The Items referenced are followed by comments made by Bolton & Menk, Inc. addressing the Item and are referenced on survey map by item number. Items 1, 2,4 through 13, 16, and 17, Schedule B - Exceptions are not addressed on this survey. NOTES CORRESPONDING TO SCHEDULE B - EXCEPTIONS LEGAL DESCRIPTION STATEMENT OF POSSIBLE ENCROACHMENTS The following are possible encroachments that may affect the subject property. R NOTES TO LEGAL DESCRIPTION The Exhibit A provided in the Title Commitment has two descriptions for the same property. The first description commences on the West line of the East Half of the Southwest Quarter 457 feet south of the Southerly line of the Railroad; The second description commences from the southwest corner of the Union Free High School grounds. Both descriptions describe a tract of land 20 rods east-west by 5 rods north-south. For the purposes of this survey it is assumed the Union Free High school grounds is that certain tract of land deeded to the Union Free High School District dated May 31, 1912 and recorded June 5th, 1912 as Document No. 116111A Said Union Free High school grounds tract commences at the south side of the railroad right of way and runs south along the west line of the East Half of the Southwest Quarter 457 feet. THEREFORE: The two described tracts of land coincide with each other. The descriptions contain unmodified directional calls such as "north" "south" "east" and "west" with no further indication of direction being given and is therefore ambiguous. For the purposes of this survey the calls of North and South have been interpreted to mean along and/or parallel with the west line of the East Half of the Southwest Quarter. The calls of East and West have been interpreted to mean at right angles to the west line of the East Half of the Southwest Quarter. For the purposes of this survey the West line of the East Half of the Southwest Quarter is based on the recorded Plat of Roberts (1875) and Murray's Addition to Roberts (1920). As per said recorded plats, the centerline of South Division Street is the West line of the East Half of the Southwest Quarter. The location of South Division Street was determined by found survey monumnetation as shown on the survey drawing. Two concrete pads are 2.7' south of the north boundary line. An electric cabinet is 1.6' south of the north boundary line A fence line is 0.8' to 10.2' west of the east boundary line The edge of a bituminous surface is 0.8' to 10.2' west of the east boundary line A concrete pad with a transformer are on the east boundary line A fence line runs 2.6' to 6.8' south of the south boundary line. An overhead electric line runs across the subject property to the adjoining residence to the south Any encroachment, encumbrance, violation, variation, or adverse circumstance affecting the Title that would be disclosed by an accurate and complete land survey of the land. Possible occupation and potential encroachments are shown on this map. Subject to road(s) as shown by available maps. The right of way depicted for South Division Street is shown based on observations and 33' offsets east and west from the determined centerline as-built. This closely matches occupation lines and found survey monuments. Record plats indicate 66' total right of way for South Division Street. Village of Roberts Corporate Boundary filed April 2, 2003 as Document Number 715622 (Vol. 2191, page 629). Bolton & Menk, Inc. was not provided with the Village of Roberts Corporate Boundary filed April 2, 2003 as Document Number 715622 (Vol. 2191, page 629). No determination with regards to corporate limits was made. ALTA/NSPS LAND TITLE SURVEY ROBERTS, WISCONSIN TITLE COMMITMENT NO. 660067 1514 15 1 2 3 SURVEYOR'S NOTES 1.There are discrepancies between the boundary lines of the property as shown on this Survey Map and those in the legal description presented in the title insurance commitment used for this survey. 2.Fee ownership is vested in Viola L. Dull (marital status unknown); subject to the Purchaser's interest of Kenric Witthoft (marital status unknown) , per above described title commitment. 3.The boundary lines of the subject property are contiguous with the boundary line of the adjoining public street (South Division Street) 4.Bolton & Menk, Inc. was provided with legal descriptions for the properties adjoining to the south (Document No. 1028770) and north (Document No. 116111A) of the subject property. The subject property (Document No. 131320A) in the title commitment relies on the deed for the "Union Free High School"(Document No. 116111A) and both reference a distance of 457 feet south of the southerly railroad right of way line. The adjoining property to the south references Document No. 131320A (subject property) for its commencement point and also references its southern line when closing. The parcels are intended to be contiguous. 5.Bolton & Menk, Inc. was not provided with legal descriptions for the properties adjoining the east side of the subject property. Since Bolton & Menk, Inc. was not provided said legal descriptions, no determination was made as to whether or not there are any gaps or overlaps created by the descriptions of the adjoining property to the east and the description of the subject property. 6.The boundary for the subject property as shown on this survey map was established based on the determined centerline of South Division Street, and record distances (from the legal description provided in title commitment). My opinion is that the centerline of South Division Street was presumed to be the west line of the East Half of the Southwest Quarter. This opinion is largely developed based on the recorded Plat of Roberts and Murray's Add to Roberts. 7.The subject property has constructed vehicular access to and from South Division Street. Bolton & Menk, Inc. was not provided documentation about whether said South Division Street right of way exists per a plat dedication, by recorded easement, by prescriptive easement, or by fee acquisition by the controlling governing entity. This surveyor is not aware of any controlled access restrictions for the South Division Street right of way. Bearing Basis 8.Orientation of the bearing system used for this survey is based on the NAD 83(1996) coordinate projection for St. Croix County, Wisconsin. Miscellaneous 9.Subject property is Abstract property. 10.Not all site improvements are shown on this survey map. This includes piping, support structures and other incidental improvements within the site.
