Staff present: Robert Bezek and Deb Murphy Chairperson Zoerb called the meeting to order at 6:00 p.m. Next Meeting: March 8, 2005 at the Government Center in Hudson Minutes: Motion by Habhegger, seconded by Burn and carried to adopt the February 8, 2005 minutes. Motion by Burri, seconded by Malick and carried to adopt the February 17, 2005 minutes. Sunset Landings Concept Review (Town of St. Joseph): A discussion was held by the committee on the concept plan for the plat of Sunset Landings. Malick handed out suggested conditions for the committee if they decide to recommend approval of the concept, and the committee reviewed. Bezek went over a letter received from the DNR regarding a biological assessment of threatened and endangered species that was done in the area. This data is in the Natural Heritage Inventory database and the DNR does not believe more data is needed for purposes of state law. Motion by Malick seconded by Habhegger and carried to approve the concept plat of Sunset Landings and to allow the plat to be moved onto the preliminary plat stage with the following six conditions: 1. Obtain DNR chapter 30 permit. 2. Satisfy Board of Adjustments conditions. 3. Mitigate for disturbance of natural features, environmental sensitivity, adverse effects of cut and fill, impervious cover, alteration of natural features, etc. per ordinance a) Maximum 10% impervious surface on subdivision and on each lot. b) Long -term bond for future replacement of mature trees (map them now), which now screen the river, with big saplings. c) Provide wildlife habitat throughout the earth - moving phase of development of the subdivision by growing temporary vegetation as indicated by county biological assessment of site. If appropriate, tall, dense, woody vegetation shall be established on the cleared power line easement (the temporary mitigation site) before existing trees and other woody vegetation are disturbed on slopes exceeding 20% grade in the proposed subdivision (the site requiring mitigation). The acreage of the temporary mitigation site shall substantially equal the area of the site requiring mitigation. The tall, dense, woody vegetation to be grown on the temporary mitigation site shall be suitable for habitat for the wildlife previously using the site requiring mitigation, during the season(s) of use by the wildlife. After earth moving on the subdivision is completed, tall, dense, woody vegetation suitable for habitat for the wildlife previously using the site requiring mitigation shall be established and the temporary mitigation site may be returned to it's previously cleared condition at the developer's option. d) Provide analysis for decision of whether culverts or bridges for the two deep valleys. 1 4. Provide actual homeowner covenants or easement terminology authorizing the Town to ` go upon cut /fill slopes for trash removal, repair, vegetation management, etc. with minimal notice to residents. 5. Obtain approvals by pertinent Riverway agencies (National Park Service Corps of Engineers, WDNR, Lower St. Croix Management Commission) of the details concerning any access by the subdivision residents to the river. 6. Obtain Wisconsin D.O.T and Highway Department approvals of US 35 intersection. Teresa Johnson, Chair for the Town of St. Joseph, reminded the committee about the roads on this plat being under town jurisdiction. She state that the town would not go along with trees being planted in the road right of way and the town is not in favor of having to deal with a bridge, as has been suggested by the committee. Bridges are too hard to maintain. Discussion held on the benefit of culverts vs. bridges for habitat movement. Johnson reiterated that the town would prefer culverts be used rather than have a bridge installed. Johnson then addressed the committee on the issue of condemnation of the Butke property for a road into the Richards property. She said that the Town of St. Joseph has clearly stated their position on this issue, and wants no part of the condemnation or eminent domain. They will not partner with the county on this, and have chosen to move forward with the preliminary plat on Sunset Landings. This will be discussed on the March 3 rd agenda at the Town. Bills and Invoices: Chairperson Zoerb reviewed and signed the bills and invoices report for the month of January. New Business: Chairperson Zoerb opened the hearing. The public hearing notice was read into the record. 1) Clarence Morten to rezone approximately 44 +/- acres of land from Agriculture to Ag/Residential. Location: Part of the NW 1 /4 of Section 31, T31N -R19W, Town of Somerset. 2) Marvin Utecht to rezone approximately 45 +/- acres of land from Ag/Residential to Agriculture. Location: The SE 1 /4 of the NW 1 /4, Section 11, T29N -R16W, Town of Baldwin. Clarence Morten: Greg Ethington, with JEO Consulting, represented the owner. The request is to divide the property into 2 lots, one lot being 34 acres and one lot being 10 acres. The Town of Somerset has approved of the request. Bob Bezek gave a PowerPoint presentation to the group of the property, going over the maps and the staff report. The request is consistent with the county plan and the town plan. There is another subdivision close to this property, in Polk County. There are some wetlands on the property. The site has road access. Jane Hudalla, an adjoining property owner at 2380 45 St., Osecola, pointed out on the maps where the wetlands are. She stated that the property tends to be very wet, and thinks it would be difficult to find a spot that would perk. There is a lot of wildlife on this property and would like it to remain that way. 2 _ Discussion was held by the committee and questions raised on the wetlands and environmental corridors on the property. It was suggested that the applicant provide a concept plan as to what the owner would like to do with the property. Motion by Malick seconded by Hurtgen and carried to table the request. The committee would like more information on this site regarding the impact to wetlands and the environmental corridors. Marvin Utecht: Jackie Henderson -Kumm represented the Mr. Utecht. The request is to rezone this parcel in order to add it onto two non - conforming ag parcels to bring them into compliance and meet the 35 -acre minimum requirement in the Agricultural District. The request is to rezone approximately 31 acres from Ag/Residential to Exclusive Ag to add onto another ag parcel of 33- acres to create a 64 -acre agricultural parcel. They also want to rezone approximately 15 acres from Ag/Residential to Exclusive Ag to add onto an existing ag parcel to create a 40 -acre parcel. Discussion by the committee. Motion by Malick, seconded by Biuri and carried to approve the request to rezone approximately 45 acres from Ag/Residential to Agriculture and forward to County Board, based on the following findings: 1. The parcel is being zoned from Ag/Residential back to Agriculture to be added onto an existing Agricultural parcel to bring the property into conformance. 2. The Town of Baldwin has recommended approval. Staff will forward onto County Board. Woodview Ridge Preliminary Plat: The committee went over the map showing the lots and easements on the property. Discussion held with the owner. Motion by Habhegger, seconded by Hurtgen and carried to approve the preliminary plat for Woodview :Ridge with the following conditions recommended by staff. 1) Submit financial guarantees for construction of joint accesses; 2) Town approval is needed; 3) Address any minor editorial comments from the surveyor.
