PUBLIC HEARING NOTICE
The St. Croix County Planning and Zoning Committee will conduct a public hearing on
Thursday, May 26, 2005 at 7:00 p.m. at the St. Croix County Government Center (Lower
Level Community Room), 1101 Carmichael Road, Hudson, Wisconsin, to consider the
following:
1) An Ordinance to replace the St. Croix County Land Use Regulations
Chapter 15, Sanitary Code, with a new Chapter 112, Sanitary Ordinance, to
conform with recent changes to the state plumbing code that establish
standards and procedures for permitting individual and common wastewater
treatment systems.
2) An Ordinance amending the Lower St. Croix Riverway Overlay District
Chapter 17 Zoning Code.
For anyone interested in reviewing, or obtaining a copy of these ordinances, please visit the
office of the Planning and Zoning Director, St. Croix County Government Center, Hudson,
Wisconsin, or view it on the County web page at www.co.saint - croix.wi.us. In the case of
cancellation of this hearing, such notice will be announced on WIXK and WEVR Radio
Stations, or call the Zoning Office at 715 - 386 -4680 before 5::00 p.m. on May 26,2005.
Written comments will be accepted through 5 p.m., Thursday, June 2 nd at the Planning and
Zoning Department, Hudson.

St. Croix County Planning and Zoning Committee
May 26, 2005
St. Croix County Government Center, Hudson, Wisconsin
Committee members present: Supervisors Lois Burri, Stan Krueger, Wally Habhegger and
Brian Hurtgen. Jan Zoerb was absent and excused
Staff present: Dave Fodroczi, Robert Bezek, Jenny Shillcox and Deb Murphy
Vice Chairperson Burn called the meeting to order at 7:00 p.m. and explained the hearing
process for the St. Croix Riverway and the Sanitary Ordinances.
Dave Fodroczi gave a summary of the ordinance updates to the group and went over the
timelines for the adoption of the two ordinances. A handout of the revised Sanitary Ordinance
was available for the public, as well as a handout for the proposed Riverway Ordinance. A
discussion was held on extending the comment period for these two ordinances to Friday, June
3 rather than June 2 The Town of Troy meets the evening; of June 2nd and may wish to
submit comments on Friday. It was agreed that the comment period would end at noon on
Friday, June P.
Bob Bezek gave a PowerPoint presentation on the Sanitary Ordinance, pointing out the
highlights of the ordinance and proposed changes since the last public hearing.
There was a question and answer period for the public. Vice Chairperson Burri opened the
hearing to take comments from the public. Fodroczi read the hearing notice as follows:

After the notice was read, the public addressed the committee and staff with the following
comments:
Sanitary Ordinance comments:
Mark Toso - Roberts
• The State of Wisconsin is 10 years behind Minnesota with their Sanitary Ordinance.
Minnesota has had problems with the common systems and we should learn from what
has happened to them, and the problems they have experienced. Some counties in
Minnesota require that the municipalities own the common systems.
• Most systems have a short lifetime (15 years) and common systems are very expensive
• Wants to know how the county will fix a large system that fails.
• Thinks the municipality has to own the common systems and is concerned about cost
controls of the system.
• Works at the MACA and is a groundwater hydrologist, and sees potential problems with
the common systems.
• Multiple discharge sites should be recommended.
• Each home should have a septic tank
• Large systems would pollute more if there were a problem.
Frank Phillips — Roberts
• Suggested that 10 -ppm (parts per million) total nitrate level should be adopted for the
common systems.
• Concerned about the nitrate problem around the county.
Bruce Elliott — Town of Warren
• Is in favor of the common systems, but wants to pre -empt the problems before they
occur. There are very high nitrates in Warren.
Bob Rollie — Town of Troy
• Common systems are a good thing and believe that smaller lots should be allowed for
these kinds of systems.
Bill Berndt (On behalf of the Homebuilders Assoc. and the Realtors Assoc.)
• Is strongly in favor of the new Sanitary Ordinance that is proposed, and will enhance and
protect our area.
• This is an improvement over what is currently in place.
• Clustering is a good way to develop the land in this county.
• Some of the issues that have been raised at this hearing should be taken up at the state
level.
• Would be willing to help put together a working group that would address some of these
issues and help with all of this.

St. Croix Riverway Ordinance
Fodroczi informed the group that the Riverway Ordinance presentation will be much like the
Sanitary Ordinance presentation. Handouts were available for the public. Jenny Shillcox, Zoning
Specialist, will present the information. Fodrociz introduced Bob Baczynski of the DNR.
Baczynski gave a brief overview of N.R. 118 to the group, before the county presentation.
Shillcox then addressed the group, giving a PowerPoint presentation on the proposed Riverway
Ordinance. She went through the ordinance section by section, pointing out that the Riverway
Ordinance is a stand -alone ordinance. She explained the new definitions: footprint, bluffline
and slope preservation zone. The new standards allowed in N.R. 118 were also explained.
There was a question and answer period for the public. Vice Chairperson Burri opened the
hearing to take comments from the public
St. Croix Riverway Ordinance comments:
Frank Ogden — River Falls
• Has worked with the St. Croix River issues since 1969.
• Handed out a comment sheet to the staff, committee, and any interested public. Ogden
went over the comments with the group. Comments are attached to the minutes.
• Main concern is that there are requirements that are being put into the ordinance that are
not in N.R. 118 and he does not believe they need to be there. A lot of work went into
N.R. 118, with many people involved, and the county should not be making more
restrictive rules than N.R. 188.
Paul Mosby — Town of Clifton (Pierce County)
• Lives on the St. Croix River and President of the St. Croix River Landowner's
Association.
• Has suggested to Pierce County to use N.R. 188 as a guideline for their Riverway
Ordinance.
• Concerned about over - regulation of the St. Croix River.
• Property owners on the St. Croix are very concerned about their property and want to
keep it scenic. Have no intention of negatively impacting the river.
• Agrees with Frank Ogden's comments.
• The county needs to use commons sense in putting together this ordinance.
• Thinks that there are things in the proposed ordinance that are unacceptable
• The Lower St. Croix Riverway group has met for over 4 years to put together suggestions
for the revision of N.R. 118. There were state and county people involved in this group,
with a good outcome.
• The county should be aware that the DNR will "hold your feet to the fire" on this
ordinance.
Bob Rollie - Troy
• Basically a good ordinance.
• Asked the staff to look at page 20, S. c. Should be look at changing the wording on
mitigation for tree planting trees to be similar to what the Town of Troy is proposing in
their ordinance. He will send a copy of this wording to the county with the town
comments.

• He does not believe you can charge for a permit for docks.
• Has concerns with lighting language in the ordinance, and thinks it is totally
inappropriate and should be eliminated (17.36 -15 (2).
• Concerned with tree replacement schedule, and thinks it is inappropriate.
• The Town of Troy has a Riverway Ordinance that has been approved by the DNR and
they will be asking to be exempt from the County Riverway Ordinance. They would like
the committee to consider this.
Joe Merchak — Trov
• Concerned with the expense for the property owners in getting approvals, and the time it
takes to get through the process.
• Would like to see the one -year time limit on permits taken out.
• Thinks non - conforming structures language and 12% slope language is too restrictive. If
the structures meet the spirit and intent of the Riverway Ordinance, need to take a look at
that.
• It is important to look at what kind, if any, impact a request actually has on the river.
_Charlie McDonald — Trov
• Complimented the staff on all of the hard work that went into the ordinance.
• Supports the comments made tonight.
• Problems arise for citizens when there are many different governing agencies involved
in the process, and several different rules. He suggests keeping in line with N.R. 188,
rather than adding things into the ordinance that may not be essential.
• Supports Troy's ordinance and if it meets all the requirements of the DNR, would like
the county to accept Troy's ordinance and honor their request.
Rich Lindholm — Trov
• Would like to see the county follow N.R. 188 and not add other things into the ordinance
that are not necessary.
• Homeowners on the river want to keep this river beautiful and natural.
• The county needs to use common sense in writing this ordinance.
After all comments were received, Burri concluded that the hearing was over. Burn declared the
hearing adjourned at 9:35 p.m.
