The Committee reviewed and discussed the comments. Minor changes affecting common systems ownership and maintenance were finalized. Motion by Burri, 2nd by Hurtgen to recommend the draft with today's revisions for adoption by County Board. Motion carried. Shillcox reviewed handouts summarizing public hearing comments on the Lower St. Croix Riverway Overlay District. The Committee made several revisions in response to the comments during a section -by- section review. Motion by Hurtgen, 2nd by Krueger to recommend adoption by County Board with today's revisions and any language edits from Corporation Counsel. CROIX COUNTY GOVERNMENT CENTER, HUDSON, WI June 8, 2005 Supervisors: Jan Zoerb, Brian Hurtgen, Wally Habhegger, Stan Krueger and Lois Burri were present. Staff: Bob Bezek, and Debbie Murphy. Chairperson Zoerb called the meeting to order at 7:00 p.m. Next Meeting: The committee scheduled June 14, 2005. Minutes: Motion by Burri, seconded by Habhegger and carried to approve the May 26, 2005 minutes with one correction. Old Business: Ronald and Diane Beauvais: Bezek explained that the request was tabled on May 5 th by the committee for additional information regarding and easement on the property. The easement has been furnished by the applicant's surveyor. The Town has approved of this request and has approved the concept map for the property. The road will be built to town standards. Short discussion held. Motion by Burri, seconded by Hurtgen and carried to approve the request to rezon2.0 acres of land from Ag to Ag/Residential, and to forward to county board, based on the following findings: 1. Adequate access to the site exists off of 150`" St. to the east. Applicant is planning to construct road with cul -de -sac to provide access to the 2.0 acre parcel. 2. The proposed use is consistent with surrounding land uses. 3. The property is not limited for the placement of POWTS. 4. The parcel is in the rural planning area and is an appropriate use. 5. The request is consistent with the surrounding neighborhood, countryside or terrain. 6. Development can be designed to be consistent with environmental policies concerning stormwater management, erosion and sediment control, placement of wells and POWTS, wetland protection, slope preservation, woodland preservation, open space preservation. 7. If rezoned the applicant should be able to meet all applicable Hand use regulations. 8. The Town of Erin Prairie has recommended approval of the rezoning and states that the rezoning does comply with Wisconsin Statutes Chapter 91.77. New Business: Chairperson Zoerb opened the hearing. The public hearing notice was read into the record. PUBLIC HEARING NOTICE The St. Croix County Planning and Zoning Committee will be conducting a public hearing on Wednesday, June 8, 2005, at 7:00 p.m. at the St. Croix County Government Center, 1110 1 Carmichael Road, Hudson, Wisconsin, to consider the following petition(s): 1) Mark K. Doyle to rezone approximately 23 +/- acres of land from Agriculture to Ag/Residential. Location: The NE V4 of the NE '/4, Section 13, T30N -R20W, Town of Somerset. 2) John and Georgine Schottler to rezone approximately 131 +/- acres of land from Agriculture to Ag /Residential. Location: The SW '/4 of the NW ' / 4, the NE ' / 4 of the SW ' /4, the NW '/4 of the SW '/4, the SE %4 of the SW '/4, all in Section 34, T30N -R19W, Town of St. Joseph. 3) Lester Langness to rezone approximately 65 +/- acres of land from Agriculture to Ag/Residential. Information on this petition may be obtained from the office of the Planning and Zoning Department, Hudson, St. Croix County, Wisconsin. In the case of cancellation of this hearing, such notice will be announced on WINK and WEVR Radio Stations, or call the Planning and Zoning Office Department at 715- 386 -4680 before 5:00 p.m. Jan Zoerb, Chairperson Planning and Zoning Committee Mark Doyle: Bezek explained that the request is to rezone approximately 22.6 acres of land from Ag to Ag/Residential. Due to the reconstruction of Hwy 35 -64, this parcel has become non - conforming and includes a 1.4 acre parcel that was severed from the majority of the existing parcel. The intent is to combine the 1.4 acres of property with another parcel of land and sell off 3- acres. 'The remaining acreage will continue to owned by the applicant. Bezek gave a PowerPoint presentation on the! request, going over the maps and the staff report with the committee The request is consistent with surrounding land uses, and complies with the County Plan. The Town of Somerset has not submitted a recommendation. Mark Doyle stated that the staff's presentation was accurate, and reiterated that he wants to combine this acreage with an Ag/Residential parcel to sell to a third party. He further stated that he still needs to go to the Town of Somerset for approval. Cheryl Carlson, neighboring property owner, expressed concerns with run -off from the property onto their property. Bezek explained that if this property is developed, stormwater run -off would be addressed by the Land and Water Conservation Department. Dave Pierce, neighboring property owner, stated that there would be no impact to his property from this parcel being rezoned. Discussion held. Motion by Habhegger, seconded by Krueger and carried to table the request until a recommendation is received by the Town of Somerset. John and Georgine Schottler: Bezek explained that the request is to rezone approximately 130.55 acres of land from Ag to Ag/Residential for future development. Bezek presented information through a PowerPoint presentation and went over the maps and the staff report with the committee. The request is consistent with surrounding land uses, and complies with the County Plan. The Town of St. Joseph has recommended approval of the request. John Schottler, owner of the property, reiterated staff's comments, and added that there are no immediate plans for development, but may develop in the future. There was no opposition to the request. Discussion was held by the committee. Motion by Habhegger seconded by Krueger and carried to approve the request and forward to county board based on the following findings: 9. The proposed use is consistent with surrounding uses. 10. The property is not limited for the placement of POWTS. 11. It appears that the proposed use can comply with standards in tehLand Use, Subdivision and Sanitary ordinances. 12. The parcel is in the rural planning area and is an appropriate use. 13. The proposed us is consistent with the minimum lot size requirements in the rural planning area. 14. The request is consistent with the surrounding neighborhood, countryside or terrain. 2 15. The proposed use is consistent with restricting development on slopes in excess of 20 %. 16. The Town of St. Joseph has recommended approval of the rezoning and states that the rezoning does comply with Wisconsin Statutes Chapter 91.77. Lester Langness: Bezek explained that this rezoning request is to rezone 65.49 acres of land from Ag to Ag/Residential for future development. Bezek gave a PowerPoint presentation on the request, going over the maps and the staff report with the committee. The request is consistent with surrounding land uses and is consistent with the County Plan. The Town of St. Joseph has recommended approval of the request, and the request is consistent with the Town Plan. Ed Flanum of Northland Surveying, represented Langness. He stated that the staff report and presentation was accurate, and that the owner did not have any immediate plans for developments. The property is currently in Farmland Preservation, but the paperwork is in progress to get out of this program. Discussion was held by the committee. Motion by Habhegger seconded by Krueger and carried to approve the request and forward to county board based on the following findings: 1. It appears that the proposed use can comply with standards in the Land Use, Subdivision and Sanitary ordinances. 2. The parcel is in the rural planning area and is an appropriate use. 3. The request is consistent with the surrounding neighborhood, countryside or terrain. 4. The proposed use is consistent with restricting development on slopes in excess of 20 %. 5. The Town of St. Joseph has recommended approval of the rezoning and states that the rezoning does comply with Wisconsin Statutes Chapter 91.77. New Horizon Homes: Bezek explained that this rezoning request is to rezone 13 acres of land from Ag /Residential to Commercial for future development. Bezek gave a PowerPoint presentation on the request, going over the maps and the staff report with the committee. Bezek stated that the City of New Richmond may have some concerns with this request. The Town of Richmond has approved of the rezoning request. Jerry Ripley, JEO Consulting Group, represented Horizon Homes. A warrants analysis has been done on the property. The request is to allow the property owner to add a small parcel of land onto an existing commercial property to the south, and another add -on to a commercial piece of property to the north. The current commercial property has a model home business located on it, and there is a new structure now going up on the property, as well. Questions were raised on the expansion of the business. Bezek stated that the expansion would need a special exception permit to be in compliance with the ordinance. Discussion held with the committee on DOT issues off of Hwy 65, and on what authority the City of New Richmond has over this request, as part of their extraterritorial area. Motion by Habhegger, seconded and carried by Burri to table the request until information is submitted from the City of New Richmond regarding their extraterritorial plat authority, information is gathered regarding how the propose Hwy 65 and County Road G interchange will affect the site, and review the existing special exception permit that New Horizon Homes is operating under.
