PLANNING AND ZONING COMMITTEE
ST. CROIX COUNTY AGRICULTURAL CENTER, BALDWIN, WI
July 27, 2005
Supervisors: Jan Zoerb, Brian Hurtgen, Wally Habhegger, and Lois Burri were present. Stan Krueger was
absent and excused. Staff. Bob Bezek, and Debbie Murphy.
Chairperson Zoerb called the meeting to order at 6:30 p.m. to discuss Items 6, 7 and 8 on the agenda.
Old Business
Cornerstone Ridge preliminary plat: Bezek explained that the request for a construction waiver was tabled
until the applicant requested the waiver in writing. Jason Paukner represented the applicant. The request has
been received in writing and the staff recommends approval with the condition that the financial guarantees
and a timetable be submitted to the Planning and Zoning Department. Motion by Hurtgen, seconded by
Habhegger and carried to approve the construction waiver for Cornerstone Ridge preliminary plat, with the
conditions recommended by staff.
Hudson Business Center preliminary plat: Bezek explained that this request is also for a construction
waiver and was tabled until the applicant requested the waiver in writing. Jon Sonnentag represented the
applicant. The waiver request has been received in writing and the staff recommends approval with the
condition that the financial guarantees and a detailed plan be submitted to the Planning and Zoning
Department. Motion by Habhegger, seconded by Burri and carried to approve with the conditions
recommended by staff.
The committee recessed from 6:35 pm to 7:00 pm.
Chair Zoerb explained the hearing process and opened the hearing at 7:00 p.m. The public hearing notice
was read into the record.

The St. Croix County Planning and Zoning Committee will be conducting a public hearing on Wednesday,
July 27, 2005, at 7:00 p.m. at the St. Croix County Agricultural Center, 1960 Eighth Avenue, Baldwin,
Wisconsin, to consider the following petition(s):
1) Roger and June Lindquist Limited Partnership to rezone approximately 20 +/- acres of land
from Agriculture to Ag/Residential. Location: The NE '/4 of the NW ' /4, Section 13, T28N-
R17W, Town of Rush River.
2) John Hilsen to rezone approximately 84 +/- acres of land from Agriculture to
Ag/Residential. Location: The SE ' /4 of the NW ' /4, the NE ' / 4 of the SW ' /4, the SE ' /4 of
the SW ' /4,all in Section 11, T30N -R19W, Town of Somerset

Roger and June Lindquist: Bezek explained that the request is to rezone approximately 20 -acres of land
from Ag to Ag/Residential. The applicant is purchasing an old church from his congregation and plans to
move the church onto a new foundation on a 20 -acre site. The plan is for the applicant to live in the basement
of the new site, and leave the church in its original state. The applicant may request to use the church for
public use sometime in the future, but for not it will be vacant. Bezek presented information through a
PowerPoint presentation, and went over the staff report. The staff recommends approval of the request.
Roger Lindquist, applicant, explained that he did not want to see the church torn down, so decided to move
onto his land and live in the basement during the summer months. He reiterated that they may look at using it
for public use in the future, and realize they would need permits to do this. The building is on the State
Historical Register, and is structurally sound.
Don Schumacher, Chair, Town of Baldwin, spoke on behalf of the town, stating that the town supports this
request and that they commend Lindquist for preserving this building. Delores Vrieze, and Leroy Lindquist
also spoke in favor of the request. Mary Eskola has concerns if the church is used for the public. Staff stated
that all adjoining property owners would be notified before any hearing in this matter.
Hearing closed. Discussion held. Motion by Habhegger, seconded by Burri and carried to approve the
request for rezoning from Ag to Ag/Residential based on the following findings:
1. The Town of Rush River has recommended approval and identified that the proposed use is in
compliance with WSS 91.77.
2. It appears that the proposed use can comply with standards in the Land Use, Subdivision and
Sanitary ordinances.
3. The parcel is in the rural planning area and is an appropriate use.
4. The proposed use is consistent with minimum lot size requirements identified in the Town Plan
for Rush River.
5. The request is consistent with the surrounding neighborhood, countryside or terrain.
6. The proposed use does provide a buffer for residential development from nearby agricultural uses
or non - metallic mining.
7. The proposed use has little potential to adversely impact stormwater management.
8. The proposed use has little potential to adversely impact water resources with sedimentation
resulting from erosion.
9. The proposed use has little potential to adversely impact shoreland areas or wetlands and closed
depressions located in shoreland areas.
10. The proposed use has little potential to adversely impact closed depressions or wetlands.
11. The proposed use is consistent with restricting development on slopes in excess of 20 %.
12. The proposed use is generally consistent or not in conflict with the St. Croix County Natural
Resources Management Plan.
13. The proposed use is consistent with the spirit and intent of the ordinance.
With the following condition:
1. Prior to the issuance of a building permit or occupancy permit for a use on the rezoned parcel, the
landowner shall cause a certified survey map to be made of the property and filed with the
register of deeds.
The request will be forwarded to the County Board for the August 16 meeting.
John Hilsen: Bezek explained that the request is to rezone approximately 85 -acres of land from Ag to
Ag /Residential for future development. Bezek went over the staff report, and presented information through
a PowerPoint presentation. The Town of Somerset has not submitted a recommendation at this time.

Harold Rivard, agent for the applicant, stated that there is an easement for the road for access. Ag /Residential
property surrounds this piece of Ag land. The Town of Somerset Planning Commission has recommended
approval and the Town board meets August 3r to review this application.
Hearing closed. Discussion held. Motion by Habhegger, seconded by Burri and carried to table the rezoning
request until the Town of Somerset submits a recommendation.
Scott Owens: This request is to rezone approximately 5 -acres of land from Ag to Ag /Residential to
allow the applicant to locate his family farm machinery business on the property, which is now on his
brother's property. This type of business is only allowed in the Ag/Residential District. Bezek went over
the staff report, and presented information through a PowerPoint presentation. The Town of Pleasant
Valley has submitted a letter approving the rezoning request. The county supports the request.
Scott Owens, owner of the property, went over the request reiterating that this is a family business that he
would like to locate on his property, as he has purchased the business from his father. This business is for
sales and servicing of equipment, and generates the most business between May and August.
There was no opposition to the request.
Hearing closed. Discussion held by the committee. Motion by Habhegger, seconded by Hurtgen and carried
to recommend approval of the request to rezone approximately 5 -acres from Ag to Ag/Residential in the
Town of Pleasant Valley, based on the following findings:
1. The Town of Pleasant Valley has recommended approval and identified that the proposed use is
in compliance with WSS 91.77,
2. The proposed use can comply with standards in the Land Use, Subdivision and Sanitary
ordinances.
3. The parcel is in the rural planning area and is an appropriate use.
4. The proposed use is consistent with minimum lot size requirements identified in the rural
planning area.
5. The proposed non - residential use is consistent with the rural character of the area and is otherwise
essential to the area.
6. The request is consistent with the surrounding neighborhood, countryside or terrain.
7. The proposed use has minimal potential to adversely impact stormwater management and can be
easily managed.
8. The proposed use has minimal potential to adversely impact water resources with sedimentation
resulting from erosion.
9. The proposed use has minimal potential to adversely impact shoreland areas or wetlands and
closed depressions located in shoreland areas.
10. The proposed use has minimal potential to adversely impact closed depressions or wetlands.
11. The proposed use is consistent with restricting development on slopes in excess of 20 %.
12. The proposed use is consistent with policies to preserve woodlands, prairie remnants, unique
open spaces, or environmental corridors.
13. The proposed use is generally consistent or not in conflict with the St. Croix County Natural
Resources Management Plan.
14. The proposed use is consistent with the spirit and intent of the ordinance.
With the following condition:
1. Prior to the issuance of a building permit or occupancy permit for a use on the rezoned parcel, the
landowner shall cause a certified survey map to be made of the property and filed with the
register of deeds.
The request will be forwarded to County Board.

Dale and Debra Wikre and Wisconsin DNR: This request is to allow a land swap between the DNR and
the Wikre's, by rezoning 1.94 acres from Ag/Residential to Conservancy ( Wikres) and 0.21 acres of land
from Conservancy to Ag /Residential (DNR). The DNR would add the 1.94 acre piece of land onto some
existing Conservancy land that they own along the Apple River. This addition would connect some existing
parcels owned by the DNR. The Wikres would obtain 0.21 acres of land for their property. Bezek went over
the request with a PowerPoint presentation. The Town of Somerset has not acted on this request, but the
owners on the agenda for an upcoming meeting.
Harvey Halvorson, with the DNR, spoke on behalf of the DNR and the Wikres. Halvorson went over the
maps with the committee pointing out that there will be no further development in this area long the Apple
River. Access to the property is from County Road I.
Joe Jahnke, 1951 County Road 1, is an adjacent landowner to the east. He had questions on the survey map.
Halvorson stated that the survey was done by Joel Brandt and Jahnke should contact Brandt with questions.
There was no opposition to the request. The County supports the rezoning request.
Hearing closed. Discussion held. Motion by Habhegger, seconded by Burri and carried to table the request
until a recommendation is received from the Town of Somerset. This item will be placed on the August 9 "
Planning and Zoning agenda for a decision.
