Community Development Staff has reviewed the submitted land use permit application for the construction of
a new dwelling in the footprint of an existing non -conforming dwelling in a shoreland overlay zoning district
and the a floodfringe. The request has been conditionally approved based on the application submittal and
the following findings:
• The single-family dwelling is located in the Town of Star Prairie, within the R-2 Residential Zoning
district, where the use is permitted -by -right
• The dwelling is located within the floodway of the Cedar Lake floodplain;
• The dwelling is located within the shodand overlay zoning district of Cedar Lake;
• The structure is legal nonconforming due to the following:
o Setback to the ordinary high -watermark:
o Setback to the side and front property lines;
o The structure is elevated with fill by means of reduced standards than those listed in Section
18.415;
• The lot is legal nonconforming due to not meeting the 1.5 acres minimum lot size for the R-2
Residential zoning district;
• The lot is considered to be a "Lot of Record" existing prior to 1968 for Shoreland Overlay Zoning
proposes;
• A permit to update the private omsite wastewater treatment system (POWTS) has been submitted to
the Community Development Department but is incomplete as of the date of this letter.
• The regalhory floodplain elevation for Cedar Lake is 921 feet
• On December 22, 2022, The Board of Adjustment had approved variance request VAR-2022-008 to
allow for the construction of a new dwelling in a floodplain by reducing the standards for elevating a
dwelling with fill, requiring a land use permit be filed with the Department along with a stormwater
management plan.

Based on the findings, approval of this land use permit are subject to the following conditions:
1) The construction of the dwelling and the modifications to the lot shall be in accordance with the
submitted building elevations dated January 31, 2023, and the site plan dated January 30, 2023.
2) All mechanicals for the dwelling shall be installed at 2 feet above the regulatory fioodplain elevation
(923 feet).
3) Stormwater best management practices(BMP's) for constructing a dwelling within the 75-foot setback
of the ordinary high-water mark shall be in place for the duration of the construction project.
4) A mi iconstruction inspection shall occur when the foundation is complete, but not before framing
commences.
5) All landscaping shall be completed by September 1, 2023
6) The vegetative buffer zone shall not be disturbed once it is established, including, but not limited to
being mowed, driven over, or removed.
7) The rain garden shall be maintained in pertuity, per the Wisconsin Department of Natural Resources:
dnrwisconsin gov/topic/Stormwater/raingarden.
8) Stormwater generated by the site shall be managed on -site and shall never be divereted to the lake
or off -site to the adjacent parcels or the right-of-way.
9) The on -site sanitary system cannot be installed prior to the approval the permit by Department Staff.
10) It is the applicant's responsibility to obtain all other local, state, and/or federal permits and approvals
associated with this project.
11) Failure to comply with to the conditions listed herein may result in the revocation of this permit by the
Zoning Administrator.
This approval is subject to the conditions listed above: it does not allow for any additional
construction, structures. or buildings beyond the limits of this request. Your information will remain
on file at the St. Croix County Community Development Department suite. This permit is valid for
one year, with the possibility of up to two (2) six-month extensions if the applicant submits the
appropriate permit extension fee and documentation to the Zoning Administrator.
A copy of the Land Use Permit placard should be submitted to the towns local Building Inspector
upon applying for town building permit(sl. The orange placard must be ported on thejobsite and
visible from public view.
