CROIX COUNTY GOVERNMENT CENTER, HUDSON, WI May 5, 2005 Supervisors: Jan Zoerb, Brian Hurtgen, Wally Habhegger and Buck Malick were present. Lois Burri was absent and excused Staff: Bob Bezek, and Debbie Murphy. Chairperson Zoerb called the meeting to order at 7:00 p.m. Next Meeting: The committee scheduled May 10, 2005 to conduct a site visit of the Hills of Troy and Ault properties. They will meet at the Government Center at 8:30 a.m. David Ault Variance Request- tabled April 26,2005: Bezek informed the committee that staff has received a letter from the applicant requesting that their variance be tabled until the committee has had a chance to view the site, and for the applicant to gather the requested information. The reason for the letter was to agree that the committee may extend the decision past the 10 days that is required for the committee to make a decision in this matter. Staff will bring this request back to the committee when the information is received from the applicant. Motion by Hurtgen, seconded by Habhegger and carried to accept the applicant's request. New Business: Chairperson Zoerb opened the hearing. The public hearing notice was read into the record. 1) Lynn and Nila Forrest to rezone approximately 7 +/- acres of land from Agriculture to Ag/Residential. Location: Part of the fractional NW 1 /4 of the NW 1 /4, Section 7, T30N -R17W, Town of Erin Prairie 2) Ronald and Diane Beauvais to rezone approximately 10 +/- acres of land from Agriculture to Ag/Residential. Location: Par of the, NW 14/ of the NW 1 /4, Section 7, T30N -R1 7W, Town of Erin Prairie. 3) Leonard and Margaret Ann DesLauriers/ Troy Development Corp. to rezone approximately 83 acres of land from Agriculture to Ag/Residential. Location: The W % of the NE %4 and the E 1 /2 of the NW 1 /4, Section 11, T29N -R19W, Town of Troy. 5) Ron and Helen Handlos /Troy Development Corp. to rezone approximately 69 acres of land from Agriculture to Ag/Residential. Location: The NE 1 /4 of the NE 1 /4 and the SE 1 /4 of the NE 1 /4, Section 11, T29N -R1 9W, Town of Troy. Lynn and Nila Forrest: Bezek explained that the request is to rezone approximately .69 acres of land from Ag to Ag/Residential in order for the applicant to add this acreage onto two existing parcels. The initial request was to rezone 7 acres, but the Town of Erin Prairie disapproved that request. They did, however, approve the .69 acre rezoning request. The land was acQUir - 41 - - applicant through a Trust. Bezek presented information through a PowerPoint went over the maps and the staff report with the committee. The request is con . surrounding land uses, and complies with the County Plan. There are no wetlar. property. The Town of Erin Prairie has recommended approval of the request. i Lynn Forrest, Jr., owner of the property, reiterated staff's comments, and added that this land is not good land for growing crops. Ron Beauvais, relative of Forrest, added that the land was given to • family members through a trust and supports the rezoning request. There was no opposition to the request. Discussion was held by the committee. Motion by Malick seconded by Bum and carried to table the request until the Town considers §91.77 in making their decision. Motion carried. Ronald and Diane Beauvais: Bezek explained that the request to rezone approximately two acres of land from Ag to Ag/Residential is very similar to the Forrest request. The Beauvais family also acquired this land through a Trust. The two acres to be rezoned are for a child of the applicant to build a home. The initial request was to rezone 9 acres, but the Town of Erin Prairie disapproved that request, but did approve the rezoning of two acres. Bezek presented information through a PowerPoint presentation and went over the maps and the staff report with the committee. The request is consistent with surrounding land uses, and complies with the County Plan. There are no wetland concerns on this property. The Town of Erin Prairie has recommended approval of the request. Ron Beauvais, Jr., owner of the property, reiterated staff's comments, and added that there are only about seven farms left in the entire town and stated that this land is not good land for growing crops. There is no Farmland Preservation on the property. Lynn Forrest stated that he supports the rezoning request, and agreed that this is very poor farmland. There was no opposition to the request. Discussion was held by the committee. Motion by Malick seconded by Burn and carried to table the request until the Town considers §91.77 in making their decision. Motion carried. Troy Development Corp. (Leonard and Margaret Ann DesLauriers, North Dakota State University, Ron and Helen Handlos): Bezek explained that this rezoning request is being made by Troy Development Corp., but there are three separate properties involved. Troy Development plans to purchase these three properties for a development, "Hills of Troy", that is currently in the preliminary stages. Bezek gave a PowerPoint presentation on the request, going over the maps and the staff report with the committee. The request is consistent with surrounding land uses and is consistent with the County Plan. The Town of Troy has recommended approval of the request, and the request is consistent with the Town Plan. Chuck Cook and Craig Lilja spoke on behalf of Troy Development Corp. There are 135 lots proposed on this property. A Conservation Easement Agreement has been drawn up by the Troy town attorney, and all parties have signed the agreement. There are no road access issues. Bob Penshom and Pat Schultz stated they had concerns with roads, lighting and wetlands in the area. Craig Lilja addressed the concerns of the property owners by stating that they have been working with the DNR and Corps of Engineers and will abide by whatever is required by these two agencies. Leonard DesLauriers added that they have never had problems with wetlands in the 40 years they have been there. It was also noted by Cook that the realignment of County Road U will not impact this property. 2 Discussion by the committee. Motion by Malick, seconded by Hurtgen and carried to table the Handlos request until the committee views the site on May 1 &. Motion by Habhegger, seconded by Hurtgen and carried to table the DesLauriers request until the committee views the site on May 10 th . Motion by Hurtgen, seconded by Habhegger and carried to table the North Dakota State University request until the committee views the site on May l O''. Announcement: Malick told the group that Stan Krueger will replace Malick on this committee starting the next meeting. Malick will be replacing Krueger on the: Board of Adjustment.
