential. Location: The NE' /4 of the NW %4, Section 19, T3 IN-RI 7W,
Town of Stanton.
Dennis Peterson represented the applicants, explaining the history of the parcel. The request for
the two rezonings is to allow the applicant to create one 3.08 acre lot on the property. This
would get rid of a non - conforming situation and make it into a legal lot.
Bezek reviewed the staff report with the committee. The request is consistent with the County
Plan. The applicant appeared before the Town on the request, but the Town of Stanton has not
stated their approval in writing. The staff will confirm this approval. The staff will prepare two
separate ordinances for the County Board to approve.
Discussion held by the committee. Motion by Hurtgen, seconded by Habhegger and carried to
recommend approval of the request to County Board, based on the; following findings:
1. The parcel is in the rural planning area and is an appropriate use.
2. This site consists of an existing home, garage and three; outbuildings surrounded by
some woods and open land.
3. There are no areas with limitations for Private Onsite VVastewater Treatment Systems
(POWTS).
4. The entire site has probable sand deposits. The site does not have probable gravel
deposits.
5. The site has access to a town road to the north, 210` Avenue.
6. Surrounding land uses include open land to the south and east and small acreage
residences or parcels to the north and west.
7. Surrounding zoning is exclusive ag to the south and east and ag residential to the
north and west.
8. Proposed use is one residential site of three acres.
9. Potential development is one residential site.
10. The applicant states the existing house on this site is a nonconforming use on a
commercially zoned lot. There would be no change to the existing use.
11. Rezoning both of these parcels would make a non - confirming commercial lot a
conforming residential lot.
12. The Town of Stanton has reviewed the rezoning and recommends approval after
considering §91.77 in making their decision.
